In response to the Notice of Deficiency (NOD-2020-PC-0194) issued April 13, 2020 pertaining to the 2019
Annual Report review for Permit No. W00038067, Terra Renewal Services (TRS) is providing the following
information (items are addressed in order presented in NOD letter):
Deficiencies:
1) We acknowledge that the samples collected for all four sources on February 11, 2019 (Q1) were at a
temperature of 8.01C (48.4°F) when checked in at the lab, which is above the required holding
temperature of s 6.0' C (42.8 ' F). Efforts will be made in the future to ensure that all samples are
delivered to the lab within the required holding temperature. If notified of this circumstance, we will
instruct the lab to discard the samples and collect new samples as replacement.
2) We acknowledge that seven (7) of the 28 fields that were land applied in 2019 were not soil sampled
within the calendar year per the requirements of the permit. Additional protocols are being
implemented in 2020 to ensure that soil samples are collected on all fields applied. This includes
sampling at an earlier time in the year (following last corn harvest) and then again in late November to
account for any fields that were applied after the first sampling event.
3) Standard Soil Fertility Analyses (SSFA) were provided from composite soil samples for several fields,
specifically MRF-20A & MRF-20B and MF-23A & MF-238. These fields are contiguous with respect to
the A & B designation and divided on a somewhat arbitrary boundary in the permit. The agronomic
practices are consistent across both sides of the divided field. These fields should have been sampled
separately since the volume of residuals applied are tracked and recorded separately and they are
designated as separate fields in Attachment B. In the future, separate SSFA reports will be submitted
for each individual field as designated in the permit.
Concerns:
a) The Arsenic concentration of 390 mglkg was incorrectly entered into Form RSSF for the sample
collected on August 26r 2019 for RVAF (Tyson) — Harmony on the original report. The correct value
was 2.5 mg/kg. This carried over to calculations on Forms MFLSF and FSF for the following fields:
NC-WK-CH-01, NC-WK-CH-03, NC-WK-MF-13, NC-WK-MF-14, NC-WK-MF-15, NC-WK-MF-23A, NC-
WK-MF-23B, and NC-WK-RJ-05. The errors have been corrected on Form RSSF for RVAF-Harmony
and the above -mentioned forms corresponding to these fields. The revised forms are provided as part
of this response.

b) The report for the sample collected for AdvancePierre Foods — Claremont, NC on October 14, 2019
provided a Molybdenum concentration of < 190 mglkg, which was the reporting limit. This occurs
periodically and is due to the laboratory method and low total solids (< 2%)_ Upon receipt of the report,
we acted to collect another sample for quantification, which resulted in confirmation of a Mo
concentration below the ceiling concentration. This was the value used in calculating metals loading
for the fields applied in this sampling period- It should be noted that based on the dry tonnage land
applied in 2019 for this source, only one (annual) analysis was required based on the permit
requirements. It was sampled quarterly including the additional sample to follow upon this issue, with
all results reported.
c) An assessment of Zinc accumulation will be performed in late summer on all fields of concern (i.e. >
2000 index level) via additional soil sampling. Management of these fields will be addressed. If fields
need to be removed, it will be done during the renewal of this permit in the second half of 2020.
d) There were 28 permitted fields land applied in 2019. The 29 shown on Form ACF in the original report
was an error. A revised Form ACF is provided as part of this response.
e) The SSFA results submitted with the 2019 Annual Report include many fields that are farmed by ASJ
Mathis Farms but are not approved land application site associated with Permit WQ0038087. Most
fields in the ASJ Mathis Farms inventory are sampled annually and compiled in the same reports with
permitted sites- The samples labeled M12 & 4 that are shown on the SSFA reports and noted in the
NOD letter are not permitted sites. Only fields that are highlighted in the SSSF reports or provided on
the single report for samples collected in 2020 were land applied in 2019- We cannot alter the report
by redacting that data or only showing pieces; however, we will make attempts in the future to
separate only permitted fields applied in a given year and have the lab present those in one report.
f} The SSFA result that is highlighted in the annual report represents a composite soil sample for both
MF-23A & MF-23B combined. Refer to the explanation in item 3 under "Deficiencies" above. This will
be corrected moving forward.
Additional:
It was brought to our attention through an internal source that Form RSSF-B for RVAF (Tyson) —
Harmony, NC was omitted from the digital (pdf) copy of the 2019 Annual Report as submitted. We are
not aware if this form was omitted from the submitted hard copy as well- The form is provided as part
of this response.

Facility was compliant during calendar year 2019 with all conditions of the land application permit
(including but not limited to items 1-13 below) issued by the Division of Water Resources. ❑ Yes A No
If no please, provide a written description why the facility was not compliant, the dates, and explain corrective action
taken.
1) Only residuals approved for this permit were applied to the permitted sites.
2) Soil pH was adjusted as specified in the permit and lime was applied (if needed) to achieve a soil pH of at least 6.0 or
the limit specified in the permit.
3) Annual soils analysis were performed on each site receiving residuals during the past calendar year and three (3) copies
of laboratory results are attached.
4) Annual TCLP analysis (if required) was performed and three (3) copies of certified laboratory results are attached.
5) All other monitoring was performed in accordance with the permit and reported during the year as required and three (3)
copies of certified laboratory results are attached.
6) The facility did not exceed any of the Pollutant Concentration Limits in 15A NCAC 02T .l 105(a) or the Pollutant
Loading Rates in i5A NCAC 02T. I 105(6) (applicable to 40 CFR Part 503 regulated facilities).
7) All general requirements in as specified in the Land Application Permit were complied with (applicable to 40 CFR Part
503 regulated facilities).
8) All monitoring and reporting requirements in 15A NCAC 02T .1 1 I l were complied with (applicable to 40 CFR Part
503 regulated facilities).
9) All operations and maintenance requirements in the permit were complied with or, in the case of a deviation, prior
authorization was received from the Division of Water Resources.
10) No contravention of Ground Water Quality Standards occurred at a monitoring well or explanations of violations are
attached to include appropriate actions and remediations.
l 1) Vegetative cover was maintained and proper crop management was performed on each site receing residuals, as
specified in the permit.
12) No runoff of residuals from the application sites onto adjacent property or nearby surface waters has occurred.
13) All buffer requirements as specified on the permit were maintained during each application of residuals.
