GARNER, NC AND BOONE, NC July 12, 2018 Mr. Zahid Khan Stormwater Permitting Regional Engineer 610 Fast Center Avenue Mooresville, NC 28155 Re: Stormwater NPDES Permit Alternative Source Demonstration for COD at SDO-1 Cleveland County Landfill Permit No. NCG 120072 Permit Period Benchmark Exceeded: Year 5 Period 2+ Event Date: June 12, 2018 Dear Mr. Khan: The analytical results of a stormwater sample SDO-1 collected on June 12, 2018 at the Cleveland County construction and demolition landfill (CDLF) had a concentration of chemical oxygen demand (COD) (337 mg(L) which is above the benchmark outlined in NCG120000 (120 mg/L) (see attached SWU-248 form). The benchmark exceedance is likely not attributed to leachate but rather believed to be originating from degradation of mulch that was placed by Cleveland County personal along the outside slopes of the construction and demolition landfill (CDLF). Mulch was previously placed to improve stormwater quality by reducing erosion and stimulate vegetative cover. As mulch gradually decays organic matter increases and the excess may be transported resulting in stormwater with elevated levels of COD. At the time of sampling SDO-1 received stormwater originating from north of the closed CDLF. Materials deposited into the CDLF consists of debris generated during the construction, renovation, and demolition of buildings, roads, and bridges. C&D materials often contain bulky, heavy primarily inert materials that include concrete, wood, metals, bricks, glass, trees, stumps, earth and rock from clearing sites. C&D leachate has much lower levels of biodegradable organic material (COD potential) due to the waste composition, dryness and bulky size (less surface area). Per Cleveland County the landfill only potentially contributes "non -contaminated stormwater". The term "non -contaminated stormwater" is defined in 40 CFR 445.2 as "Stormwater which does not come in direct contact with landlilled waste, the waste handling and treatment areas, or landfill wastewater." Non -contaminated stormwater includes stormwater which "flows off the cap, cover, intermediate cover, daily cover, and/or final cover of the landfill." (Reference: 40 CFR 445.2.) I The CDLF has no waste exposed, no erosion features or other nonconformities in the cover, permanent vegetation is established and no signs of past leachate breakouts are visible. The landfill cover, condition, maintenance, and erosion controls are reported to be adequate-, therefore, the source of COD as found in the sample is very likely originating from decay of indigenous vegetation or from excess organic matter leaching from mulch. The elevated COD levels is likely not originating from CDLF leachate. The drainage area serving SDO-1 is controlled by an erosion and sedimentation control (E&SC) system that was previously approved by NCDENR Land Quality Section. The E&SC system will continue to be inspected and maintained as necessary. Additional mulch will not be placed in areas that are susceptible to leaching from stormwater. Permit conditions will continue to he met which includes analytical sampling between August 1, 2018-December 31, 2018. The benchmark exceedance is likely not attributed to leachate but rather originating from wildlife excrement that has been consistently observed in the SDO-1 drainage area. Voluntary supplemental (not required for compliance purposes) raw leachate samples previously collected from the landfill leachate collection system has not contained detectable levels (<10 CFU/100 ml) of FC. Since previous analytical results indicate FC was not detected in raw leachate and wildlife excrement has been observed throughout the drainage area it is reasonable to assume the source of FC as detected in SDO-1 is not attributed to landfill activities. Concentrations of FC in raw leachate samples at several other facilities have also been consistently lower in relation to stormwater outfall samples and the benchmark. NCDEQ performed a field inspection at this facility during a previous monitoring period. A full Tier One response for this FC exceedance at SDO-I can/will not be prepared at this time since the source of FC as identified in SDO-1 is likely not attributed to landfill activities and controls/improvements to mitigate FC levels at a landfill are realistically impractical. The facility plans to continue following permit conditions including semi-annual analytical/qualitative monitoring. In the future additional raw leachate samples may also be tested for stormwater sample comparison purposes. If the NCDEQ does not accept this alternative source demonstration in lieu of a Tier One response please provide us a list of acceptable FC control measures or case studies which have been proven effective in a landfill setting. The benchmark exceedance is likely not attributed to leachate but rather originating from wildlife excrement that has been consistently observed in the SDO-1 drainage area. Voluntary supplemental (not required for compliance purposes) raw leachate samples previously collected from the landfill leachate collection system has not contained detectable levels (<10 CFU/100 ml) of FC. Since previous analytical results indicate FC was not detected in raw leachate and wildlife excrement has been observed throughout the drainage area it is reasonable to assume the source of FC as detected in SDO-I is not attributed to landfill activities. Concentrations of FC in raw leachate samples at several other facilities have also been consistently lower in relation to stormwater outfall samples and the benchmark. A full `Pier One response for this FC exceedance at SDO-1 can/will not be prepared at this time since the%source of FC as identified in SDO-I is likely not attributed to landfill activities and control slimprovements to," itigate FC levels at a landfill are realistically impractical. The facility plans to continue following, permit conditions including semi-annual analytical/qualitative monitoring. In the future additional raw leachate samples may also be tested for stormwater sample comparison purposes. If the NCDEQ does not accept this alternative source demonstration in lieu of a Tier One response please provide us a list of acceptable FC control measures 'on, case studies which have been proven effective in a landfill setting.
