In accordance with your application for a discharge permit received on October 1,
2013, we are forwarding herewith the subject certificate of coverage to discharge under the
subject state - NPDES general permit. This permit is issued pursuant to the requirements
of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between
North Carolina and the US Environmental Protection Agency dated October 15, 2007 (or as
subsequently amended).
Please take notice that this certificate of coverage is not transferable except after
notice to the Division of Energy, Mineral, and Land Resources. The Division may require
modification or revocation and reissuance of the certificate of coverage.
The active Mining Permit for this site (#70-16) does not allow dewatering. You
must modify that Mining Permit before dewatering is permitted, and you must notify
the Division of Water Resources if the operation will pump over 100,000 gallons per day.
Mine dewatering wastewater includes wet pit overflows caused solely „by dirgct rainfall
and groundwater seepage for this type of mining operation. Any discharge of this water
(and any stormwater commingled with it) is subject to the effluent limitations in this
permit. Complying with an approved Mining Permit is a condition of the NCG020000
NPDES discharge permit.

This general permit allows the discharge of stormwater and certain types of
wastewater from your facility. In your application, you specified that only mine
dewatering water would be discharged from this facility. If separate point -source
discharges of stormwater occur (i.e., stormwater not combined with mine dewatering
water), conditions in this permit for stormwater discharges apply,
Mine dewatering at this site has the potential to impact adjacent wetlands.
Hydric soils have been identified on NRCS maps within the southwestern corner of the
permit boundary and on surrounding properties. You should obtain a preliminary
jurisdictional determination (or "JD") by the U.S. Army Corp of Engineers (USACE) to
determine if wetlands are present, and whether a delineation of wetlands is necessary.
Please contact the USACE to arrange a preliminary JD. NC DENR staff may be available to
attend that site visit as well. Please contact Mr. Thom Edgerton in the Washington Regional
Office DEMLR at (252) 948-3963.
The specific requirements for mine dewatering at facilities near wetlands can be
found in Part II1, Section E of your permit. You must have an aPproved Pumping
Operation and Monitoring O&M) Plan before. mine dewatering discharges occur at
this facility -if wetlands are present on or near this mining site.
A Pumping 0&M PIan for your facility must be submitted to the Washington
Regional Office within 60 days of your receipt of this permit. Contact Thom Edgerton at
-the Washington Regional Office at (252) 948-3963 for more information about the
approval process.. Discharging mine dewatering wastewater without a Pumping O&M. Plan
approval will be subject to enforcement action.
This;project is located in one of North Carolina's 20 coastal counties. Coastal
= stormwater management rules (15A NCAC 2H .1000) may require an additional State
::. Stormwater•Permit (different from the NPDES mining activities. discharge. permit) for built -
upon -areas and.stormwater controls. Please contact Samir Dumpor in the Washington
RegionALOffice;at (252) 948-3959 if you are uncertain about whether to -apply -for a State
Stormwater permit.
f _ This permit does not affect the legal requirements to obtain other permits which
:may:be�required by the Division of Energy, Mining, and Land Resources, or permits =
required by the Division of Water Resources, Coastal Area Management Act, or any other
federal -or local governmental permit that may be required. Please be reminded that

That is correct. The operation or consultant can contact me with any questions regarding the O&M Plan following the
delineation.
The owner or consultant may get a fairly quick review by the Corps, when notified. Anthony and myself may be able to
attend the site visit during the Corps' visit, if we are notified and don't have other scheduled conflicts. I can be

Hi Thom,
Thanks very much for the response and guidance on this one. It sounds like you are advising us to go ahead with the
NCG02 permit COG and advise a wetlands delineation, as well as a Pumping O&M Plan based on those findings. As the
permit states, we would advise the permittee that the Plan be submitted to the WaRO for approval before dewatering
can begin. Do I have that correct?
We will coordinate the NCG02 COC with issuance of any mining permit modification. I believe Judy said the current
mining permit did not allow dewatering and would have be modified. Judy, has the owner applied for that
modification to 70-16? Do we need to make sure he understands he needs to do this?

Permitting may continue.
A preliminary JD is required. An 0&M Plan is required prior to dewatering.
The JD will designate if mining is allowable in the south western area of the permitted boundary, as noted by DWR (See
the message below). Also, the JD will designate if the adjacent area located to the east of the permitted boundary is an
area of environmental concern.
Based on the JD's findings, the 0&M Plan is to present how the operations will be conducted without causing negative
impact to wetlands or other waters of the state.
Please let me know if you need additional information regard the O&M Plan.

After conducting a review of the Notice of Intent for the Rose Pit, the following comments are points of concern the
Division of Water Resources (Division) requests additional information:
According to the Natural Resource Conversation Service (NRCS) Web Soil Survey, a hydric soil exists within the
southwestern corner of the permit boundary. In addition, mapped hydric soils exist on the Hallowell Family Limited
property to the east and Wayne Perry property to the southeast. The Division recommends a preliminary 1D on and off -
site to address the existence ofjuri5dictional wetlands. If wetlands existing, the Division recommends an Operation and
Maintenance, plan to ensure no wetlands will be lost from the on -site mining operation.

We've received an NO1 for Rose Pit in Pasquotank County (in Elizabeth City) to discharge mine dewatering water. I'm
sending this request to you because you were the contact noted on their form when they investigated a state
stormwater permit requirement — but Pat may want to assign this one to someone else. Please let me know the best
contact.
Attached is the NO1. This is an existing sand mine permitted under MP #70-16, but Judy Wehner in the Mining Program
says their current permit does not allow dewatering (and they will need to modify it). The NO1 indicates they are
dewatering now, though, so that could be a compliance problem at the moment.
The discharge is to New Begun Creek (C;Sw) in the Pasquotank Basin. They don't indicated wetlands nearby, but we
wanted to check on that with you all. it's difficult to say from the topo map I've looked at.
Does the WaRO have any comments or concerns with moving ahead with the NCG02 permit for this site? Are there
wetlands nearby that could be impacted, and should they submit a Pumping 0&M Plan for approval?
Also, do we wait for them to modify the Mining Permit before issuing NCG02? Our normal procedure now is to move ahead with NCG02 if there's a MP in place, but to hold off and coordinate as much as possible if the MP is pending. i7@s

There is no dewatering to be done at the site. I don't know why the condition was npt put in the last renewal. Please
remind them to modify the mining permit also. If they pump over 100,000 gal/day they have to notify Water Resources.

Paving Company Inc., transferred in its entirety to,you"company has been approved. As we
have received the required surety in an amount sufficient to cover the present operation, I am
enclosing the transferred mining permit. The permit number, expiration date and mine name
shall remain the same as before the transfer.
Please review the permit carefully and notify this office of any objections or questions

which shall provide that the usefulness, productivity and scenic values of
all lands and waters affected by this mining operation will receive the
greatest practical degree of protection and restoration.

In accordance with the application for this mining permit, which is hereby approved by the
Department of Environment and Natural Resources, hereinafter referred to as the Department,
and in conformity with the approved Reclamation Plan attached to and incorporated as part of
this permit, provisions must be made for the protection of the surrounding environment and for
reclamation of the land and water affected by the permitted mining operation. This permit is
expressly conditioned upon compliance with all the requirements of the approved Reclamation
Plan. However, completed performance of the approved Reclamation Plan is a separable
obligation, secured by the bond or other security on file with the Department, and may survive
the expiration, revocation or suspension of this permit.
This permit is not transferable by the permittee with the following exception: If another
operator succeeds to the interest of the permittee in the permitted mining operation, by virtue
of a sale, lease, assignment or otherwise, the Department may release the permittee from the
duties imposed upon him by the conditions of his permit and by the Mining Act with reference
to the permitted operation, and transfer the permit to the successor operator, provided that
both operators have complied with the requirements of the Mining Act and that the successor
operator agrees to assume the duties of the permittee with reference to reclamation of the
affected land and posts a suitable bond or other security.
In the event that the Department determines that the permittee or permittee's successor is not
complying with the Reclamation Plan or other terms and conditions of this permit, or is failing
to achieve the purposes and requirements of the Mining Act, the Department may give the
operator written notice of its intent to modify, revoke or suspend the permit, or its intent to
modify the Reclamation Plan as incorporated in the permit. The operator shall have right to a
hearing at a designated time and place on any proposed modification, revocation or
suspension by the Department. Alternatively and in addition to the above, the Department
may institute other enforcement procedures authorized by law.
Definitions
Wherever used or referred to in this permit, unless the context clearly indicates otherwise,
terms shall have the same meaning as supplied by the Mining Act, N.C.G.S_ 74-49.
Modifications
April 27, 2011: This permit has been modified to allow the temporary stockpiling and
permanent disposal of off -site generated clean soil material within the mining permit
boundaries as indicated on the 8 X 13 mine map section received by the Land Quality Section
on March 21, 2011.
August 9, 2013: This permit has been transferred in its entirety from Rose Brother Paving
Company, Inc. to Twiford IV, LLC.
Expiration Date
This permit shall be effective from the date of its issuance until April 12, 2017.

Conditions
This permit shall be subject to the provisions of the Mining Act, N.C.G,S. 74-46, et. seq., and to
the following conditions and limitations. -
OPERATING CONDITIONS:
A. Any wastewater processing or mine dewatering shall be in accordance with the
permitting requirements and rules promulgated by the N.C. Environmental
Management Commission.
B. Any stormwater runoff from the affected areas at the site shall be in accordance
with any applicable permit requirements and regulations promulgated by the
Environmental Protection Agency and enforced by the N.C. Environmental
Management Commission. It shall be the permittee's responsibility to contact the
Division of Water Resources to secure any necessary stormwater permits or
other approval documents.
2. A. Any mining process producing air contamination emissions shall be subject to the
permitting requirements and rules promulgated by the N.C. Environmental
Management Commission and enforced by the Division of Air Quality.
B. During mining operations, water trucks or other means that may be necessary
shall be utilized to prevent dust from leaving the permitted area.
3. A. Sufficient buffer shall be maintained between any affected land and any adjoining
waterway or wetland to prevent sedimentation of that waterway or wetland from
erosion of the affected land and to preserve the integrity of the natural
watercourse or wetland.
B. A minimum 30-foot wide buffer zone shall be maintained on the north, east and
south sides of the mine site.
C. A minimum 50-foot wide undisturbed buffer zone shall be maintained on the west
side of the mine site, beginning at the mine permit boundary back to the
easternmost side of the access road.
D. Any mining activity affecting waters of the State, waters of the U. S., or wetlands
shall be in accordance with the requirements and regulations promulgated and
enforced by the N. C. Environmental Management Commission.
4. A. Adequate mechanical barriers including but not limited to diversions, earthen
dikes, check dams, sediment retarding structures, rip rap pits, or ditches shall be
provided in the initial stages of any land disturbance and maintained to prevent
sediment from discharging onto adjacent surface areas or into any lake, wetland
or natural watercourse in proximity to the affected land.

B. An earthen berm (minimum 3 feet in height) shall be constructed and stabilized
along Sand Pit Road between said road and the mine excavation for safety
purposes.
C. Mining activities, including ingress and egress to the excavation area, shall occur
as indicated on the mine map last revised February 21, 2007.
D. All drainage from the affected area around the mine excavation shall be diverted
internal to said excavation.
E. The temporary stockpiling and permanent disposal of off -site generated clean soil
material shall be conducted as indicated on the 8 X 13 mine map section
received by the Land Quality Section on March 21, 2011 and the supplemental
information received February 3, 2011, March 11, 2011 and March 21, 2011.
5. All permit boundaries (31.41 acres) shall be permanently marked at the site on 100-foot
intervals unless the line of sight allows for larger spacing intervals.
6, The angle for graded slopes and fills shall be no greater than the angle, which can be
retained by vegetative cover or other adequate erosion control measure, structure, or
device. In any event, exposed slopes or any excavated channels, the erosion of which
may cause off -site damage because of siltation, shall be planted or otherwise provided
with ground cover, devices or structures sufficient to restrain such erosion.
7. The affected land shall be graded so as to prevent collection of pools of water that are,
or likely to become, noxious or foul. Necessary structures such as drainage ditches or
conduits shall be constructed or installed when required to prevent such conditions.
8. Existing vegetation or vegetated earthen berms shall be maintained between the mine
and public thoroughfares whenever practical to screen the operation from the public.
9. Sufficient buffer, as indicated on the mine map last revised February 21, 2007 and as
specified in Operating Condition No. 3 above, shall be maintained between any
excavation and any mining permit boundary to. protect adjacent property.
10. A, No on -site disposal of refuse or other solid waste that is generated outside of the
mining permit area shall be allowed within the boundaries of the mining permit
area unless authorization to conduct said disposal has first been obtained from
both the Division of Waste Management and the Land Quality Section,
Department of Environment and Natural Resources. The method of disposal
shall be consistent with the approved reclamation plan.
B. Mining refuse as defined by G.S. 74-49 (14) of The Mining Act of 1971 generated
on -site and directly associated with the mining activity may be disposed of in a
designated refuse area. All other waste products must be disposed of in a
disposal facility approved by the Division of Waste Management. No petroleum
products, acids, solvents or their storage containers or any other material that
may be considered hazardous shall be disposed of within the permitted area.
C. For the purposes of this permit, the Division of Energy, Mineral and Land
Resources considers the following materials to be "mining refuse" (in addition to
those specifically listed under G.S. 74-49 (14) of the N.C. Mining Act of 1971):
1. on -site generated land clearing debris
2. conveyor belts
3. wire cables
4. v-belts
5. steel reinforced air hoses
6. drill steel
D. If mining refuse is to be permanently disposed within the mining permit boundary,
the following information must be provided to and approved by the Division of
Energy, Mineral and Land Resources prior to commencement of such disposal:
1. the approximate boundaries and size of the refuse disposal area;
2. a list of refuse items to be disposed;
3. verification that a minimum of 4 feet of cover will be provided over the
refuse;
4. verification that the refuse will be disposed at least 4 feet above the
seasonally high water table; and,
5. verification that a permanent vegetative groundcover will be established.
E. Only off -site generated clean soil material shall be stockpiled or permanently
disposed of within the mining permit boundaries as indicated on the 8 X 13 mine
map section received by the Land Quality Section on March 21, 2011 and the
supplemental information received on February 3, 2011, March 11, 2011 and
March 21, 2011.
11. An Annual Reclamation Report shall be submitted on a form supplied by the
Department by February 1 of each year until reclamation is completed and approved.
12. The operator shall notify the Department in writing of the desire to delete, modify or
otherwise change any part of the mining, reclamation, or erosion/sediment control plan
contained in the approved application for a mining permit or any approved revision to it.
Approval to implement such changes must be obtained from the Department prior to on -
site implementation of the revisions.
13. The security, which was posted pursuant to N.C.G.S. 74-54 in the form of a $23,500.00
Assignment of Savings Account, is sufficient to cover the operation as indicated in the
approved application. This security must remain in force for this permit to be valid. The
total affected land shall not exceed the bonded acreage.
B. Pursuant to N. C. G. S. 70 Article 3, "The Unmarked Human Burial and Human
Skeletal Remains Protection Act," should the operator or any person in his
employ encounter human skeletal remains, immediate notification shall be
provided to the county medical examiner and the chief archaeologist, North
Carolina Division of Archives and History.

The approved plan provides:
Minimum Standards As Provided By G.S. 74-53
The final slopes in all excavations in soil, sand, gravel and other unconsolidated
materials shall be at such an angle as to minimize the possibility of slides and be
consistent with the future use of the land.
2. Provisions for safety to persons and to adjoining property must be provided in all
excavations in rock.
3. All overburden and spoil shall be left in a configuration which is in accordance with
accepted conservation practices and which is suitable for the proposed subsequent use
of the land.
4. No small pools of water shall be allowed to collect or remain on the mined area that are,
or are likely to become noxious, odious or foul.
5. The revegetation plan shall conform to accepted and recommended agronomic and
reforestation practices as established by the North Carolina Agricultural Experiment
Station and the North Carolina Forest Service.
6. Permittee shall conduct reclamation activities pursuant to the Reclamation Plan herein
incorporated. These activities shall be conducted according to the time schedule
included in the plan, which shall to the extent feasible provide reclamation simultaneous
with mining operations and in any event, provide reclamation at the earliest practicable
time after completion or termination of mining on any segment of the permit area and
shall be completed within two years after completion or termination of mining.
RECLAMATION CONDITIONS:
Provided further, and subject to the Reclamation schedule, the planned reclamation
shall be to restore the mine excavation to a lake area and to grade and revegetate the
adjacent disturbed areas.
2. The specifications for surface gradient restoration to a surface suitable for the planned
future use are as follows:
A. The lake area shall be excavated to maintain a minimum water depth of four feet
measured from the low water table elevation.

grasses such as switch grass, Indian grass, bluestem and gamma grass.
In addition, the permittee shall consult with a professional wildlife biologist with the N.C.
Wildlife Resources Commission to enhance post -project wildlife habitat at the site.
4. Reclamation Plan:
Reclamation shall be conducted simultaneously with mining to the extent feasible. In
any event, reclamation shall be initiated as soon as feasible after completion or
termination of mining of any mine segment under permit. Final reclamation, including
revegetation,)shall:be completed within two years of completion or termination of
mining.
This permit, issued to Rose Brothers Paving Company, Inc. June 24, 1993, renewed
April 12, 2007 and modified April 27, 2011, is hereby transferred in its entirety to Twiford
IV, LLC this gth day of August, 2013 pursuant to G.S. 74-51.

The projection used in the preparation of this map was the North Carolina
State Plane (FIPSZONE 3200). The horizontal datum was the North American
Datum of 1983, GRS80 ellipsoid. Differences in datum, ellipsoid, projection, or
Universal Transverse Mercator zones used in the production of FIRMs for adjacent
jurisdictions may result in slight positional differences in map features across
jurisdictional boundaries. These differences do not affect the accuracy of this
FIRM. All coordinates on this map are in U.S. Survey Feet, where
1 U.S. Survey Foot = 1200/3937 Meters.
Flood elevations on this map are referenced to the North American Vertical
Datum of 1988 (NAVD 88). These flood elevations must be compared to structure
and ground elevations referenced to the same vertical datum. An average
offset between NAVD 88 and the National Geodetic Vertical Datum of 1929
(NGVD 29) has been computed for each North Carolina county. This offset was
then applied to the NGVD 29 flood elevations that were not revised during the
creation of this statewide format FIRM. The offsets for each county shown on
this FIRM panel are shown in the vertical datum offset table below. Where a
county boundary and a flooding source with unrevised NGVD 29 flood elevations
are coincident, an individual offset has been calculated and applied during the
creation of this statewide format FIRM. See Section 6.1 of the accompanying

part of the National Digital Orthophoto Program. The time period of collection for the
imagery is 1998-1999. Information and geospatial data supplied by the local community(ies)
that met FEMA base map specifications were considered the preferred source for
development of the base map. See geospatial metadata for the associated digital FIRM
for additional information about base map preparation.

of Special Flood Hazard include Zones A, AE, AH, AO, AR, A99, V, and VE. The Base
Flood Elevation is the water -surface elevation of the 1% annual chance flood.
