PROJECT SUMMARY: The applicant proposes to construct a single -family -dwelling, pool, parking area, wooden bridge, 2 piers, rip rap, retaining wall, and wooded wetland fill. Richard Fertig Fertig Project Salvo Beaufort County Project setting Atlantic Environmental Consultants, LLC on behalf of Mr. Richard Fertig has submitted the attached CAMA Major Permit application for construction of a single-family dwelling, elevated wood bridge, 2 piers, rip rap, retaining wall and section 404 wetland fill. The project site is located at 26212 Otter Way (lot 19r) in the Wind over Waves phase III subdivision on the Pamlico Sound in the Town of Salvo in Dare County, North Carolina. Mr. Fertig does not currently own the property. He has a signed offer to purchase and contract form signed by him as well as the seller, which is Wind over Waves. Lot 19R is 4.6 acres in size with t2,508 linear feet of shoreline. This lot is peninsula that projects into the Pamlico Sound and is connected to the shoreline high ground through a narrow strip of land that is approximately 40' in width bordered by the Pamlico Sound on both the north and south side. This small strip of land has a fringe of coastal wetlands on both sides of less than 10'. The remainder of the spit has been delineated as section 404 wetlands. This small connection progresses into a large peninsula containing a variety of coastal wetland plants included but not limited to Spartina patens (salt meadow grass), Scirpus pungens (three -square) and Juncus romerianus (Black needlerush) surrounding the perimeter. These coastal wetlands transition to delineated section 404 wetlands under the jurisdiction of the US Army Corps of Engineers. These Section 404 wetlands then transition to an upland area near the strip of land which connects to the upland shoreline of the Wind over Waves subdivision. The property is bordered on both the upstream (north) and downstream (south) sides by the Pamlico Sound. The southern side of the peninsula is referred to as Midgette Cove. Wind over Waves subdivision has vacant lots as well as lots under various stages of development and several with complete single-family residences. Previous State permits listed for this property area include SW-7080907, low density stormwater permit issued 03/2712009, and SW-7050909 issued 09/26/2005. No history of archaeological sites was available for this property. The Pamlico Sound in this area is classified SA HQW by the Environmental Management Commission. This section of the Sound is designated as coastal waters, and is in the Pasquotank river basin and is open to shell fishing. The project site is not located within a Primary Nursery Area. Water depths in the Midgette Cove area are approximately 3.0' below Normal Water Level (NWL). No SAV's were observed in this area during the on - site visit. Project description The applicant proposes to fill section 404 wetlands under the jurisdiction of the US Army Corps of Engineer in two separate areas totaling 1,325 ftz of the narrow strip of land for the approaches to a proposed 70 ft. long x 12 ft. wide vehicular bridge to provide access from the upland shoreline of the Wind over Waves subdivision to the upland area on the peninsula. A 12' wide gravel driveway is proposed to connect to Otter way. A 54' x 40' single-family dwelling with a 10' wide covered deck, pool and parking area will be constructed on this upland area of the peninsula. An approximately 600 linear foot retaining wall is proposed immediately landward of the delineated section 404 wooded wetlands surrounding the upland area of the peninsula. Approximately 1,235 linear feet of rip rap with an 8' wide base width is proposed immediately water ward of the Coastal Wetlands surrounding the perimeter of the peninsula. An 85-foot-long section of this riprap will be located 30 feet water ward of NWL with a 6ft. wide opening and function as a breakwater. Two piers are proposed as part of this application. A 50' long x 6' wide pier with a 50' long x 6' wide L-head dock will be located on the southern side of the peninsula into Midgett Cove. This pier will have 3 tie pilings to create 2 fixed slips. Water depths in this located are approximately 3.0' below NWL. Additionally, a 305' long x 6' wide walkway will traverse the Coastal Wetland on the west side of the peninsula and then extend 100' into Pamlico Sound. A 20' x 20' covered platform will be constructed on the terminal end of this pier. Anticipated impacts The applicant proposes to disturb ±21,605 ft2 of land including the filling of±1,325 ft2 of Section 404 wooded wetlands. 840 ft2 of section 404 wetlands will be shaded as a result of the bridge construction. The construction of the single-family dwelling and associated structures will result in approximately 5.7 % of impervious surface in the Coastal Shoreline AEC. Approximately 2,010 ft2 of Coastal Wetlands will be shaded by the construction of the two piers. No SAV's will be impacted by the installation of the wet boat slips. Approximately 1,600 ft2 of sound bottom will be shaded as a result of the pier and platform construction. The installation of the riprap will result in the filling of 9,880 ft2 of sound bottom.
