forwarding herewith the subject certificate of coverage to discharge under the subject state — NPDES general
permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the
Memorandum of Agreement between North Carolina and the US Environmental Protection Agency dated May
9, 1994 (or as subsequently amended).
Please take notice that this certificate of coverage is not transferable except after notice to the Division
of Water Quality. The Division of Water Quality may require modification or revocation and reissuance of the
certificate of coverage.
This permit does not affect the legal requirements to obtain other permits which may be required by the
Division of Water Quality or permits required by the Division of Land Resources, Coastal Area Management
Act or any other federal or local governmental permit that may be required.

attached.
This certificate of coverage shall become effective December December 7, 2007.
This Certificate of Coverage shall remain in effect for the duration of the General Permit.

To Whom It May Concern:
Nomaco, Incorporated (Nomaco) owns and operates a foam
manufacturing; facility in Tarboro, North Carolina. In August 2007,
Nomaco submitted a request for a No Exposure Certification for
Exclusion from NPDES Storm Water Permitting; for the Tarboro
facility. In response to this request, the facility was inspected by Mr.
Ron Boone of the Surface Water Protection Group on October 3, 2007.
Several deficiencies were identified during the inspection and the
request for no exposure was denied. The purpose of this letter is to
notify the appropriate partues that Nomaco intends to apply for the
general storm water discharge permit, NCG050000 on or before
November 17, 2007. In addition to apply for coverage under the
general stonmwater permit, Nomaco will also submit a status report for
the required corrective actions resulting; from Mr. Boone's inspection.

The NC Division of Water Quality (DWQ), Stormwater Permitting Unit'(SPU), received a No Exposure
Certification (NEC) for exclusion from NPDES stormwater permitting from Nomaco, Inc. for it's
manufacturing facility located at 3006 Anaconda Road, in Tarboro, North Carolina, on I August 2007. Ron
Boone, of DWQ's Raleigh Regional Office (RRO), conducted an inspection of the facility to assess whether
or not it does indeed qualify for a NEC on13 October 2007. The cooperation and assistance of Mr. Travis
Smith during his inspection was greatly appreciated. The findings of his inspection are listed below.

3. The items listed above disqualify Nomaco for the NEC. All items must be corrected in order for Nomaco to
qualify. Additionally, it should be noted that if Nomaco decides not to correct the items listed above for the
NEC qualification, it still may have to correct the items in order to properly comply with the stormwater
permit that will be issued in lieu of the NEC.
4. Please understand that Nomaco is currently in violation of NC General Statute 143-215.1, by having not
been issued either the NEC or the proper NPDES general stormwater discharge permit from DWQ, and is
therefore subject to the assessment of civil penalties in an amount not to exceed $25,000 per day, per
violation. It is the recommendation of this office that Nomaco handle this issue with the utinost urgency
and accuracy.
5. Please respond to this office and the SPU within 10 days of your receipt of this letter. Your response should
convey whether Nomaco has decided to correct the above deficiencies and reapply for the NEC, or simply
apply for the NPDES general stormwater discharge permit, NCG050000. Then, within 30 days, either
correct all deficiencies listed in the table above and resubmit the NEC form, or submit the Notice of Intent
for the NCGO50000 general stormwater discharge permit. All forms/applications for either plan of action
can be downloaded from DWQ's website at the following web address:

A condition of no exposure exists at an industrial facility when all industrial materials and activities are protected by a storm resistant shelter to prevent
exposure to rain, snow, snowmett, andfor runoff. Industrial materials or activities include, but are not limited to, material handling equipment or activities,
industrial machinery, raw materials. intermediate products. by-products, final products, or waste products. Material handling activities include the storage,
loading and unloading, transportation, or conveyance of any raw material, intermediate product, final product or waste product. A storm resistant shelter is
not required for the following industrial materials and activities:
- drums, barrels, tanks, and similar containers that are tightly sealed, provided those containers are not deteriorated and do not leak. "Sealed'
means banded or otherwise secured and without operational taps or valves;
- adequately maintained vehicles used in material handling; and
- final products, other than products that would be mobilized in storm water discharges (e.g., rock salt).
A No Exposure Certification must be provided for each facility qualifying for the no exposure exclusion. In'addilion, the exclusion from NPDES permitting is
available on a facility -wide basis only. not for individual outfalls. If any industrial activities or materials are or will be exposed to precipitation, the facility is
not eligible for the no exposure exclusion.
By signing and submitting this No Exposure Certification form, the entity in Section A is certifying that a condition of no exposure exists at its facility or silo,
and is obligated to comply with the terms and conditions of 40 CFR 122,26(g)-

Nomaco, Incorporated (Nomaco) owns and operates a foam
manufacturing facility in Tarboro, North Carolina. The facility is
expanding its current manufacturing operations into an existing
building across the parking lot. Nomaco is submitting this request for
a new No Exposure Certification for Exclusion from NPDES Storm
Water PCrllitting.
Federal law at 40 CFR Part 122.26 prohibits point source discharges of
storm water associated with industrial activity to discharge to the
waters of the U.S. without a NPDES permit. However, NPDES permit
coverage is not required for discharges of storm water associated with
industrial activities identified at 40 Cl-- 122.26(b)(14)(i)-(ix) and (xi) if
the discharger can certify that a condition of "no exposure" exists at
the industrial facility or site.
Nomaco certifies that a condition of�ilo exposure exists at the facility.
All industrial materials and activities are protected by a storm resistant
shelter- to prevent exposure to rain, snow, S110Wmelt, and/or runoff.
Nomaco will, if permitted, maintain a condition of110 CXposllrC at the
facility so that the no exposure exclusion remains applicable. If'
conditions change resulting in tile exposure of materials and activities
to storm water, the facility will obtain coverage under a NPDES storm
water permit.
