Sullins Governor Director January 22, 2010 CERTIFIED MAIL: RETURN RECEIPT REQUESTED Mr. Scott Jones, Field Chief U.S. Army Corps of Engineers Asheville Regulatory Field Office 151 Patton Avenue, Room 208 Asheville, NC 28801-5006 Subject Property: Grandview Peaks Dear Mr. Jones: Dee Freeman Secretary DWQ Project # 07-0168, Ver. 2 McDowell County On behalf of the NC DWQ 410/Wetlands Permitting Unit, we again respectfully request that you consider the following comments within your review of the 404 Individual Permit request for the above referenced property: Section 8.0, Page 13. Project Purpose states, "The basic project purpose of the proposed development at Grandview Peaks is to provide residential housing", however, on page 32, the applicant states, "Construction of the impoundments is the only option that meets the project purpose". This is inconsistent with their stated project purpose in Section 8.0. Additionally, Item Number 19, Project Purpose, within the applicant's Application For Department Of Army Permit, states, "The purpose of the proposed project is to provide road access to high ground residential lots and homesites and provide amenities for residential use." This Office understands this statement to mean that the purpose of this project is to build a residential development, and it is the opinion of this Office that amenities, other than the impounding of streams and the resulting negative impacts to the streams that such an activity would cause, should be permitted in lieu of amenity lakes. Furthermore, based on the sales to date of lots at the site, this Office is further convinced that amenity lakes are not a prerequisite for the financial viability and success of this project.
