Based on the information provided and a site visit conducted on April 17, 2012, the NE has been approved. Please note that you are obligated to maintain no -exposure conditions at your facility. if conditions change such that your facility can no longer qualify for a NE, you are obligated to immediately obtain NPDES permit coverage for your stormwater discharge. Otherwise, the discharge becomes subject to enforcement as an un- permitted discharge. Your NE does not expire. In order to help assure that your facility stays in compliance with all of the conditions in the Certification, you must self -recertify your facility at least annually. Unless otherwise requested, you can maintain your annual re -certification on file at your facility. Site visit notes and recommendations: During the site visit it was noted that there were items under tarps. These items were shelving and were temporarily placed outside during construction activities but will not remain outside. The facility is relatively new and was laid out with a good stormwater treatment system; including grass swales flowing to two bio-retention (wetland) structures. These treatment systems will require maintenance for optimal effectiveness. The following is a link to the Stormwater Best Management Practices Manual: http://portal.ncdenr.orp,/web/wq/ws/su/bmp-manual. This manual is a design manual, but will assist you with maintenance of your structures. Refer to Chapter 9 (9.5) for wetland structures maintenance and Chapter 14 (14.5) for grass swale structures maintenance. One of your wetland structures had many cattails in it. Cattails are not to be planted in wetlands because they will take over, and their root systems can clog an outlet structure. But their seeds do migrate and invade wetlands so maintenance is,required to keep them at bay. Wetlands function best with a variety of plants; it is recommended that your cattails be limited especially in the vicinity of your outlet structure. Based on your conversation with Mr. Bruce W. Stainbrook, Corporate Environmental Manager, the No Exposure Certification form is being resubmitted as we are unable to find copies of the original submission completed and submitted in 2006. In addition you confirmed in your discussion with Mr. Stainbrook that the State does not have a a copy of the submission in your files. With regards to question 12e in the application we offer the following additional information. Completed bodies are loaded on to a truck outside the building for delivery to other facilities. These bodies are completely finished and are customer ready and would be attached to a chassis. Altec Industries' Burnsville manufacturing facility conducts the same loading operations that are conducted at our Creedmoor, North Carolina manufacturing facility. In October 2007, Mr. Robert Patterson and Mr. Myrl Nisely of the North Carolina Department of Environmental Management, Storm Water Division visited our Creedmoor manufacturing facility at Altec industries request. The purpose of the visit was to review our operations which included the loading and storage of completed bodies, and to determine if the stormwater discharge outfalls covering these areas were exempted from permitting. Based on that visit, it was determined that there was no exposure and that the body loading and storage operations were considered the same as parking of vehicles, and therefore did not require a NPDES stormwater discharge permit. Since the loading and storage operations at our Burnsville facility are the same, the loading of completed bodies onto the trucks for delivery to other locations would also be exempted. In addition, dumpsters at our Burnsville facility that are located outside the main building are covered or located inside a separate building to eliminate contact with stormwater. Liquid chemicals, paints and products utilized in our operations inside the building have secondary containment areas provided to reduce the potential for a release to migrate outside of the building. No production operations are conducted outside of the building. The facility has aboveground storage tanks for nitrogen, oxygen, propane, carbon dioxide and argon stored outside the building. A condition of no exposure at an industrial facility means all industrial materials and activities are protected by a storm resistant shelter (with some exceptions) to prevent exposure to rain, snow, snowmelt, and/or runoff. For permitted facilities in North Carolina, DWO must approve your application for No Exposure Certification before this exclusion is effective. A storm resistant shelter is not required for the following industrial materials and activities: drums, barrels, tanks, and similar containers that are tightly sealed, provided those containers are not deteriorated and do not leak. "Sealed" means banded or otherwise secured and with locked or non -operational taps or valves; adequately maintained vehicles used in material handling; and final products, other than products that would be mobilized in stormwater discharges (e.g., rock salt). A No Exposure Certification must be provided for each facility qualifying for the no exposure exclusion. In addition, the exclusion from NPDES permitting is available on a facility -wide basis only —not for individual outfalls. If any industrial activities or materials are, or will be, exposed to precipitation, the facility is not eligible for the no exposure exclusion. Site visit notes and recommendations: During the site visit it was noted that there were items under tarps. These items were shelving and were temporarily placed outside during construction activities but will not remain outside. The facility is relatively new and was laid out with a good stormwater treatment system; including grass swales flowing to two bio-retention (wetland) structures. These treatment systems will require maintenance for optimal effectiveness. This manual is a design manual, but will assist you with maintenance of your structures. Refer to Chapter 9 (9.5) for wetland structures maintenance and Chapter 14 (14.5) for grass swale structures, maintenance. One of your wetland structures had many cattails in it. Cattails are not to be planted in wetlands because they will take over, and their root systems can clog an outlet structure. But their seeds do migrate and invade wetlands so maintenance is required to keep them at bay. Wetlands function best with a variety of'plants; it is recommended that your cattails be limited especially in the vicinity of your outlet structure.
