June 16, 2020 File: Little Ivy Stream Restoration Project Madison County, NC French Broad River Basin, CU 06010105 Attention: NC DEQ – Division of Water Resources 401 & Buffer Permitting Unit Supervisor 512 North Salisbury St. Raleigh, North Carolina 27604 Reference: Little Ivy Stream Restoration Project Section 401 Permit Resource Institute, Inc. (RI) is seeking approval from the NC DEQ for a Section 401 Permit for construction of the Little Ivy Stream Restoration Site (the Site) in Madison County, North Carolina. Restoration is proposed for approximately 571 linear feet of California Creek, 481 linear feet of Paint Fork Branch, and 687 linear feet of Little Ivy Creek. Funding for the proposed restoration efforts is being coordinated by RI and the Natural Resources Conservation Service (NRCS) and is a combination of state funding and the NRCS Environmental Quality Incentives Program (EQIP). RI has contracted with Stantec Consulting Services Inc to provide design and construction oversight services for the implementation of the restoration. The preliminary construction plans are included as an attachment to this permit application. The following is a brief description of the site conditions and the proposed restoration efforts. Project Location The Little Ivy (Metcalf) Stream Restoration project (the Site) is located approximately 2.7 miles east of Mars Hill, in Madison County, NC. The upstream end of the project lies at LAT/LONG 35.82098611 º N, 82.50309722ºW. The Site drains to the French Broad River (USGS 8-digit Hydrologic Unit Code 06010105). The majority of the project property is privately owned by Mr. Clifton Metcalf with smaller portions owned by Ms. Jane Barrow, the Madison County Board of Education and Ms. Judith Futch. Property and Land Use Historic land use at the Site has consisted primarily of agricultural production. Additional land use practices, including excavation of drainage ditches, maintenance and removal of riparian vegetation and relocation, dredging, and straightening of streams have contributed to the June 16, 2020 Page 2 of 3 Reference: Seniard Creek Mitigation Site Erosion Control Plan Review unstable channel characteristics, and degraded water quality. Previous efforts by others to reinforce the channels of Paint Fork, California Creek, and Little Ivy Creek on the site have also led to greater instability, particularly at the confluence of Paint Fork and California Creek. Current stream conditions at the Site consist of incised channels with unstable banks and limited riparian buffers. Restoration Goals and Objectives The goal of the project is to restore ecological function to the existing streams, floodplains and riparian corridors. Measures to promote functional uplift will include returning the degraded streams to a stable condition, restoring floodplain connectivity, and revegetating the riparian area with native plant species appropriate for the given valley and watershed conditions. Benefits of grading activities will be to improve riparian hydrology and increase hydrologic access of the floodplain for overbank flows. Stream restoration activities will also yield improved water quality by re-establishment of a wooded riparian area and stabilized stream banks resulting in reduced downstream sediment load. Improvement of terrestrial and aquatic habitats will result from re- establishment of native vegetation in the riparian buffer, improved landform complexity associated with the floodplain grading, and improved stream habitat complexity. Existing Conditions The watershed is partially forested, with agricultural and low-density residential land use composing the remainder. The majority of the land within the Site boundary has been in agricultural production for at least the last twenty-five years. California Creek flows from northwest to southeast until it merges with Paint Fork towards the middle of the project site. From here, Little Ivy Creek flows southwest towards Ivy Creek with a contributing watershed of approximately 38.6 square miles. Many of the channel banks throughout the site are actively eroding bluffs which contribute significantly to the sediment input into Ivy Creek. Restoration Methods To correct erratic meander behavior, a geomorphically stable pattern, consistent with a Type-Bc stream, will be returned to Paint Fork Branch and California Creek by realigning the channel and repairing actively eroding banks. Channel dimensions and alignment along Little Ivy Creek will be returned to a stable Type-C stream. A new floodplain will be excavated at bankfull elevation which will increase flood conveyance and correct channel incision, therefore reducing stress on the bed and banks during flood events. In-stream log structures, as well as brush toe structures, will be installed to increase bed form and aquatic habitat diversity, and will be constructed using onsite material whenever possible. The proposed channel bed will be constructed of onsite, native bed material. Following channel construction, native woody and herbaceous species will be installed to establish a protected riparian buffer. Wetland and Stream Impacts Jurisdictional wetlands have not been delineated within the limits of the proposed construction activities. Unavoidable, stream impacts will occur along approximately 2,042 linear feet of California June 16, 2020 Page 3 of 3 Reference: Seniard Creek Mitigation Site Erosion Control Plan Review Creek, Paint Fork Branch and Little Ivy Creek in order to construct the channels along the proposed alignments, repair deteriorating banks and provide approximately 1,739 linear feet of restoration. Efforts will be made to minimize the impacts to the channel banks and, where disturbances occur, bank stabilization techniques will be implemented to re-establish native vegetation. Summary Stantec anticipates significant superficial ground disturbance will occur during construction activities due to the use of heavy equipment in the installation of stream restoration components. These activities are necessary to reverse the extensive degradation of the Sites streams, resulting from a history of erosion and human manipulation. The temporary disturbance caused by this project will result in the long-term enhancement and restoration of stable stream functions, and the improvement of aquatic, terrestrial and avian habitat. This property, and many adjacent properties, are used for agricultural production. Site streams exhibit excessive erosion and instabilities due to these agricultural practices. Previous efforts by others to reinforce the channels of Paint Fork, California Creek, and Little Ivy Creek on the site have led to greater instability, especially at the confluence of Paint Fork and California Creek. 3b. Erosion control measures will be installed prior to any land disturbing activity to prevent erosion and retain sedimentation onsite. Where the stream channel departs from morphologically stable conditions, it will be reconstructed with proper dimension, pattern and profile. Restoration will include the excavation of a new floodplain and the installation of in-stream structures to provide stream bed integrity and improved habitat for aquatic species. Native vegetation will be planted to provide restoration of a natural forested buffer adjacent to the stream channels and habitat for insect, terrestrial and avian species. Upon completion of the work, all access roads, staging areas, construction entrances and silt fence will be removed and all disturbed soils will be stabilized with mulch and native seed to establish permanent ground cover. RI will assist the farmer/landowner by helping ro address issues related to managing and contracting for the required design, planning, permitting and construction work for stream enhancement practices on the site, as well as necessary structure work, and bank stabilization. RI's objective is to help address current water quality degradation issues; however, work cannot be guaranteed for acts of nature related to flood events. RI is working with NRCS, Conservation Districts and the farmer/landowner to help reduce those impacts as much as possible.
