Box 558 Elkin, N.C. 28621 Dear Mr. Atkins: Subject: Proposed fill in Wetlands or Waters Emergency road reconstruction, SR 1619 and SR 1334 Surry County DEM Project # 931030 Upon review of your request for 401 Water Quality Certification to place fill material in 0.02 acres of wetlands or waters which are tributary to Mitchell and Fisher River for emergency road construction located at SR 1619 & SR 1334 in Surry County as described in your submittal dated 8 December 1993, we have determined that the proposed fill can be covered by General Water Quality Certification No. 2745. A copy of the General Certification is attached. This Certification may be used in qualifying for coverage under Corps of Engineers, Nationwide Permit No. 3. This letter replaces the Certification issued on 17 December 1993. If this Certification is unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this Certification. This request must be in the form of a written petition conforming to Chapter 150D of the North Carolina General Statutes and filed with the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. Unless such demands are made, this Certification shall be final and binding. 1786. SAM HUNT SECRETARY The North Carolina Department of Transportation, District I Maintenance has discovered pipes at two locations in Surry County which are in bad condition and in need of immediate repair. We wish to replace these pipes to ensure the safety of the traveling public. The first line is a 48" CS pipe located on SR 1619 approximately 0.4 mile West of the Intersection of SR 1620. We plan to replace this existing line with approximately 40' of 48" BCCS pipe. A small unnamed stream flows through this pipe. It does not appear to affect any DEHNR designated trout streams. The second line is a 32" CS pipe located on SR 1334 approximately 600 LF East of the Intersection of SR 1330. We plan to replace this existing line with 40' of 40" BCCS pipe. A small unnamed stream which is a tributary to the Mitchell River flows through this pipe. It does not appear to affect any DEHNR designated trout streams. We are requesting a 404 Nationwide Permit (#3 Maintenance) from your agency since these pipe crossings involve small streams. I am sending a straight line sketch with the proposed erosion control, stream, and a marked county map showing the locations. By copy of this letter I am asking Mr. Joseph Mickey, Jr., North Carolina Wildlife Resources Commission District Fisheries Biologist to comment directly to you concerning the 404 Nationwide Permit Request. 4 Jolly - Emergency Permit Page 2 Also, by copy of this letter, I am requesting authorization to proceed under Section 401 of the Clean Water Act from the Division of Environmental Management.
