Stormwater Permit No. SW3200401
Village at Granite Quarry – Phase 2
Rowan County
Dear Mr. Nguyen:
The Division of Energy, Mineral and Land Resources (DEMLR), received a Stormwater
Management Permit Application for the subject project on April 6, 2020. A review of that
information has determined that the application is not complete. The following information is
needed to continue the stormwater review:
1. Please provide the permit number from the previously returned application (Section II, 3).
2. Please ensure that any other permits required for this project (such as erosion & sediment
control) are listed (Section II, 4a).
3. Since the applicant is the property owner, “property owner” should be the only checked
off box (Section III, 1c). The property owner information (Section III, 2) and the property
owner authorization signature (Section IX) are not needed and should be removed.
4. Sheet 2L-18 indicates that there are off-site components to the drainage areas. Ensure that
the information in Section IV, 10 matches the rest of the submittal. Please refer to the
note about dealing with off-site drainage areas after the comment section.
5. The “total” of the impervious surface area table does not match the “proposed impervious
area” of the basin information table (Section IV, 10). The impervious area shown in the
table and calculations should be the exact amount of proposed impervious area, not an
estimate.
6. Please provide one full, original, hard copy and one full, duplicate, hard copy of both the
Supplement-EZ Form and the O&M Agreement Form (Section V & Section VI, 3). We
do not keep any of the submittal materials from a returned submission.
7. Please initial the items of Section VI that are included with the submission.
8. Please provide one original hard copy and one duplicate hard copy of the deed restriction
document (Section VI, 2 & Section VII).
9. Please provide a label on the plan set showing the surface water area (in acres) located
within the project area (Section VI, 8h). NOTE: Surface waters include all perennial
waterbodies, perennial streams, and intermittent streams as shown on the USGS
topographic map.
10. Please dimension all proposed BUA (Section VI, 8j). BUA information shown in the
application/calculations should be verifiable on the plans.
11. Please include the 30-foot stream buffer around all perennial waterbodies, perennial
streams, and intermittent streams as shown on the USGS topographic map (Section VI,
8p).
12. Please provide official documentation showing the title and position of the applicant, Jeff
Webb, within LGI Homes NC, LLC as his name is not listed on the Secretary of State
business registration information (Section VI, 11).
13. Please ensure that the sediment storage elevation for the main pool and forebay of the
proposed wet pond is clearly shown on the cross-section and that the sediment storage
area is not taken into consideration when determining the volume of the main pool or the
forebay.
14. The inlet 7-300 appears to short-circuit the proposed wet pond (Wet Pond MDC 4).
Please consider moving the pond outlet so it is closer to midway between each forebay.
15. The forebay volume appears to be larger than 20% of the main pool volume for the
proposed wet pond (Wet Pond MDC 5a).
16. Please clearly show the forebay entrance and exit elevations for the proposed wet pond in
the cross-sectional view on sheet 2L-11. Ensure that the forebay entrance depth is deeper
than the forebay exit depth and that at least 6 inches of sediment storage are provided at
both the entrance and exit of the forebay (Wet Pond MDC 5b).
17. The contour elevations of the forebays for the proposed wet pond on sheet 2L-11 appear
to be incorrectly labeled.
18. Please show the vegetated shelf slope for the proposed wet pond on the cross-section
view on sheet 2L-11.
19. Please provide documentation for the proposed optional fountain for the proposed wet
pond (Wet Pond MDC 9).
20. Provide pdfs of all revisions, 2 hardcopies of revised plan sheets, and 1 hardcopy of other
documents. Pdfs must be uploaded using the form at:
https://edocs.deq.nc.gov/Forms/SW_Project_Submittal
NOTE: While it is not required, it is recommended that the off-site drainage from upstream
properties be diverted around the SCM since the applicant cannot maintain control over the
development of property that they do not own. If the applicant elects to account for off-site
drainage, there must be either a recorded legal agreement in place between the applicant and the
owner of the upstream property in which the owner of the upstream property agrees to record a
deed restriction limiting the minimum/maximum amount of BUA on the upstream property that
will be treated in the applicant’s SCM, the locations and sizes of access and drainage easements,
how construction and/or ongoing maintenance costs will be handled, maintenance responsibility,
a list of legal recourses available to each party should one party fail to hold up their end of the
agreement, and any other related legal issues. Alternatively, the off-site drainage areas can be
taken into the consideration when sizing the proposed SCM in accordance with 15A NCAC
02H .1003(3)(b). Credit is not received for treating off-site areas in this manner.
Please note that this request for additional information is in response to a preliminary review.
The requested information should be received by this Office prior to June 12, 2020, or the
application will be returned as incomplete. The return of a project will necessitate resubmittal
of all required items, including the application fee. Please reference the State assigned project
number SW3200401 on all correspondence.
If you need additional time to submit the information, please submit your request for a time
extension to the Division at the contact below. The request must indicate the date by which you
expect to submit the required information. The Division is allowed 90 days from the receipt of
a completed application to issue the permit.
The construction of any impervious surfaces, other than a construction entrance under an
approved Sedimentation Erosion Control Plan, is a violation of NCGS 143-215.1 and is subject
to enforcement action pursuant to NCGS 143-215.6A.
