Dear Ms. O'Reilly:
We are in receipt of your ietter received in our office on April 26, 2019 regarding a representative outfall for the
City of Charlotte - Heavy Equipment Shop located at.4600 Sweden Road in Charlotte, North Carolina. The received
representative outfall status request proposed outfall 2 to be representative of outfall 1.
The Mooresville Regional Office staff inspected the subject facility on May 2, 2019 and met with Jeremy
Henderson on site. During the site visit we discussed the drainage areas for outfall 1 & 2 and their activities on site, the
concems with sampling from outfall 1, and recommendations to reduce the TSS for outfall 1 (Tier 2) and outfall 2 (Tier 3).
Based on the information provided and the site visit on May 2, 2019 we are declining the request for
representative outfall status. In light of the above, it was agreed that additional measures and an altered sampling point
for outfall 1 can be made to reduce TSS in both oudalls in response to Tiers 2 $ 3 with increased housekeeping and
maintenance. Please continue to conduct analytical monitoring at all outfalls as required per the existing permit.

Inspection Summary:
This inspection was conducted per a Representative Outfall Status request submitted by Kristen O'Reilly. Jeremy
Henderson was present during the inspection. Suggestions were discussed on site with Jeremy Henderson on measures
and housekeeping changes that may reduce levels of TSS in the samples. Upon inspection, it was found that Outfall 2 is not
representative of Outfall 1, and it is recommended that the request be denied.

Comment: It is recommended that sampling from Outfall 1 be taken at the end of the property boundary at
the Pi e by the street side. This will allow a more accurate sample of the stormwater after it has
been treated by control measures on site. Suggestions for reducing TSS include more frequent
housekeeping measures using a_ac-truck or sweep around inlets on a routine basis, replacing
the filtrexx around the inlets more frequently, and paving the area around the inlets _

if a facility is required to sample multiple discharge locations with very similar stormwater discharges, the
permittee may petition the Director far Representative Outfall Status (ROS). DEQ may grant Representative
Outfall Status if stormwater discharges from a single outfall are representative of discharges from multiple
outfalls. Approved ROS will reduce the number of outfalls where analytical sampling requirements apply.
if Representative Outfall Status is granted, ALL outfalls are still subject to the qualitative monitoring
requirements of the facility's permit --unless otherwise allowed by the permit (such as NC6020000) and DEQ
approval. The approval letter from DEQ must be kept on site with the facility's Stormwater Pollution
Prevention Plan. The facility must notify DEQ in writing if any changes affect representative status.

Representative Outfall Status Request
4) Detailed explanation about why the outfalls above should be granted Representative Status:
(Or, attach a letter or narrative to discuss this information.) For example, describe how activities and/or
materials are similar.
Outfall 1's drainage area contains vehicles awaiting maintenance similar to OutWa 2's drainage area. Outfall 2's drainage area actually has more
potential pollutants from rinsing, oillwater separator, drum storage, dumpsters, and larger capacity for vehicles awaiting maintenance.
Outfall 1 and 2 are in Tier II and III for TSS respectively. The primary sources of TSS for the outfalls are sediment from vehicles and a deteriorating
parking lot. The facility has BMPs in place at all inlets, has a private contract for consistent BMP maintenance, recently purchased a sweeper and
and started regular sweeping. The lot is on the Capital Improvement Project list for repaving in the next couple of years.
5) Certification:
North Carolina General Statute 143-215.6 B(i) provides that:
Any person who knowingly makes any false statement, representation, or certification in any application, record,
report, plan, or other document filed or required to be maintained under this Article or a rule implementing this
Article; or who knowingly makes a false statement of a material fact in a rulemaking proceeding or contested case
under this Article; or who falsifies, tampers with, or knowingly renders inaccurate any recording or monitoring device
or method required to be operated or maintained under this Article or rules of the [Environmental Management]
Commission implementing this Article shall be guilty of a Class 2 misdemeanor which may include a fine not to exceed
ten thousand dollars ($10,000).
I hereby request Representative Outfall Status for my NPDES Permit. I understand that ALL outfalls are still
subject to the qualitative monitoring requirements of the permit, unless otherwise allowed by the permit
and regional office approval. I must notify DEQ in writing if any changes to the facility or its operations
take place after ROS is granted that may affect this status. If ROS no longer applies, I understand I must
resume monitoring of all outfalls as specified in my NPDES permit.

approval by the NCDEQ Regional Office. The Regional Office may inspect your
facility for compliance with the conditions of the permit prior to that approval.

requested. Analytical monitoring as per your current permit must be continued, at all outfails, until written
approval of this request is granted by DEQ. Non-compliance with analytical monitoring prior to this request
may prevent ROS approval. Specific circumstances will be considered by the Regional Office responsible for
review.
