5 Total Toxic Organics sampling is applicable only for those facilities which perform metal finishing operations, manufacture semiconductors, manufacture
electronic crystals, or manufacture cathode ray tubes. For purposes of this permit the definition of Total Toxic Organics is that definition contained in the EPA
Effluent Guidelines for the facility subject to the requirement to sample (for metal finishing use the definition as found in 40 CFR 433.11; for semiconductor
manufacture use the definition as found in 40 CFR 469.12; for electronic crystal manufacture use the definition as found in 40 CFR 469.22; and for cathode ray
tube manufacture use the definition found in 40 CFR 469.31).

Facilities that incorporate a solvent management plan into the Stormwater Pollution Prevention Plan may so certify, and the requirement for TTO monitoring
may be waived. The solvent management plan shall include a list of the total toxic organic compounds used and the other elements listed in the General
Permit. For those facilities electing to employ the TTO monitoring waiver, the discharger shall sign the following certification statement:
"Based upon my inquiry of the person or persons directly responsible for managing compliance with the permit monitoring requirement for total toxic organics
(TTO), I certify that to the best of my knowledge and belief, no dumping of concentrated toxic organics into the Stormwater or areas which are exposed to rainfall or
Stormwater runoff has occurred since filing the last discharge monitoring report. I further certify that this facility is implementing the all the provisions of the
solvent management plan included in the Stormwater Pollution Prevention Plan."

two copies of the semi-annual stormwater Discharge Monitoring Report (DMR) for the site
referenced above in accordance with the industrial stormwater permit (NCG030694). Please note
there are metal exceedances in Stormwater Discharge Outfall (SDO) samples SDO-001, SDO-003.
SDO-004, and S130-005. Zinc is the compound found above the benchmark of 0.067 mg/L for
SDO-003 (0.965 mg/l-) and SDO-005 (0.990 mg/L). SDO-004 is also slightly above the zinc
benchmark at a concentration of-0.084 mg/L. SDO-001 is slightly above the benchmark for copper
(0.007 mg/L) at a concentration of 0.008 mg/1— Historically, the Former Cunningham Plant outfalls
have exceeded the benchmarks of'zinc and copper.
In 2014, DEQ performed an inspection to assess compliance with the NPDFIS general stormwater
permit to evaluate the drainage of the facility's five SDOs. The SDOs were found to be in excellent
condition and concluded in a letter dated Junc 5. 2014 that offsite sources have opportunities to
contaminate samples taken from outfalls 1,2,4 and 5. Additionally, the buildings on the property
are made, in part, from galvanized metal which could contribute to the copper and zinc
concentrations.
There are slight differences in the current sampling location nomenclature compared to historic
sampling of the SDO's. A brief summary regarding sampling nomenclature is as follows. SDO-
001 was sampled from a stream outside the property boundary instead of at the outfall discharge
per recent NOI point. SDO-002 is sampled from the same location as historically. SDO-003 is now
sampled from a catch basin that is located northwest of where SDO-003 was previously sampled
from. SDO-003 was sampled from a discharge pipe located in the sample catch basin where SDO-
004 is now sampled from. SDO-004 was historically sampled south of building 22, the outfall
located west of OWS45 (located north of building 6 warehouse). SDO-005 was sampled at the
same location but was previously called "Intake."

Considering the 2014 NC DEQ letter, the only metal exceedance requiring a tiered response is zinc
in SDO-003. Due to the exceedance of SDO-003, a stormwater management inspection was
conducted within two weeks ofreceiving sampling results. We are evaluating whether conditions
can be improved to prevent exceedances in the future, although the source of the zinc may be the
facility roof or other building materials.

In accordance with your application for a discharge pennit received on June 14, 2018, we are
forwarding herewith the subject certificate of coverage (COC) to discharge under the subject state —
NPDES general permit. This permit is issued pursuant to the requirements of North Carolina General
Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the US
Environmental Protection Agency dated October 15, 2007 (or as subsequently amended).
Please note that the NCG030000 General Permit will expire on October 31, 2018. Typically, all
permit COCs are renewed automatically once the General Permit itself is finalized, unless there are
outstanding annual fees. There is no need to reapply for a renewal unless the Division directs you
to do so. Be sure to check our program website for updates and public notice of proposed renewal
actions.
Please be aware that there are also multiple Total Maximum Daily Loads (TMDLs) that affect this
watershed. Information about these TMDLs can be found on Division of Water Resources' website:
https:/ldeg.nc.goviabout/divisions/water-resources/planninglmodeling-assessmentltm_ dls. In Part I,
Section A, the General Permit explains that for discharges to watersheds affected by a TMDL,
coverage under this permit may depend on the facility demonstrating that discharges have no
reasonable potential to violate applicable water quality standards for specified pollutants.
Please take notice that this certificate of coverage is not transferable except upon approval of the
Division of Energy, Mineral, and Land Resources. The Division of Energy, Mineral, and Land
Resources may require modification or revocation and reissuance of the certificate of coverage,

On behalf of LL Flex, LLC, Hart & Hickman, P.C. (H&H) is submitting the enclosed
Notice of Intent (NOI) for industrial stormwater permit coverage under General Permit
NCG030000 for the former Oracle Flexible Packing, Inc. (Oracle) Cuinmingham Plant.
The property is not owned by LL Flex, LLC or Oracle. The site was previously utilized
for manufacturing of aluminum foil of various gauges from aluminum ingots. The facility
has been inactive since 2016 when the Alpha Aluminum (Alpha) vacated the site
suddenly due to financial problems. Alpha was responsible for the prior stormwater
permit (NCG030239). However, because Alpha was subleasing from Oracle, the
responsibility to maintain a stormwater permit may rest with Oracle. In addition, the site
does not appear to currently qualify for a No Exposure Certification. Therefore, Oracle is
submitting this NOI for a new industrial stormwater permit. Oracle does not plan to use
the facility.
