REGAN Secterory TRACY DAVIS Director Subject: General Permit No. NCG020000 412 Quarry COC NCG020910 Forsyth County Dear Mr. Johnson: In accordance with your application for a discharge permit received on October 5, 2016, we arc forwarding herewith the subject certificate of coverage to discharge under the subject state — NPDES general permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143- 215.1 and the Memorandum of Agreement between North Carolina and the US Environmental Protection Agency dated October 15, 2007 (or as subsequently amended). Please take notice that this certificate of coverage is not transferable except after notice to the Division of Energy, Mineral, and Land Resources. The Division may require modification or revocation and reissuance of the certificate of coverage. This general permit allows the discharge of stormwater and certain types of wastewater from your facility. In your application, you specified that only mine dewatering water would be discharged from this facility. If separate point -source discharges of stormwater occur (i.e., stormwater not combined with mine dewatering water), you will be required to adhere to the conditions in this permit for stormwater discharges. Also, you may be required to apply for a separate Post -Construction stormwater permit from the State or local government (Winston-Salem in this case) if you are adding built -upon area at this site. Please see guidance on our website for mines located in Phase 11 Post -Construction areas (in the table along with the NCG020000 General Permit, on this page: htt :llde .nc. ,ov/about/divisions/ener - mineraldand-resourcesleneray-mineral-land-permitslstormwater-permits/npdcs-industrial-sw), This guidance clarifies the applicability of Session Law 2006-246 to mines located in Phase 11 Post - Construction areas. Why or why not?* (3) If No, is it otherwise feasible to build a CLRS at this site? Why or why not?* The existing site has minimal area available for a storage/treatmentcell and no end user of the flow. (4) What is the feasibility of building a CLRS compared to direct surface water discharge A CLRS is not feasible. The discharge from the site is the runoff collected in theguairy pit and any future runoff collecte_d,durinj storm events. The oroposed discharge is not Dart of a process system, so there is not 'a end use for the water collected in CLRS. d) Surface or Subsurface Disposal System (e.g., spray irrigation): i) Is a surface or subsurface disposal technologicallyfeasible (possible)? ..................... ❑ Yes X No Why or Why not?* The required treatment area associated with a.discharge rate of 1200 ms exceeds the available acreage for treatment on the site. ii) Is a surface or subsurface disposal system otherwise feasible to implement?*............ ❑ Yes X No Why or Why not?• Surface or Subsurface Disposal is not feasible due to the limited capacity for treatment using a surface or subsurface disposal system. The pit provides the required treatment for a direct discharge. Page 8 of 12 SWU-NCG02-NOI Last revised 9110/2015 NCG020000 N.O.I. What is the feasibility of employing a subsurface or surface discharge as compared to a direct discharge to surface waters?* The buffers associated with streams floodi2lains, and Property lines and existinn development provide additional restrictions on where a treatment area could be located. Reducing the discharge to match the available treatment capacity of anv availablb area•on the site would defeat the uurr)ose of the Direct Discharge to Surface Waters: Is -discharge to surface waters the most environmentally sound alternative of all reasonably cost-effective options for the wastewaters being considered?* X Yes ❑ No e) tf this review included all wastewater discharge, types, would excluding some, types (e.g. mine dewatering) make any of the above non -discharge options feasible for1ome of the wastewaters? ❑ Yes X No * Feasibility should take into account initial and recurring costs. It is anticipated that the quarry would be pumping pit water at a rate of 1200 gallons per minute. Continuous pumping would be rr dewatered. After that point, the flow rate may be reduced depending on the amount of rainfall that occurs each day. Per our conversation, the owner is applying for a NPDES permit that allows direct discharge into the stream. The runoff Is tested during the pumping operations to ensure that it complies u limits.
