Briefly describe the proposed permitting action and facility background: The Town of Tryon has
applied for an NPDES permit renewal at 1.5 MGD in May 2018. This facility serves a population of
2,500 residents with 1 significant industrial users (SIUs) in their pretreatment program. Treated
wastewater is discharged into Vaughn Creek, a class C water in the Broad River Basin. The facility has a
primary Outfall 001. The average flow as reported in the 2018 permit renewal application was 0.358
MGD.

4. Instream Data Summary
Instream monitoring may be required in certain situations, for example: 1) to verify model predictions
when model results for instream DO are within 1 mg/l of instream standard at full permitted flow; 2) to
verify model predictions for outfall diffuser; 3) to provide data for future TMDL; 4) based on other
instream concerns. Instream monitoring may be conducted by the Permittee, and there are also
Monitoring Coalitions established in several basins that conduct instream sampling for the Permittee (in
which case instream monitoring is waived in the permit as long as coalition membership is maintained).
If applicable, summarize any instream data and what instream monitoring will be proposed for this
permit action: The current permit requires instream monitoring for dissolved oxygen, temperature and
conductivity 100 feet upstream of outfall 001 and downstream of the outfall, 50 feet upstream of Pacolet
River. The Permittee provided sampling data in compliance with their permit requirements which has
been summarized in Table 2, shown below.

Students t-tests were run at a 95% confidence interval to analyze relationships between instream
samples. A statistically significant difference is determined when the t-test p-value result is < 0.05.
The downstream temperature did not exceed 29 degrees Celsius [per 15A NCAC 02B .0211 (18)]. The
temperature differential was greater than 2.8 degrees Celsius on no occasion during the period reviewed.
It was concluded with 95% confidence that no statistically significant difference between upstream and
downstream temperature exists.
Downstream DO did not drop below 5 mg/L [per 15A NCAC 02B .0211 (6)] during the period reviewed.
It was concluded with 95% confidence that no significant difference between upstream and downstream
DO exists.
It was concluded that a statistically significant difference exists between upstream and downstream
conductivity. Effluent conductivity was consistently higher than upstream conductivity during the review
period and appears to be influencing conductivity levels downstream. However, due to the facility
consistently passing chronic toxicity testing, the heightened conductivity is likely not having negative
impacts downstream
The draft permit maintains the same instream monitoring requirements as the current permit.

5. Compliance Summary

violations resulting in enforcement between August 2016 and February 2020.

6. Water Quality-Based Effluent Limitations (WQBELs)
Dilution and Mixing Zones
In accordance with 15A NCAC 2B.0206, the following streamflows are used for dilution considerations
for development of WQBELs: 1Q10 streamflow (acute Aquatic Life); 7Q10 streamflow (chronic Aquatic
Life; non-carcinogen HH); 30Q2 streamflow (aesthetics); annual average flow (carcinogen, HH).

Oxygen-Consuming Waste Limitations
Limitations for oxygen-consuming waste (e.g., BOD) are generally based on water quality modeling to
ensure protection of the instream dissolved oxygen (DO) water quality standard. Secondary TBEL limits
(e.g., BOD= 30 mg/l for Municipals) may be appropriate if deemed more stringent based on dilution and
model results.
If permit limits are more stringent than TBELs, describe how limits were developed: The results of the
1981 Level B model indicated that secondary BOD5 limits were adequately protective of the stream. No
changes are proposed.
Ammonia and Total Residual Chlorine Limitations
Limitations for ammonia are based on protection of aquatic life utilizing an ammonia chronic criterion of
1.0 mg/l (summer) and 1.8 mg/l (winter). Acute ammonia limits are derived from chronic criteria,
utilizing a multiplication factor of 3 for Municipals and a multiplication factor of 5 for Non-Municipals.
Limitations for Total Residual Chlorine (TRC) are based on the NC water quality standard for protection
of aquatic life (17 ug/l) and capped at 28 ug/l (acute impacts). Due to analytical issues, all TRC values
reported below 50 ug/l are considered compliant with their permit limit.
Describe any proposed changes to ammonia and/or TRC limits for this permit renewal: Monthly and
weekly average ammonia limits were added to the permit in 2016 based on the results of instream
wastewater concentration-based calculations. Ammonia limits have been reviewed in the attached WLA
form and have been found to be protective. No changes are proposed.
The facility uses chlorination as its primary disinfection. The current permit limits TRC at 28 ug/L as a
daily maximum. Though several reported TRC values exceeded the 28 ug/L daily maximum limit, the
facility is considered compliant with its permit since all reported values were less than 50 ug/L. The TRC
limits have been reviewed in the attached WLA and have been found to be protective. No changes are
proposed for TRC.

Reasonable Potential Analysis (RPA) for Toxicants
The need for toxicant limits is based upon a demonstration of reasonable potential to exceed water quality
standards, a statistical evaluation that is conducted during every permit renewal utilizing the most recent
effluent data for each outfall. The RPA is conducted in accordance with 40 CFR 122.44 (d) (i). The NC
RPA procedure utilizes the following: 1) 95% Confidence Level/95% Probability; 2) assumption of zero
background; 3) use of ½ detection limit for “less than” values; and 4) streamflows used for dilution
consideration based on 15A NCAC 2B.0206. Effective April 6, 2016, NC began implementation of
dissolved metals criteria in the RPA process in accordance with guidance titled NPDES Implementation of
Instream Dissolved Metals Standards, dated June 10, 2016.
A reasonable potential analysis was conducted on effluent toxicant data collected between October 2016
and January 2020. Pollutants of concern included toxicants with positive detections and associated water
quality standards/criteria. Based on this analysis, the following permitting actions are proposed for this
permit:
Effluent Limit with Monitoring. The following parameters will receive a water quality-based
effluent limit (WQBEL) since they demonstrated a reasonable potential to exceed applicable
water quality standards/criteria: Copper, Chloride
Monitoring Only. The following parameters will receive a monitor-only requirement since they
did not demonstrate reasonable potential to exceed applicable water quality standards/criteria,
but the maximum predicted concentration was >50% of the allowable concentration: Bis (2-
ethylhexyl) phthalate [based on limited data set]
No Limit or Monitoring: The following parameters will not receive a limit or monitoring, since
they did not demonstrate reasonable potential to exceed applicable water quality
standards/criteria and the maximum predicted concentration was <50% of the allowable
concentration: Arsenic, Beryllium, Cadmium, Total Chromium, Cyanide, Lead, Nickel,
Selenium, Silver, Zinc, Total Phenolic Compounds
If applicable, attach a spreadsheet of the RPA results as well as a copy of the Dissolved Metals
Implementation Fact Sheet for freshwater/saltwater to this Fact Sheet. Include a printout of the RPA
Dissolved to Total Metal Calculator sheet if this is a Municipality with a Pretreatment Program.
Toxicity Testing Limitations
Permit limits and monitoring requirements for Whole Effluent Toxicity (WET) have been established in
accordance with Division guidance (per WET Memo, 8/2/1999). Per WET guidance, all NPDES permits
issued to Major facilities or any facility discharging “complex” wastewater (contains anything other than
domestic waste) will contain appropriate WET limits and monitoring requirements, with several
exceptions. The State has received prior EPA approval to use an Alternative WET Test Procedure in
NPDES permits, using single concentration screening tests, with multiple dilution follow-up upon a test
failure.
Describe proposed toxicity test requirement: This is a Major POTW, and a chronic WET limit a will
continue on a quarterly frequency at Outfall 001 at 37% effluent.
Mercury Statewide TMDL Evaluation
There is a statewide TMDL for mercury approved by EPA in 2012. The TMDL target was to comply
with EPA’s mercury fish tissue criteria (0.3 mg/kg) for human health protection. The TMDL established a

wasteload allocation for point sources of 37 kg/year (81 lb/year), and is applicable to municipals and
industrial facilities with known mercury discharges. Given the small contribution of mercury from point
sources (~2% of total load), the TMDL emphasizes mercury minimization plans (MMPs) for point source
control. Municipal facilities > 2 MGD and discharging quantifiable levels of mercury (>1 ng/l) will
receive an MMP requirement. Industrials are evaluated on a case-by-case basis, depending if mercury is a
pollutant of concern. Effluent limits may also be added if annual average effluent concentrations exceed
the WQBEL value (based on the NC WQS of 12 ng/l) and/or if any individual value exceeds a TBEL
value of 47 ng/l

Describe proposed permit actions based on mercury evaluation: Since no annual average mercury
concentration exceeded the WQBEL, and no individual mercury sample exceeded the TBEL, no mercury
limit is required. Since the facility is < 2 MGD, no MMP special condition is required in the permit.

15A NCAC 2H.0107( c)(2)(B), 40CFR 122.47, and EPA May 2007 Memo: As total copper and chloride
demonstrated reasonable potential to exceed the facility’s allowable discharge concentrations based on
state surface water standards, monthly average and daily maximum limits have been put in the permit for
total copper and chloride. After discussing the limits with the Permittee, the Permittee requested a
schedule of compliance to provide time to locate issues and come into compliance with the new limits. A
3-year compliance schedule has also been put in the permit. Within 1 year of the permit’s effective date,
the Permittee shall submit to DWR an Action Plan for Division approval, summarizing the strategy or
actions to be taken to achieve compliance with the total copper and chloride limitations. The plan will
include specific dates for completion or implementation of each action. Within 2 years of the permit’s
effective date, the Permittee shall submit a report to the Division summarizing actions taken in
accordance with the Action Plan. The Town shall achieve compliance with total copper and chloride
limitations within 3 years of the permit’s effective date.
If applicable, describe any water quality standards variances proposed in accordance with NCGS 143-
215.3(e) and 15A NCAC 2B.0226 for this permit renewal: NA

7. Technology-Based Effluent Limitations (TBELs)

8. Antidegradation Review (New/Expanding Discharge):
The objective of an antidegradation review is to ensure that a new or increased pollutant loading will not
degrade water quality. Permitting actions for new or expanding discharges require an antidegradation
review in accordance with 15A NCAC 2B.0201. Each applicant for a new/expanding NPDES permit
must document an effort to consider non-discharge alternatives per 15A NCAC 2H.0105( c)(2). In all
cases, existing instream water uses and the level of water quality necessary to protect the existing use is
maintained and protected.
If applicable, describe the results of the antidegradation review, including the Engineering Alternatives
Analysis (EAA) and any water quality modeling results: NA
9. Antibacksliding Review:
Sections 402(o)(2) and 303(d)(4) of the CWA and federal regulations at 40 CFR 122.44(l) prohibit
backsliding of effluent limitations in NPDES permits. These provisions require effluent limitations in a
reissued permit to be as stringent as those in the previous permit, with some exceptions where limitations
may be relaxed (e.g., based on new information, increases in production may warrant less stringent TBEL
limits, or WQBELs may be less stringent based on updated RPA or dilution).

10. Monitoring Requirements
Monitoring frequencies for NPDES permitting are established in accordance with the following
regulations and guidance: 1) State Regulation for Surface Water Monitoring, 15A NCAC 2B.0500; 2)
NPDES Guidance, Monitoring Frequency for Toxic Substances (7/15/2010 Memo); 3) NPDES Guidance,
Reduced Monitoring Frequencies for Facilities with Superior Compliance (10/22/2012 Memo); 4) Best
Professional Judgement (BPJ). Per US EPA (Interim Guidance, 1996), monitoring requirements are not
considered effluent limitations under Section 402(o) of the Clean Water Act, and therefore anti-
backsliding prohibitions would not be triggered by reductions in monitoring frequencies.

11. Electronic Reporting Requirements
The US EPA NPDES Electronic Reporting Rule was finalized on December 21, 2015. Effective
December 21, 2016, NPDES regulated facilities are required to submit Discharge Monitoring Reports
(DMRs) electronically. Effective December 21, 2020, NPDES regulated facilities will be required to
submit additional NPDES reports electronically. This permit contains the requirements for electronic
reporting, consistent with Federal requirements.

and Division responses has been attached as an addendum to the fact sheet. The DWR Asheville Regional

Office commented on the permit regarding the facility’s components list. The digester had been converted
to a sludge thickener and holding pond. The component list has been updated. The draft permit was also
submitted to US EPA Region 4, the Division Operator Certification Program, the DWR Aquatic
Toxicology Branch and the DWR PERCS unit. No comments were received from each of these groups.

Please accept the following comments regarding the draft NPDES permit renewal for the Tryon WWTP:
We disagree with the decision to remove the monitoring requirements for selenium, cyanide and zinc and would
request that those monitoring requirements be reinstated.
We agree with and support the decision to add total copper and chloride limits and change the quarterly
monitoring requirement to monthly.
We suggest reducing the schedule of compliance for copper and chloride from 3 years to 1 year.
We suggest that the monitoring frequency for bis ( 2- ethylhexyl) phthalate be increased from quarterly to
monthly.
We support the effluent hardness and instream hardness monitoring requirements, but suggest increasing the
frequency from quarterly to monthly.

Fact Sheet Addendum
The Division received comments from the MountainTrue Organization on May 8, 2020 and provides the
following responses:
1. Comment: We disagree with the decision to remove the monitoring requirements for selenium, cyanide and
zinc and would request that those monitoring requirements be reinstated.
Response: Based on the results of the reasonable potential analysis (RPA) demonstrating no reasonable
potential for selenium, cyanide and zinc to exceed surface water quality standards, monitoring is not necessary
for these parameters. As such, the removal of monitoring requirements for selenium, cyanide and zinc has been
maintained in the final permit.
2. Comment: We suggest reducing the schedule of compliance for copper and chloride from 3 years to 1 year.
Response: When conducting the reasonable potential analysis (RPA) for the Tryon WWTP, total copper and
chloride both demonstrated reasonable potential to exceed surface water quality standards. After we informed
the Town that we would be putting limits in their permit for both copper and chloride, the Town requested a
compliance schedule for both parameters, in accordance with 40 CFR 122.47(a)(1). The Town mentioned that
they need time to locate the source(s) of these parameters, manage the source adequately to reduce the
concentrations, and to come into compliance with the permit limits. In discussing the timeline with the Town,
we agreed upon a 3-year schedule to allow the Town to conduct their investigation into the source for both
parameters and to handle each appropriately. Per 40 CFR 122.47(a)(3), “compliance schedules that are longer
than one year in duration must set forth interim requirements and dates for their achievement.” For the duration
of the compliance schedule, the Town would have annual milestones to report to the Division. After the first
year, the Town shall submit a corrective action plan to the Division for approval. After the second year, the
Town shall submit a progress update to the Division to ensure they are making progress toward compliance.
After the third year, the Town shall achieve compliance with the permit limit. The Division feels this
compliance schedule would promote the Town coming into compliance with their permit limits as soon as
possible. Thus, the schedule will maintain a 3-year duration.
3. Comment: We suggest that the monitoring frequency for bis (2 – ethylhexyl) phthalate be increased from
quarterly to monthly.
Response: A reasonable potential analysis (RPA) was conducted on the bis (2-ethylhexyl) phthalate data
reported by the Town in their Priority Pollutant Analyses. Of the 5 samples, 4 were reported below the detection
limit. Based on Division guidance provided in a 7/15/2010 memo regarding implementation of RPA conditions,
when reasonable potential to exceed surface water quality standards exists, but the data set is limited (n < 9
samples) and fewer than 2 samples exceeded the allowable discharge concentration, quarterly monitoring is
added to the permit. As bis (2-ethylhexyl) phthalate falls into this category, quarterly monitoring has been
maintained in the final permit.
4. Comment: We support the effluent hardness and instream hardness monitoring requirements, but suggest
increasing the frequency from quarterly to monthly.
Response: Based on 2016 permitting guidance for NPDES Implementation of Instream Dissolved Metal
Standards, to build a more robust hardness dataset, all Municipal and Industrial Permittees, with a discharge to
freshwater, required to sample for hardness-dependent metals shall get quarterly monitoring requirements for
effluent hardness and instream hardness, upstream of the discharge. All Pretreatment POTWs sampling for
hardness-dependent metals (as part of their Pretreatment LTMP/STMP or as a permit requirement) shall
get quarterly monitoring requirements for effluent hardness and instream hardness, upstream of the discharge.
As the Town falls into both categories, quarterly monitoring has been maintained in the final permit.

Inspector Mikal Willmer, with the Asheville Regional Office, conducted a compliance evaluation
inspection of the Tryon WWTP on March 16, 2020. This inspection was conducted to determine
whether the facility is operating in compliance with NPDES Permit No. NC0021601. Deborah Bradley
(ORC) and Michael Fife (BORC) were present and assisted in the inspection.
The facility appeared to be in compliance at the time of the inspection. Comments/recommendations
are listed below.
Maintenance: The Town has been taking active steps to improve facility performance and make repairs.
Since the last inspection in 2018, the weirs and center feed well in clarifier #2 have been repaired, two
new pumps have been installed in the scum box and RAS pumps have been rehabilitated. The weir
teeth in clarifier #1 still need to be replaced and should be kept in the budget to be completed once
major deficiencies in the collection system are addressed.
Flow: Staff report average flows are 0.25 MGD and currently no new growth or expansion within the
system. Continue to assess the current mechanical bar screen. Mr. Fife and Ms. Bradley indicated the
mechanical screen has issues handling flows above 0.7 MGD. The facility is rated for 1.5 MGD. A
reduction in I&I from the collection system would reduce these flow swings. The Town is currently
working on projects within the CS.
Chlorine/Dechlor: Facility utilizes chlorine gas a liquid calcium thisoulfate solution. Chlorine Sales &
Services replaces all tubing and calibrates feed equipment once a year. Feeds were flow paced;
however, the system had trouble consistently feeding small doses, so it is now a manual feed. Staff
report they do not have to adjust feed rates too often. If manually feeding, more process control checks
during rain events is recommended to maintain adequate disinfection. Solids are removed
approximately once a year from the contact chamber.
Receiving Stream: no visual impacts noted at the time of the inspection. The foam observed in 2018
was not observed during this inspection.
