Stormwater/Wastewater General Permit. This permit is reissued pursuant to the requirements of North
Carolina General Statute 143-215.1 and the Memorandum ol' Agreement between the state of North
Carolina and the U.S. Environmental Protection Agency, dated October 15. 2007 (or as subsequently
amended.) The following information is included with your permit package:

The General Permit authorizes discharges of Stormwater and/or wastewater (as applicable to your site),
and it specifies your obligations with respect to discharge controls, management, monitoring and record
keeping. Please review the new permit to familiarize yourself with all changes in the reissued permit.
Significant changes to the General Permit are outlined in the Technical Bulletin.
Your coverage under the General Permit is transferable only through the specific action of DEMLR. This
permit does not affect the legal requirements to obtain other permits which may be required by the N.C.
Department of Environmental Quality, nor does it relieve the permittee from responsibility for
compliance with any other applicable federal, state. or, local law, rule, standard, ordinance, order.
judgment or decree.

In accordance with your application for a discharge permit received on May 1, 2014,
we are forwarding herewith the subject certificate of coverage to discharge under the subject
state — NPDES general permit. This permit is issued pursuant to the requirements of North
Carolina General Statute 143-215.1 and the Memorandum of Agreement between North
Carolina and the US Environmental Protection Agency dated October 15, 2007 (or as
subsequently amended).
This certificate of coverage is not transferable. If the facility changes ownership or is
closed, the Division of Energy Mineral & Land Resources may require modification, revocation
or reissuance of the certificate of coverage.
Per the requirements of the Catawba Riparian Buffer Rule, ail stormwater drainage to
stream buffers, from portions of this site that have been constructed after June 30, 2001, must
be discharged through a correctly designed level spreader or another device that meets
diffuse flow requirements per 15A NCAC 2B .0243. Diffuse flow requirements are described
in Chapter 8 of the North Carolina Stormwater BMP Manual, available at:

This permit does not affect the legal obligation to obtain other permits which may be
required by the Division of Energy, Mining, and Land Resources, or any other federal, state, or

sizes. The wash plant will receive crushed stone from an onsite quarry and by utilizing fresh water will assist

overflow from one collection_ settling pond and one stormwater detention basin located along the western
boundary of the subject facility.

33) Signatory Requirements (per 40 CFR 122.22)
All applications, reports, or information submitted to the Director shall be signed and certified.
a. All notices of intent to be covered under this General Permit shall be signed as follows:
(1) For a corporation: by a responsible corporate officer. For the purpose of this permit, a responsible corporate officer means: (a) a president,
secretary, treasurer or vice president of the corporation in charge of a principal business function, or any other person who performs similar
policy or decision making functions for the corporation, or (b) the manager of one or more manufacturing production or operating facilities
employing more than 250 persons or having gross annual sales or expenditures exceeding 25 million (in second quarter 1980 dollars), if
authority to sign documents has been assigned or delegated to the manager in accordance with corporate procedures.
(2) For a partnership or sole proprietorship: by a general partner or the proprietor, respectively; or

(3) For a municipality, state, federal, or other public agency: by either a principal executive officer or ranking elected official.

constitute the permit requirements for the discharge(s) and is enforceable in the same manner as an individual

protection so as to contain all spills on the site.
4. 1 agree that solid wastes will be disposed of in accordance with N.C. statutes and rules governing
solid waste disposal.
5. 1 agree that maintenance activities for vehicles and heavy equipment will be performed so as to
not result in contamination of the surface or ground waters.

enforceable requirements of the General Permit.

We. have reviewed the application your company submitted for the referenced mine site.
However, the following information is needed to continue processing your application: '
Provide proof, such as copies of the signed returned receipts from certified mail,
that the adjoining property owners, county manager, and city/town manager have
been properly, notified. Provide the original affidavit of notification. Provide a
property map showing the location/names of all adjoining landowners.
2. Revise the mine map to show the entire permit boundary. The permit boundary
is a contiguous line that includes all mine features (mine excavation area, waste
area, processing area, screening berms, access/haul roads) and buffers. The
buffers must be clearly labeled as undisturbed or unexcavated. Undisturbed
buffer are left natural and are required around wetlands and waterway (50 foot
undisturbed minimum). Unexcavated buffers can have roads or berms on them
and are located around permit and right-of-way boundaries only. You can have
undisturbed buffers inside of the permit boundaries but you may not.have
unexcavated buffers along wetlands and waterways. Label the length also.
3. Locate the originally permitted 10 acres on the mine map.

4. Provide a detail of the berms. Provide a detail of the waste area, including
staged seeding during construction. Provide a highwall detail that includes the
highwall barrier at the top of the highwall and bench heights/widths.
5. Provide a comprehensive erosion and sediment control plan that includes
construction details and supporting calculations. Sediment basins must pass a
25 year 24 hour storm event. Show the location of all basins, drainage areas of
basins and diversions on the mine map.
6_ Show the centerlines of all waterways on the mine map.
7. Provide a reclamation plan that shows the final pit depth. If this will be below the
water table, explain how a lake area will not be left.
8. Show the location of the asphalt and concrete crushing area in relation to the
permit boundary.
9. The acreage table on the mine map doesn't match the acreages provided in the
individual areas on the mine map. Please clarify.
Please be advised that our review cannot be completed until all of the items listed
above have been fully addressed. In addition, please note the Land Quality Section may
request additional information, not included in this letter, as the mining application review
progresses.
