A copy of the General Certification is attached. This Certification may be used in qualifying for coverage under Corps of Engineers' General Permit No. 031. If this Certification is unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this Certification. This request must be in the form of a written petition conforming to Chapter 150B of the North Carolina General Statutes and filed with the Office of Administrative Hearings, P.O. PROJECT SUMMARY: Widen existing 20' wide DOT bridge across manmade canal to Jean Guite Creek to 24' width. t .A NC DOT Bridge #40/SR 1208 BIO REPORT Page 2 SITE DESCRIPTION The applicant proposes to widen an existing bridge over a manmade canal off of Jean Guite Creek in Kitty Hawk, Dare county on SR 1208. This proposed construction would include the placement of two pilings within Public Trust Waters and shallow water habitat. The bulkheading under the bridge would also be extended on both shoreline banks to match the new bridge width. The proposed construction would increase the bridge width from 20 ft. to 24 ft. The entire bridge will also be resurfaced. Existing clearances beneath the bridge will be maintained. No additional construction is planned for the bridge approach ramps. Coastal species (Typha latifolia) are present on an adjacent parcel approximately 40 ft. from the bridge on the north-east approach. The immediate area where the proposed work would occur is vegetated in upland lawn grasses. No shoreline stabilization structures are present adjacent to the proposed construction. Jean Guite Creek is classified as an Inland Water and Primary Nursery Area. No fish spawning activity was observed during this field visit at the site. The site is located in a residential area of Kitty Hawk and is classified as "Developed Village/ Conservation" in the Kitty Hawk LUP. ANTICIPATED IMPACTS This proposed project will include the filling of approximately 2 sq. ft. of Public Trust Waters to provide support for the widening of the bridge structure. Increased turbidity would be experienced temporarily due to the placement of these pilings. This project would not adversely impact public trust access or other coastal resources.
