This permit is issued pursuant to the requirements of North Carolina General Statute 143- 215.1 and the Memorandum of Agreement between North Carolina and the US Environmental Protection Agency dated October 15, 2007 (or as subsequently amended). Please take notice that this certificate of coverage is not transferable except after notice to the Division of Energy, Mineral, and Land Resources (DEMLR). The Division may require modification or revocation and reissuance of the certificate of coverage. Please note that mine dewatering wastewater includes wet pit overflows caused solely by direct rainfall and groundwater seepage for this type of mining operation. Any discharge of this water (and any stormwater commingled with it) is subject to the effluent limitations in this permit. This permit does not affect the legal requirements to obtain other permits which may be required by the Division of Energy, Mining, and Land Resources, or permits required by the Division of Water Resources, Coastal Area Management Act, or any other federal or local governmental permit that may be required. I notice that the plans show several drainage channels leading to temporary sediment traps with one leading to a 24" CMP culvert at the entrance road. The sediment traps may or may not discharge off the property, however I would think the channel to the entrance road culvert would certainly be considered a discharge outfall. I did speak with the consultant last week and he reiterated that they were planning a recycle system with no discharges off the property. I advised him to advise the mine operator that under the NCG020000 permit he would still be subject to complying with all permit conditions including the development of a SWPPP and documentation of monitoring records even if it means recording no flow/no discharge for any/all outfalls. I recommend we go ahead and issue permit coverage.
