Based on your submittal and signed certification of no exposure at the above referenced facility, the Division is granting your conditional exclusion from permitting as provided for under 40 CFR 126.22(g), which is incorporated by reference in North Carolina regulations. We are also hereby rescinding your current Certificate of Coverage NCG080564. Please note that by our acceptance of your no -exposure certification, you are obligated to maintain no - exposure conditions at your facility. If conditions change such that your facility can no longer qualify for a no - exposure exclusion, you are obligated to immediately obtain NPDES permit coverage for your stormwater discharge. Otherwise, the discharge becomes subject to enforcement as an un-permitted discharge. Your conditional no -exposure exclusion expires in five years (February 28, 2013). At that time you must re -certify with the Division, or obtain NPDES permit coverage for any stormwater discharges from your facility. Your conditional exclusion from permitting does not affect your facility's legal requirements to obtain environmental permits that may be required under other federal, state, or local regulations or ordinances. All but Asheville and morganton appear to qualify for no exposure. Most of the facilities have nothing outside, including no ASTs, no pallets, no nothing. A few have a couple of vehicles. These vehicles have drip'pans and are not used in transit and transportation. Also according to the no -exposure form adequately maintained vehicles used in material handling are not required to be under shelter. In my inspection reports for these facilities I recommended that they review the no -exposure form and submit it, I included the form with all inspection reports. Thanks for asking! The facilities I visited were doing an incredible job with their plans and monitoring and housekeeping. However I just didn't really think there were any potential water quality problems or exposure at the majority of the facilities. Oh, and the spreadsheet wasn't attached. Sarah Young wrote: Attached is a list of no -exposures from National Guard facilities across NC that have stormwater permits. During our renewal process, the National Guard sent us a list of 49 facilities that they think would qualify for no -exposure status.
