In accordance with your application for a discharge permit received on June 6, 2012, we
are forwarding herewith the subject certificate of coverage to discharge under the subject state —
NPDES general permit. This permit is issued pursuant to the requirements of North Carolina
General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the
US Environmental Protection Agency dated October 15, 2007 (or as subsequently amended).
Please take notice that this certificate of coverage is not transferable except after notice to
the Division of Water Quality. The Division of Water Quality may require modification or
revocation and reissuance of the certificate of coverage.
Please note that mine dewatering wastewater includes wet pit overflows caused solely
by direct rainfall and groundwater seepage for this type of mining operation. Any discharge of
this water (and any stormwater commingled with it) is subject to the effluent limitations in this
permit.
Additionally, new coastal stormwater management rules (SESSION LAW 2008-211)
were irnpiemented October il, 2008. Due to these new rules you may be required to appiy for an
additional Coastal State Stormwater Permit. Please contact Kelly Johnson in the Wilmington
Regional, Office at 910- 79641345 to determine if you will be rcquired to submit an application
for this additional permit.
This permit does not affect the legal requirements to obtain other permits which may be
required by the Division of Water Quality or permits required by the Division of Land
Resources, Coastal Area Management Act or any other federal or local governmental permit that
may be required.

We've received an NOI from Barnhill Contracting Company for their site Beaver Dam Mine in Brunswick County for
coverage of their sand and clay mine. The site discharges stormwater to Beaverdam Swamp (C;Sw). The NOI is
attached. It looks like you did a site visit and advised them they needed a permit.
Please let me know if the Wilmington Regional Office has any concerns about issuing this facility a COC for this general
permit, and are there any potential impacts to wetlands? If we don't receive any objections, we'll issue the COC in 30
days.

employing more than 250 persons or having gross annual sales or expenditures exceeding 25 million (in second quarter 1980 dollars), if
authority to sign documents has been assigned or delegated to the manager in accordance with corporate procedures.
(2) For a partnership or sole proprietorship: by a general partner or the proprietor, respectively; or
(3) For a municipality, state, federal, or other public agency: by either a principal executive officer or ranking elected official.
I hereby request coverage under the referenced General Permit. I understand that coverage under this permit will
constitute the permit requirements for the discharge(s) and is enforceable in the same manner as an individual
permit.

Dear Mr. Bennett,
Please find enclosed Barnhill Contracting Company's Notice of Intent
for a NCG020000 permit for our Beaver Dam Mine in Brunswick County. We
have met on -site with DWQ representative Linda Willis of the Wilmington
Regional office in regards to our renewal of this mining permit. After a
site review, Ms. Willis determined that we need a discharge permit for
this pit because of an outlet pipe installed in the southern end of the
settling pond. We do not dewater this pit and the only disch ge that may
occur would be from an extreme rain event. I have updated and enclosed
the mine map to show all buffers, the metal outlet pipe, and other
features on -site. The map also shows the relative water flow on the
property. Our mining permit is currently under renewal with the Land
Quality.
Please find enclosed the Notice of Intent and all supporting
documents with the requested information. Should you have any questions,

The Solid Waste Section reviewed your Land Clearing and Inert Debris (LCID) landfill notification for the above
referenced address received on September 7, 2005. Based on the information submitted in the notification,
approval for operation of a LCID landfill is hereby granted for disposal activities at the referenced property as
long as the facility does not exceed 2 acres in size.
Should your landfill disposal facility exceed 2 acres in size, you will need to make application to the Solid Waste
Section for an individual LCID disposal permit. Please be aware that the application and siting requirements for
an individual LCID permit are more stringent.
This authorization is issued under the conditions summarized below and specifically contained in 15ANCAC 1313
Sections .0563, .0564 and .0566.
1) When the property is sold, leased, conveyed or transferred, the deed or other instrument of transfer shall
contain in the description section a statement that clearly states the property was used as a Land Clearing and
Inert Debris landfill, The statement shall be in type that is no smaller than the size used in the body of the deed
or instrument.
2) Amendments or revisions to the Solid Waste Management Rules or the violation of groundwater standards
may necessitate modification of the construction and operation of this facility or closure of this facility.
3) This authorization is not transferable.
4) The Land Clearing and Inert Debris landfill is permitted to receive the following material types:

a) Land Clearing Waste as provided in 15A NCAC 13B .0101(72), stumps, trees, limbs, brush, grass, and
other naturally occurring vegetative material.
b) Inert Debris and untreated wood as provided in 15A NCAC 13B .0101(73); concrete, brick, concrete
block, uncontarninated soil, gravel and rock, untreated and unpainted wood.
c) Used asphalt as provided under North Carolina General Statute'130A-309.0913(a)(1); used asphalt or
used asphalt mixed with dirt, sand, gravel, rock, and concrete.
5) Site preparation and construction shall be in accordance with 15A NCAC 13B .0564, Siting Criteria For Land
Clearing and Inert Debris (LCID) Landfills for facilities of less than 2 acres in size.
6) The facility must be operated in accordance with 15A NCAC 1313 .0566, Operational Requirements for Land
Clearing and Inert Debris (LC1.D) Landfills.
7) The approved facility must comply with the sedimentation and erosion control requirements contained in 15A
NCAC 4, Sedimentation Control. Construction and operations involving sedimentation and erosion control
activities greater than 1 acre typically require approval from the Land Quality Section. You should contact the
Land Quality Section at [phone] to determine whether your disposal activities require approval.
8) Ground water quality at this facility is subject to the classification and remedial action provisions of 15A
NCAC 2L, Classifications and Water Quality Standards. Please contact the Water Quality Section ( 1 -877-
623-6748) for additional information.
9) Closure of the facility shall be in accordance with 15A NCAC 13B .0566(5), which requires a minimum of l
foot of suitable soil cover sloped to allow surface water runoff in a controlled manner be applied within 120
calendar days after completion of any phase of disposal operations or upon revocation of a permit. Please
note that the regulation gives the Solid Waste Section the authority to require further actions if needed to
correct any adverse condition.
