A copy of the General Certification is attached. This Certification may be used in qualifying for coverage under Corps of Engineers' Nationwide Permit No. 3. District Engineer post office Box 250 North Wilkesboro, North Carolina 2865,9 Reference is made to your letter of February 1, 1993, regarding your plans to discharge dredged/fill material into the waters/wetlands of unnamed tributaries of Grassy Fork Creek, associated with the replacement of two existing pipe culverts with the paving upgrade of S.R. 1913 (Minning Ridge Road), Benham, Wilkes County, North Carolina. Reference is also made to Mr. Joe Mickey's letter of February 4, 1993, in which the North Carolina Wildlife Resources Commission expressed no objections to the planned road improvements provided that: a. No heavy equipment is operated in the live streams in order to minimize sedimentation and prevent introduction of other pollutants. b. Erosion control measures should be implemented where soil is disturbed and maintained until project completion. For the purposes of the U.S. Army Corps of Engineers' Regulatory Program, Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the Federal Register on November 22, 1991, lists nationwide permits (NWP). Authorization, pursuant to Section 10 of the Rivers and Harbors Act of 1899 and Section 404 of the Clean Water Act, was provided for the repair, rehabilitation, or replacement of any previously authorized, currently serviceable structure or fill; or of any currently serviceable structure or fill constructed prior to the requirement for authorization, provided that the structure or fill is not to be put to uses differing from those uses specified or contemplated for it in the original permit or the most recently authorized modification. Dear Mr. Bennett: -2- Special conditions of this permit state that before discharging dredged or fill material into waters of the United States occurring within the twenty-five mountain counties of North Carolina that contain trout waters, the applicant will obtain a letter of approval from the North Carolina Wildlife Resource Commission. Review of the information you have provided, and the comments submitted by the North Carolina Wildlife Resources Commission, reveals that your proposed work of the replacement of two existing culverts for the purpose of upgrading to meet current safety standards, is authorized by NWP provided it is accomplished in strict accordance with the enclosed conditions and the recommendations set forth by the Wildlife Resources Commission. This NWP does not relieve you of the responsibility to obtain any required State or local approval. You should contact Mr. John Dorney, North Carolina Division of Environmental Management, (919) 733-5083, to obtain the necessary Section 401, Water Quality Certification prior to starting work. This verification will be valid for 2 years from the date of this letter unless the NWP authorization is modified, reissued, or revoked. Also, this verification will remain valid for the 2 years if, during that period, the NWP authorization is reissued without modification or the activity complies with any subsequent modification of the NWP authorization. If during the 2 years, the NWP authorization expires or is suspended or revoked, or is modified, such that the activity would no longer comply with the terms and conditions of the NWP, activities which have commenced (i.e., are under construction) or are under contract to commence in reliance upon the NWP will remain authorized provided the activity is completed within 12 months of the date of the NWP's expiration, modification or revocation, unless discretionary authority has been exercised on a case-by-case basis to modify, suspend, or revoke the authorization. The stone shall be sound, tough, dense, resistant to the action of air and water, and suitable in all other respects for the purpose intended. Where broken concrete from demolished structures or pavement is avail- able, it may be used in place of stone provided that such use meets with the approval of the Engineer. However, the use of broken concrete which contains reinforcing steel will not be permitted. The stone or broken concrete shall be graded to meet the following rectuirements: 1. For Class 1 Rip Rap. Stone shall vary in weight from 5 to 200 pounds. At least 30 percent of the total weight of the rip rap shall be in individual pieces weighing a minimum of 60 pounds each. Not more than 10 percent of the total weight of the rip rap may be in individual pieces weighing less than 15 pounds each. 2. For Class 2 Rip Rap. Stone shall vary in weight from 25 to 250 pounds. At least 60 percent of the total weight of the rip rap shall be in individual pieces weighing a minimum of 100 pounds each. Not more than 5 percent of the total weight of the rip rap may be in individual pieces weighing less than 50 pounds each. 691 EROSION CONTROL SCHEDULE (1) All adequate temporary erosion control measures will be installed before clearing and grubbing operations begin. (2) As construction progresses temporary and permanent erosion control devices shall be installed in a timely manner. (3) All siltation and erosion control devices shall be properly maintained until no longer needed. (4) As project progresses, request will promptly be made to the Division Roadside Environmental Unit for stage and permanent seeding. (5) Any removal of siltation devices will be based on the condition of established ground cover of that area the device is serving. Army Corps of Engineers 11413 Falls of the Neuse Road Wake Forest, NC 27587 Dear John: The Department of Transportation is scheduled to grade, drain, base, and pave primarily along the existing roadway of SR 1913 (Minning Ridge Rd.), in Wilkes County during the 1993-1994 fiscal year. Due to the proximity of said stream there are 2 existing cross line drainage structures that will need replacing, or upgrading, in which we are requesting a 404 Nationwide permit no. 14. Attached is a straight line sketch with proposed erosion control, stream, stream embankment, pipe crossings, construction limits, and marked county map. By copy of this letter I am asking Mr. Joe Mickey, Jr., of the North Carolina Wildlife Resources Commission District Fisheries Biologist to comment directly to you concerning the 404 Nationwide Permit request. Also by copy of this letter, I am requesting authorization to proceed under Section 401 of the Clean Water Act from the Division of Environmental Management.
