HomeMy WebLinkAboutGC 1663GENERAL CERTIFICATION THIS GENERAL CERTIFICA'T'ION is issued in conformity with the requirements of Section ~+Ol of Public Laws 92-500 and 95-217 of the United States and subject to the North Carolina Division of Environmental Management Regulations in 15 NCAC 2H, Section .0500 for the category of activity as specified below in the waters or adjacent wetlands of the State. 'T'his General Certification is valid for the placement of rip-rap as associated with shoreline stabilization. This General Certification is applicable to both private and government projects. This General Certification does not apply to jetties. The State of North Carolina certifies that this activity will not violate Sections 301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in accordance with the application and conditions hereinafter set forth. 1. That the rip-rap material be of such size so as not able to be carried off by wave action and consist of clean rock or masonry material free of debris or toxic pollutants. 2. That where the rip-rap material is to be placed below the mean high water mark, the applicant will take all reasonable measures to minimize adverse impacts on water quality. 3. That placement of rip-rap material will be limited to a maximum shoreline length of 500 feet and extend an average distance of not more than 2 feet waterward of the mean high water (MHW} elevation contour and at no point extend further waterward than 5 feet from the MHW elevation. 4. That the turbidity of the water not be increased by more than: a. 25 NTU for those activities where the activity occurs in designated shellfish waters. b. 10 NTU for those activities where the activity occurs in designated trout waters. c. 50 NTU for those activities in all other waters or wetlands. The turibity condition (a, b, or c) will be designated by the Division of Environmental Management. 5. The applicant shall accept liability and hold the State harmless for any damages which may occur as a result of the activity or if the intents of the activity are not fulfilled under this certification. b. That the Director of the North Carolina Division of Environmental Management may require submission of a formal application for certi- fication for any project of this type, if it is deemed necessary to assure the protection of water quality standards.
