The Division has reviewed your submittal of the No -Exposure Certification form for Exclusion from
NPDES Stormwater Permitting. Based on your submittal and signed certification of no exposure at the above
referenced facility, and the inspection dated September 13, 2016, the Division is granting your conditional
exclusion from permitting as provided for under 40 CFR 122.26(g), which is incorporated by reference in North
Carolina regulations.
Please note that by our acceptance of your no -exposure certification, you are obligated to maintain no -
exposure conditions at your facility. If conditions change such that your facility can no longer qualify for a No -
Exposure exclusion, you are obligated to immediately obtain NPDES permit coverage for your stormwater
discharge. Otherwise, the discharge becomes subject to enforcement as an unpermitted discharge.
You must self re -certify your No -Exposure status annually and the form can be downloaded by visiting:
http:Hportal.nedenr.orglwebllr/npdes -stormwater the web page for the Division of Energy, Mineral and Land
Resources Stormwater Program. The annual self re -certification does not need to be submitted to DEMLR
unless requested. A copy should be maintained in your file.
Your conditional exclusion from permitting.does not affect your facility's legal requirements to obtain
environmental permits that may be required under other federal, state, or local regulations or ordinances.

We are in receipt of the Stormwater Discharge Monitoring Report with Supplement Stormwater
Monitoring Information for the FedEx Ground Package System Inc. facility located in 6604 CSX Way,
Charlotte, Mecklenburg County. The facility was inspected on September 8, 2016 and was found to be
in compliance with the tiered response actions and other conditions of the NCGO80000 General Permit.
As noted in the Engineering report conducted by ATC Group Services LLC, "The supplement
monitoring indicates that the stormwater influent into the FedEx Ground facility associated with IF-2, from
the Duke Energy property,- exceeds the permit benchmark value for TSS due to influent concentrations
from the third party contributors (Duke Energy and CSX) originating from off -site. Based on the facility
inspection and the Engineering report by ATC. Group Services LLC, the Division is granting regulatory
relief from the Tier responses., Upon receipt of this letter, the subject facility may resume the permit
specified semi-annual analytical monitoring forthe remainder of the current permit term. Your current
permit is set to expire on 10/31/2017. This decision applies only to the TSS benchmarks. A benchmark
exceedance of any other parameter listed in your permit will trigger the tiered response actions as
described in the general permit.
You must notify this office, in writing, within five business days if you become aware of any
other significant source of TSS at your facility that has the potential to be exposed to stormwater.
The relief granted in this letter is contingent upon the current industrial practices at FedEx Ground
Package System Inc. If industrial practices change and TSS does become a significant stormwater
exposure risk or significant TSS values have been recorded during regular sampling events,

then this office reserves the right to withdraw this decision and reinstate the permit specified
tiered response or other actions that maybe warranted by the new set of circumstances. -

inside, except some process chemicals that are stored in a locked metal building outside with
seconda containment and service lines running into the facility, There is a covered dum ster
outside with an attached trash compactor and exposed compressor, neither the dumpster or the
compressor showed any evidence of leaking. Their is one water discharge line to the outside
from an oil water separator OWS from an air filter that serves the facilities main air
compressor: The filter and OWS are maintained annually with the air compressor. There were
no oil deposits on the discharge line. There is some discoloration beneath the dischargeline on
the asphalt, but it neither smelled oily or felt greasy. The facility had no floor drains that
discharged to the ground_ surface. Recommend no exposure.
