In my email I also explained that the subject line of the cover letter was in error but the addressee and the information on( the Certificate of Coverage (COC) is correct (which is the most important part of the permit package). In my haste to get the permit out, I did not notice the misleading information and I resent a previous email to you with the same attachment. Also, I referred to you in my previous email as the applicant but what I really meant was the consultant for the owner. I would sincerely hope that you are not always this caustic with those whom you or your company might have future interaction. Richard L. Thirdly, I can understand anyone being confused. I cannot imagine a more convoluted process than getting a permit to dig clean sand from a hole in the ground. He also pointed out that the county was wrong. I did check the cover letter and the Certificate of Coverage (COC) and did notice that it was wrong on the letter but correct on the COC, the more important part. This permit is issued pursuant to the requirements of North Carolina General Statute 143- 215.1 and the Memorandum of Agreement between North Carolina and the US Environmental Protection Agency dated October 15, 2007 (or as subsequently amended). Please take notice that this certificate of coverage is not transferable except after notice to the Division of Energy, Mineral, and Land Resources. The Division may require modification or revocation and reissuance of the certificate of coverage. Please be aware that mine dewatering at your site has the potential to impact adjacent wetlands. The specific requirements for mine dewatering at facilities near wetlands can be found in Part III, Section E of your permit. You must have an approved Operation and Monitoring Plan before mine dewaterin>a discharees occur at your facility. Discharging mine dewatering wastewater without Plan approval will be subject to enforcement action. An Operation and Monitoring Plan for your facility must be submitted to the Wilmington Regional Office within 60 days of your receipt of this permit. Contact Dan Sams at the Wilmington Regional Office at (910) 796-7215 for more information about the approval process. Please note that mine dewatering wastewater includes wet pit overflows caused solely by direct rainfall and groundwater seepage for this type of mining operation. Any discharge of this water (and any stormwater commingled with it) is subject to the effluent limitations in this permit. This general permit allows the discharge of stormwater and certain types of wastewater from your facility. In your application, you specified that only mine dewatering water would be discharged from this facility. The sand mine is on a 10.04 acre site owned by Sea Level Mine, LLC. A mining permit for the facility has been applied for and is in process in the Land Quality Section of the Division of I nergy, Mineral and Land [ZCSources. The mining pit is approximately 4.1 acres and will be excavated to a depth of 30 to 40 feet. The remainder of the 10 acre site is a surge and sediment pond (0.403 ac.), waste area for storage of overburden (1.0 ac.), the haul road (1.71 ac), and the buffer, wetlands and other boundary areas (2.8 ac.). The existing ground elevation around the pit is 9 to 10 feet NAVD. DESCIZIPTI.ON OF MINING ACTIVITIES Prior to starting dewatering and mining operations, silt fencing will be installed along the boundary of the wetlands disturbance.
