'thank you for your May 8, 2017, email to the U.S. Environmental Protection Agency on behalf of your
constituent, Mr. Alan Heckle of Hallman Foundry (Hallman) located in Sanford, North Carolina. Mr.
Heckle expressed concerns regarding the recently proposed administrative penalty from the EPA for
Clean Water Act (CWA) violations at Hallman. ,Mr. Heckle also cited concerns regarding the reason for
the EPA's February 2016 inspection. the burdens of the regulations and the proposed administrative
penalty in the enforcement case.
"fhe EPA promulgated National Pollutant Discharge Elimination System (NPDIaS) permitting
regulations for industrial stormwater dischargers in November 1990. On November 7. 2012,
North Carolina issued a general permit for stormwater point source discharges associated with industrial
activities from metal fabrication processes and like industrial activities. Since then, North Carolina has
issued updated permits with the most recent permit issued On November 1. 2012. Hallman Foundry was
inspected by the EPA and North Carolina Department oft nvironmental Quality (NC DEQ) in 201C as
part ofthe EPA's National Enforcement Initiative (N1-1) to evaluate industrial discharges. During the
inspection and review it was determined that the facility fell under one of the industrial source categories
requiring NPDES permit coverage for stormwater discharges, and that Hallman had been operating
without an NPDES permit for six years. Certain industrial sectors like chemical and metal
manufacturing have been found to discharge nutrients and metal pollutants to lakes, rivers, and streams,
and have the potential to degrade water quality and threaten drinking water sources.
The EPA is unable to comment on active enforcement negotiations, including penalty discussions.
However, since the inspection we have worked with Hallman on required actions so that they can be
within compliance of the CWA. Hallman applied for and has received permit coverage, and they have
taken steps to come into compliance. We will continue to work with Hallman to help the facility come
into full compliance and resolve this enforcement action.

1. Statutory Authority
1. Section 309(a) of the Clean Water Act (CWA), 33 U.S.C. § 1319(a), provides
that, whenever the U.S. Environmental Protection Agency finds that any person is in violation of
any condition or limitation which implements, inter alia, Sections 301 and 402 of the CWA, 33
U.S.C. §§ 1311 and 1342, the EPA may issue an order requiring such person to comply with
such condition or limitation, and shall specify a time for compliance that the EPA determines to
be reasonable.
2. The following Findings of Fact and Determinations of Law are made and this
Administrative Order on Consent (AOC) is issued pursuant to the authority vested in the EPA by
Section 309(a) of the CWA, 33 U.S.C. § 1319(a), as amended. This authority has been delegated
to the Regional Administrator of the EPA. Region 4, and further delegated by the Regional
Administrator to the Director of the Water Protection Division of the EPA, Region 4.
II. Findings of Fact and Determinations of Law
3. To accomplish the objective of the CWA, defined in Section 101(a) of the CWA.
33 U.S.C. § 1251(a), to restore and maintain the chemical, physical, and biological integrity of
the nation's waters, Section 301(a) of the CWA, 33 U.S.C. § 1311(a), prohibits the discharge of
pollutants by any person into navigable waters except in compliance with a National Pollutant
Discharge Elimination System (NPDES) permit issued pursuant to Section 402 of the CWA. 33
U.S.C. § 1342.
4. Hallman Foundry LLC is a limited liability company formed under the laws of the
State of Delaware and is a "person" within the meaning of Section 502(5) of the CWA, 33
U.S.C. § 1362(5).

5. A. Stucki Company is a corporation formed under the laws of the State of
Delaware and is a "person" within the meaning of Section 502(5) of the CWA, 33 U.S.C.
§ 1362(5).
6. At all times relevant to this action, Hallman Foundry LLC and A. Stucki Company
(Respondents) owned and/or operated an iron foundry (Hallman Foundry or Facility), as
identified by Standard Industrial Classification (SIC) Code 3321, located at 105 East Humber
Street, Sanford, North Carolina 27330.
7. Section 402 of the CWA, 33 U.S.C. § 1342, establishes a NPDES Permit Program
authorizing the EPA or authorized states to administer the NPDES Permit Program, including the
issuance of NPDES permits allowing for the discharge of pollutants, including stormwater, into
navigable waters subject to specific terms and conditions. The EPA has granted the State of
North Carolina, through the North Carolina Department of Environmental Quality (NCDEQ),
approval to issue NPDES permits pursuant to Section 402(b) of the CWA.
8. The NCDEQ issued General Permit to Discharge Stormwater Under the National
Pollutant Discharge Elimination System, Permit No. NCG030000 (Permit) for establishments
primarily engaged in metal fabrication in accordance with the North Carolina General Statute
143-215.1 and the CWA. The Permit became effective November 1, 2012, and will expire on
October 31, 2017. Coverage under the Permit is obtained by submitting a Notice of Intent (NO])
to NCDEQ.
9. The Permit is a North Carolina statewide NPDES general permit governing
stormwater point source discharges associated with industrial activities from metal fabrication
processes and like industrial activities deemed by NCDEQ to be similar.
10. Pursuant to Section 402(p)(2)(B) of the CWA, 33 U.S.C. § 1342(p)(2)(B), a
NPDES permit is required for "a [stormwater] discharge associated with industrial activity."
11. "Stormwater discharge associated with industrial activity," as defined at 40 C.F.R.
§ 122.26(b)(14), means the discharge from any conveyance that is used for collecting and
conveying storm water and that is directly related to manufacturing, processing, or raw materials
storage areas at an industrial plant.
12. Pursuant to 40 C.F.R. 122.26(b)(14)(ii), facilities "classified as Standard
Industrial Classifications ... 33...," which would include 3321, are considered to be engaging in
"industrial activity" for the purposes of 40 C.F.R. 122.26(b)(14).
13. On February 9, 2016, representatives of the EPA, in conjunction with the
NCDEQ, performed a.Compliance Stormwater Evaluation Inspection ("CS WEI") at the Hallman

Foundry to evaluate the Respondents' compliance with the requirements of Sections 301 and
402(p) of the CWA, 33 U.S.C. §§ 1311 and I342(p); the regulations promulgated thereunder at
40 C.F.R. S 122.26; and the Permit.
14_ During the CSWEI, the EPA inspectors observed the following:
a. The Respondents have several uncovered industrial areas outdoors with exposure
to stormwater runoff. including outdoor scrap metal storage, slag storage, sand
storage, equipment storage, oil and chemical storage; and maintenance operations.
b. The Respondents, which operate a ductile iron foundry under SIC Code 3321,
have failed to submit a NOI requesting coverage under the Permit dated
November 1, 2012.
15, In accordance with Section 402(p) of the CWA; 33 U.S.C. 5 1342(p), and its
implementing regulations, based on the CSWEI and due to the hydrology of the Facility and
historic rainfall data. the EPA has determined that from November 2011 to May 2016,
stormwater associated with industrial activity generally discharged from the Facility throu�_h
stormwater drains and sheet flow to a drainage ditch which ultimately discharges to Little
i3tsffalo Creek.
16. Little Buffalo Creek is a tributary to the Deep River, a traditionally navigable
water of the United States as defined by Section 502(7) of the Act, 33 U.S.C. § 1362(7) and its
complementing regulation 40 C.F.R. 5 122.2.
17. Therefore. Respondents have violated Section 301 of the C\\"A. 33 U.S.C.. § 1311.

III. Agreement on Consent
18. Based on the foregoing Findings of Fact and Determinations of Law and pursuant
:0 the authority of Sections 308 and 309(a) of the CWA, 33 U.S.C. ti ` 13 18 and 1319(a), THE
DII?-uCTOR HEREBY ORDERS AND THE RESPONDENTS HEREBY AGREE AND
CONSENT TO THE PROVISIONS OF THE PARAGRAPHS BELOW:
a. The Respondents shall cease all unauthorized discharges of stormwater from
industrial activity from the Facility to waters of the United States Without a CWA
NPDES permit within ninety (90) days of the Effective Date of this Order.
b_ If the Respondents choose to comply by ceasing all discharges; the Respondents
shall submit a -work plan to the EPA within thirty (30) days of the Effective Date
of this AOC detailing the steps the Respondents must take to cease discharging.
The work plan shall include projected dates for achieving major milestones. The
work plan should also include any interim controls necessary to prevent
discharges of industrial stormwater from the Facility and projected dates for
establishing those controls. Throughout the Respondents' implementation of the
work plan_ the Respondents shall submit a progress report every thirty (30) days
to the EPA. Each progress report shall include photographs and a written
description of the work completed since the previous progress report. The
progress reports will assist the EPA in determining whether the Respondents are
abating the unlawful discharges and preventing additional discharges.
c. If the Respondents intend to comply by obtaining a CWA NPDES permit that
authorizes discharges from the facility, the Respondents shall:
i. Report to the EPA on the submission of a NO1 and associated documents
to NCDEQ within thirty (30) days of the Effective Date of this AOC, and
simultaneously submit a copy of the NOl and proof of submission to the
EPA.
ii. Subunit a copy of most current Stormwater Pollution Prevention Plan
(SPPP) to the EPA within thirty (30) days of the Effective Date of this
AOC.
in, Perform and submit the results from an initial round of analytical and
qualitative monitoring performed at the facility in accordance with Part it
of the Permit within sixty (60) days ofthe Effective, Date of this AOC.
iv. Within one hundred and eighty (1 80) days of the Effective Date of this
AOC. pertorm and provide the results of a second round of analytical and
qualitative monitoring performed in accordance with Part 11 of the Permit.
19. The Respondents may submit a request, in writing; for an extension of time to
comply with the requirements of this AOC within seven (7) calendar days of the required
completion date. Such request must include the reason(s) for the extension request and a date
when compliance will be achieved. Any extension trust be granted by the EPA in writing to be
effective.

20. Ail reports, notifications, documentation and submittals required by this AOC
,hall be signed by a duly authorized representative of the Respondents as specified by 40 C.F.R.
ti 122.22(b)(2) and (d), and shall include the following statement:
--I certify under the penalty of law that this document and all attachments were
prepared under my direction or supervision in accordance with a system clesigned
to assure that qualified person-nel properly gather and evaluate the information
submitted. Based on my inquiry of the person or persons who manage the system,
or those persons directly responsible for gathering the information; the
information submitted is; to the best of my knowledge and belief true, accurate;
and complete. l am aware that there are significant penalties for submitting false
information, including the possibility of fine and imprisonment for knowing
violations."

IV. Final Report and Termination of AOC
22. Within thirty (30) calendar days after the Respondents have fiiliy completed and
implemented the actions required by Section III (Agreement on Consent) of this AOC, the
Respondents shall submit for the EPA's review and approval a final report (Final Report) that
includes: (a) a description of all of the actions which have been taken toward achieving
compliance with this AOC; (b) an assessment of the effectiveness of such actions; and (c) an
analysis of �yhether additional actions beyond the scope of this .HOC: are necessary to further
COMply with the CWA and this AOC.
23. if the EPA determines; after review of the Final Report, that all the requirements
of this AOC have been completed and implemented in accordance with this AOC, the EPA will
provide notice to the Respondents and this AOC shall be deemed terminated.
24. If the EPA determines that any requirement has not been completed and
implemented in accordance with this AOC, the EPA will notify the Respondents; provide a list
of deliciencies, and may require the Respondents to modity their actions as appropriate in order
to correct such deficiencies. If so required, the Respondents shall implement the modified and
approved requirement(s) and submit a modified Final Report in accordance with the EPA notice.
Failure by the Respondents to implement any of the approved modified requirernent(s) shall be a
violation of this AOC.
V. General Provisions
2-. The Respondents' compliance with this AOC does not necessarily constitute
compliance with the provisions of the CWA, 33 U.S.C. § 1251 et seq.. its implementing
reaUlat1011S, or Vlth the Permit. The Respondents shall remain solely responsible for compliance
with the terms of the CWA, its implementing regulations, this AOC, and the Permit. -
26. Nothing in this AOC shall constitute a waiver; suspension, or modification ofthc
terms and conditions oFthe Permit, which remain in full force and effect.
27. failure to comply With the requirements herein shall constitute a violation of this
AOC and the CkVA, and may subject the Respondents to penalties as provided in Section 309(d)
of the CWA, 33 U.S.C.. § 1319(d).
28. This AOC shall not relieve the Respondents of their obl12atiOn to comply with al':
applicable provisions of federal, state. or local law. nor shall it be construed to be a ruling on. or
determination of: anv issue related to any other federal. state. or local permit. Compliance with
this AOC shall not be a defense to any actions subsequently commenced pursrrant to federal laws
and regulations administered by the EPA.
29. Issuance of this AOC shall not be deemed as prohibiting, altering_ or in any way
linliting the ability of the EPA to pursue any other enforcement actions available to it under law.
Such actions may include, without limitation; any administrative; civil, or criminal action to seek
penalties, fines, injunctive, or other appropriate relief, or to initiate an action for imminent and
substantial endangerment under the CWA or any other federal or state statute; regulation, or
perm it.
30. The EPA reserves all rights and remedies, legal and equitable, available to enforce
anv violation cited in this AOC and to enforce this AOC.
31. Nothing in this AOC is intended to nor shall be construed to operate in any way to
resolve any criminal liability of the Respondents; or other liability resulting from violations that
were not alleged in (his.AOC-
32. This AOC applies to and is binding upon the Respondents and its ol'licers,
directors, employees, agents, successors, and assigns.
33. Any chanoe in the legal status of the Respondents, including bill not limited to
any transfer of assets of real or personal property, shall not alter the Respondents'
responsibilities under this AOC.
34. The Respondents admit to the jurisdictional allegations set forth within this AOC.
35. The Respondents waive any and all claims for relief and otherwise available
rights or remedies to judicial or administrative review which the Respondents may have with
respect to any issue of fact or law set forth in this AOC. including. but not limited to any ri�4ht of
;judicial review of the AOC under the Administrative Procedure Act, 3 U.S.C. SS 701-706.
36. Each party shall bear its own costs and attorneys fees in connection with the
action resolved by this AOC.
37. Pursuant to Section 309(a)(4) of the CWA. 33 U.S.C. § 1 319(a)(4): the EPA has
ent a cope of this AOC to the State of North Carolina.
38. Each undersigned representative of the parties to this AOC ccrtities that he or she

On February 9, 2016, the U.S. Environmental Protection Agency Region 4 conducted a Compliance
Stormwater Evaluation Inspection (CSWEI) at the industrial facility known as Hallman Foundry,
Humber Street Facility, located at 105 East Humber Street, Sanford, Lee County, NC, 27330 for which
Hallman Foundry is the operator. The purpose of the CSWEI was to evaluate Hallman Foundry's
compliance with the requirements of Sections 301 and 402(p) of the Clean Water Act (CWA), 33 U.S.C.
§ § 1311 and 1342(p); and the regulations promulgated thereunder at 40 C.F.R- § 122.26.
Enclosed is the EPA's CSWEI report and photo log. The EPA is continuing to analyze observations
made during the CSWEI and to evaluate Hallman Foundry's compliance with the CWA. As a result, the
EPA may be in further contact with Hallman Foundry in the future.

A ductile iron foundry, using iron and steel scrap to create a specific quality of ductile iron for customers. No prior stormwater permit
coverage acquired under NCG030000. Indoor operations include smelting, forming using sand molds, cooling, and grinding. Some
materials storage outdoors, including sand, some scrap metal, equipment storage, slag residue, and parts in bins.
The facility has two sump pumps due to a high groundwater table. Groundwater is collected from open basins inside the main building,
and pumped out to the storm drain system. The storm drain system discharges from the facility in ditches on either side of the rail spur,
in a northerly direction towards Little Buffalo Creek to the north-northwest.
