There is 325 linear feet of Goose Creek and unnamed tributaries to Goose Creek within the project area which include five streams. There is 0.113 acre of wetlands adjacent to Goose Creek within the project area which include seven wetlands. The enclosed permit application request is for construction of a lift station, forcemain, and gravity sewer line. This permit application request is in additional to the original request submitted and approved in 2018 by the Corps and NC DWR. Copies of the previous approvals including the approved preliminary jurisdictional determination are enclosed for your reference. All the previously approved impacts are still necessary. These included temporary impacts to 0.087 acre of herbaceous wetlands for construction access, dewatering, and open trench installation. Additional impacts included permanent conversion impacts to 0.026 acre of forested wetlands for a permanent maintenance right-of-way, permanent impacts to 60 linear feet of stream associated with the installation of ArmorFlex matting at original stream bed elevations for maintenance access, and 145,041 square feet of buffer disturbance. The pre-existing ground elevation within the wetlands will be re-established once construction is complete. The topsoil within the wetlands will be saved and used so that the herbaceous seed bank within the soil allows for quick herbaceous germination. Charlotte Water will be planting 0.032 acre of current herbaceous wetlands with trees within the construction corridor (on either side of the permanent maintenance corridor). Charlotte Water will be replanting 7.35 acres of woody vegetation within the construction corridor. A copy of the DMS receipt for buffer mitigation has been included for your reference. Construction of the project has begun. Stream crossings 3, 4, and 7 from the original NWP 12 application have already been completed, are currently being completed, or will be started within the next week. These stream crossings were directionally bored. This permit application is requesting temporary stream impacts at crossings 1, 2, 5, 6, and 8 to open cut the stream bed as well as for pump arounds to work in the dry. The total linear footage requested at these five stream crossings is 190 linear feet. The pre-existing stream bed elevation will be restored once ATLAS Environmental, Inc. 338 S. The excavated stream bed material will be side cast along the stream bank and used to re-establish the pre-existing habitat. DWR's Goose Creek Buffer rules previously did not allow temporary stream impacts for sewer line construction therefore all eight stream crossings were presented as trenchless in the 2018 NWP 12 application. As of June 1, 2020, 15 NCAC 02B .0607 Site Specific Water Quality Management Plan For The Goose Creek Watershed (Yadkin Pee -Dee River Basin): Buffer Types And Management Activities Within Riparian Buffers were proposed to be revised including the Table of Uses to allow for temporary stream impacts for sewer line construction. This NWP 12 application is being submitted due to this revision in DWR's buffer rules. All of the stream crossings would have been proposed for temporary stream impacts in 2018 if these buffer rules had not prohibited these impacts. The primary drivers/benefits for shifting from directional boring to open trench stream crossings are that there is a lower risk of tunnel collapse and associated impacts to the environment as well as worker safety. Boring under the stream bed carries inherent risk of collapse where the soil between the tunnel and the stream bed fails and the pressure from the bore tunnel then breaks through the stream bed. Open trenching stream crossings eliminates this risk. Secondly, shorter construction duration is required for open trenching. Open trench installation can be performed in a much shorter time frame. This has cost and schedule benefits but also from an environmental standpoint, the temporary impact areas are disturbed for shorter timeframes and can be restored sooner. Thirdly, open trenching can be achieved at a lower cost. In addition to the shorter construction time frames, open trench installation requires less specialized equipment and operators as well as reduced mobilization costs. The design team has addressed all the previous agency comments received during the first application approval process. The following design steps have been taken to proactively mitigate any concern to the environment, water quality, and protected species. First, instream erosion control measures have been designed to meet the NCDEQ Erosion Control Manual's recommendation for High Quality Waters, specifically the stream pump around system shall be sized for a 25 year storm instead of the standard 10 year storm. Secondly, turbidity curtains have been added downstream of the five proposed open trench stream crossings in accordance with recommendations from DWR to ensure no sediment from temporary disturbances migrates downstream. This was a FWS concern as well for mussels but the addition of the turbidity curtain eliminates any downstream sediment migration. Atlas performed a mussel survey with FWS representatives in August 2017. No mussels were observed. Goose Creek, the unnamed tributaries to Goose Creek, and Stevens Creek are classified as "C" waters by DWR. The Corps, DWR, and two representatives from US FWS conducted site visits to the project area in 2017 and 2018. Atlas has conducted numerous site visits to the project area since 2017. Enclosed are the necessary permit documents and additional project information.
