Dear Bradley Bennett:
I arm in receipt of your letter dated 6-06-2002 regarding the renewal permit NCG08006 --COC #
NCG)80151 located in Haywood County and our facility located on Riverside Drive in Buncombe
County # COC # NCG080022.. Larry Butler and Charles Friedlien are no longer employed by Morgan
Energy and these permit notices apparently went unnoticed. Marty Trickett (828045 -9473) is currently
the Facility Contact in Haywood County and Wayne Ballard (828-252-4454 ext. 23) is the Facility
Contact in Buncombe County.
In the course of reviewing other permits and plans connected with our bulk plants by Tim Laughlin. PE
for the North Carolina Petroleum Marketers Association, it was pointed out to us that we had most likely
registered our oil water separators for General Permit NO. NCG0800000the permit when we were not.
required to do so. I arm enclosing the correspondence that led to this conclusion. I am assuming this is
why the application was not filled out and returned to you by the previous Facility Contact.
If this conclusion is correct would we need to fill out the form that asks for Rescission Request Form
even though our oil water separator still discharges stormwater run off? If this conclusion is incorrect
then we would be required to fill out The Renewal Application Form. I am currently tilling out both
forms (for both locations) and faxing thern to you. I am requesting that you advise us as to the correct
form we should ultimately fill out.
We ask that no civil assessments, fines or penalties be levied against us , We do not believe that we
are required to have this permit and that we previously registered for R in error.

GENERAL PERMITS) This regulation stabli§hes appliqailil for bulk plants and terminals that have Standard
Industrial Coda (SIC) k171 and which have vehicle maintenance, also. (SIC 5171 refers to 'Peuoleurn Bulk Stations and

Therefore;, for a bulk plant to be applicable under the stormwater regulation, a bulkplant must L Lhh be classified as
SIC Code 5171 and have vehicle maintenance operations at the plant.
Vehicle`MaIntenance Areas Include vehicle rehabilitation, mechanical repairs, palming, f lei 1142 , lubrication and
equlpr mt cleaning operations aroas assocl. d with SIC 5171 bulk plants.
Fueling means fueling your company vehicles at the facility. Cardlocks and other types of fueling to the public or
private fleets at the SIC 5171 facility are exempt
VERY: IMPORTANT: If you have an plf water_ ap rater for storm water discharges and no vehicle maintenance ac-
tivity then you are no reaulred to have a NPIDES General Permit.
