Being that it's spring time, vegetation is popping up and it's harder to see the erosion. According to our client, it is worse in the winter months when vegetation recedes. Shore Drive in Morehead City recently and is currently working on the JD request package. He delineated a freshwater wetland, coastal wetland, and normal high water line that runs adjacent to Bogue Sound. The site has an erosional escarpment mainly caused by adjacent stabilization efforts on the adjacent properties (rip rap to the west and bulkhead to east). The owners would like to stabilize an area with the largest escarpment (3-4 feet) with a bulkhead and then fill behind it. This would impact around 0.02 acre of freshwater wetlands (see attached sketch). I emailed Tom Charles this info to get his feedback before I sent in the NWP 18 application (all proposed work would be outside of CAMA AEC). He said that because of the small amount of wetland fill, no permit would be required from them. Would that be the same situation for DWR? Since these wetlands are adjacent to SA waters, I'm thinking a 401 WQC may be needed. But then again, I was surprised by Tom's answer, so maybe I'll be surprised by your answer as well! Thanks!
