Based on your submittal and signed certification of no exposure at the above referenced facility, the Division is granting your conditional exclusion from permitting as provided for under 40 CFR 126.22(g), which is incorporated by reference in North Carolina regulations. Please note that by our acceptance of your no -exposure certification, you are obligated to maintain no - exposure conditions at your facility. If conditions change such that your facility can no longer qualify for a no - exposure exclusion, you are obligated to immediately obtain NPDES permit coverage for your stormwater discharge. Otherwise, the discharge becomes subject to enforcement as an un-permitted discharge. Your conditional no -exposure exclusion expires in five years (January 30, 2014). At that time you must re -certify with the Division, or obtain NPDES permit coverage for any stormwater discharges from your facility. Your conditional exclusion from permitting does not affect your facility's legal requirements to obtain environmental permits that may be required under other federal, state, or local regulations or ordinances. I did not see any piles of chronlium or cadmium on the property. I did not see any haz waste in drut77s or otherwise stored outside.- As this no exposure permit applies to exposure to precipitate that would only fall Outside the buildings. I did not evtlluate any of their inside activities or storage prnctices as they are riot exposed to precipitate. Should I be throwing a rock? For example for haz waste regs it is ok to store waste on concrete pads outside in drums. For our regs. we can require secondary containment for this. I haven't been there, My question to you was: "And they also are a large generator of haz.Waste - where is this stored?" Meaning is this properly stored, if so where, and is it ok? I hope I have cleared up any confusion about what I meant. I have been to the site and they have no materials exposed to storrnwater outside the building. Again, it is hazardous waste's job to determine if they are storing waste properly inside the building. They are not exposing it to stormwater, i recommend the No Exposure Celt be issued. I called him and he said that you have already been to the site. The NOI is attached. -As you have already been there —from what lie said it seems like its in pretty good condition. The only thing I am concerned about is that there may be exposure from is their air permit — what kind of scrubbers and air releases do they have? He said the air permit was for the chromium and cadmium release. And they also are a large generator of haz. Waste -- where is this stored? He said that they don't' have anything stored outside though? Does the Winston-Salem Regional Office have any concerns about issuing this facility a COC for this general permit?
