This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the US Environmental Protection Agency dated October 15, 2007 (or as subsequently amended). An Operation and Monitoring Plan for your facility must be submitted to the Washington Regional Office within 60 days of your receipt of this permit. I've reviewed the NO!, plans and O&M documents. The O&M document is very short and it could be put together much better, however since the discharge from this mine is going back to the wetlands (recharging the wetlands) I believe that we should ga ahead and issue this permit. As I mentioned to you also, looking at the plans, at the southwestern corner of the mine, there are apparently some spoil piles placed within wetlands. These spoil piles were to be removed by June 21, 2013 according to the plans, to avoid wetland violations. This issue should not prevent you from issuing the permit, however it could be something to ask the consultant if it was done or not. I hope this helps. Please let me know if you need anything else. Date: August 15, 2013 This plan defines responsibilities for operating, inspecting, and maintaining equipment and structures used for dewatering the Wilber Griggs Mine safely, and that dewatering will not degrade or negatively impact any areas of environmental concern or wells. Description and Operation of the Wilber Griggs Mine The Wilber Griggs Mine is the reactivation of an un-permitted mine in lower Currituck County operated in the 1.980's and 1990's the ponds left as a result of this operation contained 3.9 acres and 9.3 acres and are separated by a small berm. The owner plans to dewater the 3.9 acre pit into a settling pond that overflows through a rip -rap spillway and ditch at the northeast side of the mine and ultimately discharging into the wetlands that border the mine to the north and west. At this time Mrs. Griggs is filing an application with DEMLR to permit the affected area to a total of 22.09 acres within the total permit acreage of 24.43 acres. The mining operation for this site is better described in the mining permit application included with this application. Sand Mine Dewatering Dewatering as described above will allow for full depth excavation and proper reclamation of the edges of the pond. It is the intention of Mr. Balance to only dewater the excavation as needed, which will not entail full-time dewatering. The outlet for the dewatering pump from the pond is located on the west side of the settling pond, and there is an overflow outlet located on the east side of the settling pond. The discharge point will release clear water to an agriculture ditch, leading to a wooded wetland area that joins Albemarle Sound (see attached map for outflow route and discharge point locations). Water will be pumped from the 3.9 acre pond to the sediment pond by an 8 in. high head compressor pump rated at 3,200 GPM for 10 hours a day until the desired water depth is reached. Estimated maximum flow from the pump will be 1,920,000 per day initially then diminish to maintain desired level. Water will travel through Bin. pipe to the west side of the settling pond. It is the intention of Mr. Ballance to drop the water level in the main pond approximately 20 feet when needed from natural ground level. The overflow from the settling pond will be over a rip -rap weir constructed in the east side settling pond berm, 1' below the top lip of the berm, and will consist of NC DOT Class B placed on a filter fabric liner (see attached diagram). This control structure wiH allow water to flow over the weir into the existing 5ft wide agriculture ditch located adjacent to the settling pond. For erosion control the discharge ditch will have 2 check dams installed causing water to back up and be stored in 2 agriculture ditches before topping the check dams, the overflow water will then travel northwest 400' and empty into the adjoining wetland area . Time and distance will allow suspended materials to settle to acceptable levels before the overflow water reaches outfall and then the waters of the State. Also the water backing up in the 2 adjacent ditches will allow infiltration back into the soils reducing the total discharge and recharging the ground water table. Sedimentation and Erosion Control All erosion and sedimentation will remain inside of the permit area; all stormwater will be diverted into the pit. The outfall ditch will be monitored for sediment build up and cleaned as needed. A water truck will be used as needed to keep dust to a minimum. Maintaining the Settling Pond Overflow Control Structure, Settling Pond and Ditches Inspections and maintenance are required to obtain the intended function of safely dewatering the sand mine, and to maintain the life of adjacent wetlands or waters of the State. Items to inspect and maintain during the 10 year life of the mine dewatering permit are: • Inspect the check dams, out flow weir and ditches regularly, especially following heavy rains and runoff, or during periods of operation of the structure. • Inspect the structures for sediment and erosion around the sides of the structure. Remove accumulated debris and sediment from the riprap check dams. Replace dislodged rock as necessary. • Inspect settling pond berm and repair any damaged areas as needed. • Repair any damage to vegetated areas or berms with compacted earth fill, reshaping, sodding, reseeding and mulching as needed. Monitoring the Process and Effects of Dewatering Monitoring of mine dewatering wastewater will be in accordance with the NCG020000 permit, as follows: • All ponds in the Wilber Griggs Mine permit area will be inspected weekly by the operator to identify any abnormal conditions. • All berms and erosion control and sedimentation control structures will be inspected following significant (1J2-inch) rainfall events for damages, and all structures will be repaired immediately. Dewatering process will be inspected daily during pericds of dewatering the excavation. • Rain gauge data will be collected by monitoring rain gauge data monthly and after each rain event. Wetland areas will be inspected and any adverse effects will be noted and corrective measures taken as needed. Erect Mine Access Gate A metal post and chain or swing metal bar gate will be installed to prohibit access to the mine as shown on the attached site plan. No trespassing signs will also be erected every 250' along the permit boundary and at the main access. If required a fence (wooden post and metal cable) can be erected along the southern boundary to further limit access, however a fence is not currently planned. Please note, there is an active materials and aggregate storage facility located on the eastern portion of the property that is operated by Barnhill Contracting, Inc. and access by the public is not generally an issue. 2. Mark Active Mine Limits and Cemetery Buffers Active Mine Limits and cemetery buffers will be delineated and marked. Active mine limits will be marked every 100 feet (more or less provided line of sight is adequate) using white PVC pipe (typical). Cemetery buffers will be installed using wooden posts and rope and/or cable_ 3. Haul Roads The haul roads have an existing paved surface and serve other uses to this parcel; they will be maintained as needed. 4. Daily Operation The mine will be open six days a week from dawn to dusk and will generally offer sand for sale to the public. A dredge company will fill the settling pond/stockpile/processing area and allow the material to dewater. The mine manager/operator will then fill dump trucks with the dried materials as needed and at mine manager's discretion and leisure. Once the dewatered material is sold and loaded, a dredge company will be contracted to return and start the process again. V. a 0 .I Appendix B Sedimentation and Erosion Control Measures The mine is designed to not have any discharge to any waters of the state. All stormwater runoff will be diverted into the pit area. The mine uses existing paved and gravel roads to access the site (prior to exiting onto Highway 158). The proposed method of mining, if preformed as outlined within the attached Mine Permit Application, will not discharge sediment into any ditches that lead to or any watercourse or Waters of the US of the State of North Carolina.
