This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the US Environmental Protection Agency dated October 15, 2007 (or as subsequently amended). Please take notice that this certificate of coverage is not transferable except after notice to the Division of Water Quality. The Division of Water Quality may require modification or revocation and reissuance of the certificate of coverage. A requirement of this permit is compliance with the Division of Land Resources' (DLR) Minim Permit; therefore, you must hold a approved DLR permit before any mining industrial activities take place. `Phis site will discharge to a wetland near a receiving stream designated as High Quality Waters (M. QW) and a Primary Nursery Area (PNA), Williston Creek. Should the dewatering activities result in a discharge to Williston Creek, a now limit will be imposed in accordance. with 15A NCAC 213.0224(1)(b)(v). . Their discharge would have to travel approximately 1400-1700 feet before entering a tidally influenced LIT to Williston Creek. The width of the creek where the discharge is mostly likely to make it is 66' wide and I'm guessing'/ 'deep on low tide. i can't use a zero or negative flow for incoming tide situation so I use the situation where the tide is slack on the failing tide. So, I use .005 ft/s as the flow in stream when the tide is dropping. This is conservative (I think), since I cannot hike to the creek at that location and I haven't been given the ok to put in a kayak and paddle there to check the depth on the falling tide.. but the theory is.. that we are protecting the creek during the lowest flow scenario. (( 66' X .3/4' X .005 ft/s ) x 7.48 gal/tuft X 86400 sec/day ) = 159,952 then I rounded it down for safety factor .. that's how I got 150,000 gallons/day as the 7Q10. It's the best I can do given I have absolutely no guidance from anywhere on how to handle this and business keeps rolling in and we have to find answers. So, it's an answer and it's more protective than no flow limit. Sound ok to you? What we realized after Brian reviewed the application was that the mine pit would discharge to an ORW and DWQ couldn't allow a discharge to ORW waters (it's against our rules for ORW classified waters). So, that put me back to the drawing board with Mr. Willis concerning the discharge plan. I visited the site again and we talked about how to get the discharge to Williston Creek. Your recent plan takes care of that issue for us. Currently, the new settling basin proposed north of the site goes to a ditch and travels about a half of a mile before it discharges into a canal (that was dug for mosquito control many moons ago). The closest conveyance via the mosquito canal to the mainstem of Williston creek would put the discharge where the creek is about 66' across. I would request that the discharge not exceed a limit of 150,000 gallons per day (Brian, can you make that statement in the cover letter and request we get the 0 & M in writing within say 15 business days? I can share my crude talcs on that if you're interested, but since this creek is an HQW, we have flow limits to consider. She really does not have anything else to go on, and I applaud her effort to estimate a limit on more appropriate low flow conditions for a tidal water. I'd suggest some language like this for the cover letter. It starts out like our current letter template (but slightly revised). What we realized after Brian reviewed the application was that the mine pit would discharge to an ORW and DWQ couldn't allow a discharge to ORW waters (it's against our rules for ORW classified waters). So, that put me back to the drawing board with Mr. Willis concerning the discharge plan. I visited the site again and we talked about how to get the discharge to Williston Creek. Your recent plan takes care of that issue for us. Currently, the new settling basin proposed north of the site goes to a ditch and travels about a half of a mile before it discharges into a canal (that was dug for mosquito control many moons ago). The closest conveyance via the mosquito canal to the mainstem of Williston creek would put the discharge where the creek is about 66' across. I would request that the discharge not exceed a limit of 150,000 gallons per day (Brian, can you make that statement in the cover letter and request we get the 0 & M in writing within say 15 business days? I can share my crude talcs on that if you're interested, but since this creek is an HQW, we have flow limits to consider. 'rhe type of discharge that will be present on the site will be mine dewatering. Reference is made to the site plan that illustrates the points of discharge from the mine. Robert Preston Willis proposes to dewater mining operations through the following sequence of events. 1. Erosion Control items will be installed prior to any mining activities on the site. Sediment Basins, Diversion Ditches, and Level Spreaders will be installed per plan design before mining activities begin in any area of site. 2. Excavation will begin in pit area 2 (indicated on map) in the southern most point and continuing north. When mining activities extend below the water table, water will begin being pumped into basin 1, where it will have time to settle and once it reaches the height of the level spreader it will flow over the 50 undisturbed buffer back into the wetlands rehydrating them. 3. Excavation will continue in pit area 2 leaving a 10 foot damn between the first 1 pond and the second pond area, still in pit area 2. Water will now be pumped into the first excavated area then it will be pumped to the basin area I and out through the level spreader. 4. Once the third pond area is done we will go back to the first 10 foot damn and knock it out creating a larger area of settling for the water to be pumped from pond area 3 into this larger area then out through the level spreader. 5. This process will continue throughout the entire site. 6. There are two extra basins proposed in the plans for dewatering if wetland hydration is inadequate and needs to be dewatered in multiple areas to distribute equally. These are indicated on the plans by basin 3 and basin 4.
