During the inspection, the following items were noted: 1) The annual self -recertification required to maintain a status of No Exposure had not been performed. To be in compliance with the No Exposure certification, the self -certification inspection shall be performed and documented annually. 2) Dumpsters at the facility were observed with no covers. To be in compliance with the No Exposure certification, all dumpsters shall be covered, and not leaking. 3) The secondary containment at the facility has a drain valve which was open at the time of the inspection. To be in compliance with the No Exposure certification, all drain valves on secondary containment shall be closed and locked. 4) The "class -A Bio-solids" material was observed to be exposed to precipitation, and had been mobilized in stormwater runoff. To be in compliance with the No Exposure certification, all material on site must be in a storm resistant shelter except the following; drums, barrels, tanks, and similar containers that are tight[y sealed, provided those containers are not deteriorated and do not leak. "Sealed" means banded or otherwise secured and with locked or non -operational taps or valves; adequately maintained vehicles used in material handling; and final products, other than products that would be mobilized in stormwater discharges (e.g., rock salt). The storage of the Class -A Bio-Solids must be entirely in a storm resistant shelter, and no residuals or deposits of that material shall be exposed to precipitation, including material displaced by loading and unloading activities. If the above requirements to maintain a status of No Exposure are not possible at the facility, then the facility operator shall submit a notice of intent (enclosed) to the Department of Environmental Quality to obtain coverage under the NCG110000 General Permit for industrial stormwater. Please give the above items your immediate attention. This facility will be re -inspected on or after April 15,.2019. If the above items have not been addressed, further action will be taken. Based on your submittal and signed certification of no exposure at the above referenced facility, the Division is granting your certification as provided for under 40 CFR 126.22(g), which is incorporated by reference in North Carolina regulations. Please note that by our acceptance of your no exposure certification, you are obligated to maintain no exposure conditions at your facility. If conditions change such that your facility can no longer qualify for a no - exposure exclusion, you are obligated to immediately obtain NPDES permit coverage for your stormwater discharge. In addition, the exclusion from NPDES permitting is available on a facility -wide basis only, not for individual outfalls.
