Sullins, Director Division or Water Quality The Division has reviewed your submittal of the No -Exposure Certification for Exclusion from NPDES Stormwater Permitting form, which we received on June 30, 2007. Based on your submittal and signed certification of no exposure at the above referenced facility, the Division is granting your certification as provided for under 40 CFR 126.22(g), which is incorporated by reference in North Carolina regulations. Please note that by our acceptance of your no exposure certification, you are obligated to maintain no exposure conditions at your facility. If conditions change such that your facility can no longer qualify for a no - exposure exclusion, you are obligated to immediately obtain NPDES permit coverage for your stormwater discharge. Otherwise, the discharge becomes subject to enforcement as an un-permitted discharge. Your conditional no -exposure exclusion expires in five years (December 31, 2012). At that time you must re -certify with the Division, or obtain NPDES permit coverage for any stormwater discharges from your facility. Your certification of no exposure does not affect your facility's legal requirements to obtain environmental permits that may be required under other federal, state, or local regulations or ordinances. Typically, we approach sites with two incorporated entities on a case -by -case basis, and make a determination based on the overall circumstances. In this instance, our determination is based on our understanding as follows: a) The two entities are cc -located, with the same street address, and at least partly under the same roof. b) The two entities are under the managment of a single plant manager. u) The two entities are under a single corporate umbrella entity, Wellco Enterprises, Inc., (Ro-Search is a subsidiary of Wellco Enterprises, Inc.) with the same responsible corporate official submitting the two no exposure certifications. d) Given that the two entities are co -located, it is likely that the stormwater flows on the site are not segregatable and identifiable as exclusively from one entity, or the other. I realize that other aspects might argue for separate exclusions, but we think the preponderance of the circumstances support the determination that a single exclusion is sufficient, and that the exclusion covers both entities, under the designation, "Wellco Enterprises, Inc."
