In accordance with your application for a discharge permit received on September 26,
2011, we are forwarding herewith the subject certificate of coverage to discharge under the
subject state — NPDES general permit. This permit is issued pursuant to the requirements of
North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North
Carolina and the US Environmental Protection Agency dated October 15, 2007 (or as
subsequently amended).
Please take notice that this certificate of coverage is not transferable except after notice to
the Division of Water Quality. The Division of Water Quality may require modification or
revocation and reissuance of the certificate of coverage.
A requirement of this permit is compliance with the Division of Ener,-y, Mineral and
Land Resources' (DEMLR) Mining Permit; therefore, you must hold an approved DEMLR
permit before any mining industrial activities take place.
Please be aware that mine dewatering at your site has the potential to impact adjacent
wetlands. The specific requirements for mine dewatering at facilities near wetlands can be found
in Part III, Section E of your permit. You must have an approved Operation and Monitoring
Plan before mine dewatering discharges occur at your facility. Discharging mine dewatering
wastewater without Plan approval will be subject to enforcement action. An Operation and
Monitoring Plan for your facility must be submitted to the Wilmington Regional Office within
60 days of your receipt of this permit. Contact Chad Coburn at the Wilmington Regional
Office at (910) 796-7215 for more information about the approval process.
This site will discharge to a receiving stream designated as High Quality Waters
(HQW) and a Primary Nursery Area (PNA). As a result, a more stringent TSS limit and
wastewater discharge volume applies [per Table 8 in the_permitj. The 7Q10 flow for the UT to

Mill Creek at this location is estimated to be 4.5 cfs; therefore, wastewater discharge to the UT
to Mill Creek should be limited to 1,454,000 gallons per day (gpd) or less. This must be
included in your 0&M Plan, which is an enforceable part of the permit.
Please note that mine dewatering wastewater includes wet pit overflows caused solely
by direct rainfall and groundwater seepage for this type of mining operation. Any discharge of
this water (and any stormwater commingled with it) is subject to the effluent limitations in this
permit.
This general permit allows the discharge of stormwater and certain types of wastewater
from your facility. In your application, you specified that only mine dewatering water would be
discharged from this facility. If separate point -source discharges of stormwater occur (i.e.,
stormwater not combined with mine dewatering water), you will be required to adhere to the
conditions in this permit for stormwater discharges.
This permit does not affect the legal requirements to obtain other permits which may be
required by the Division of Water Quality or permits required by the Division of Land
Resources, Coastal Area Management Act or any other federal or local governmental permit that
may be required.

wasn't able to find another address for Mr. Young. I've run into this sort of thing in the past. Hopefully we will not

I went out there last week to look at the NCGO10000 items. I agree with what you mentioned below. It looks like they
are close to reclaiming the existing pit but I'm guessing that they plan on opening a new pit at some point in the future.
If we issue the COC then we won't have to go through all of this again. I ride by the site quite often so we will probably
notice any "mining" activity should it begin in the future. According to Brian Lambe with DLR (DEMLR) they are a long
way away from opening a new pit. Let me know if this sounds okay with you. Thanks!

think that I finally have the story straight on this mine site. DLR says that the applicant had an illegal mine on the tract
which is what they are reclaiming now. They have an application for another mine pit on a different part of the tract but
the applicant has not fully paid the application fee and so they cannot move forward with the permitting review. I'm
thinking that we should not ask the applicant to withdraw the NCG02 application (unless the applicant asks us to
withdraw it) since it appears that there is an intention of moving forward with a new pit at some point in the future.

We requested information on October 28, 2011 and the letter was returned "unable to forward" so I really have no idea
what is going on with him. He did not pay his processing fee among many other things. We would have no problems as
long as he realizes he can't mine until he gets his mining permit. Can you condition it as such?

I would estimate the flow in the actual stream as probably 3 or 4 times the flow in the ditch. I guess something like 4.5
cfs? You've got a good point about the potential for scouring and TSSTII get with them and see what they can do.

Could you estimate a flow in the stream? That is what we'll base their pumping activities on. The only issue for the
ditch (non stream feature) is that the pumping via it is not causing scouring which would carry TSS to the receiving
stream.

Sure, I'll see what I can do. I'll need the NO1 and contact info. Keep in mind that the feature that the mine discharges to
is NOT a stream. It doesn't become Mercers Mill Pond for some ways down gradient. The flow estimate was for the
non -stream feature. The actual stream had more flow just fyi.

The Division of Water Quality's Stormwater Permitting Unit received a National Pollutant Discharge Elimination
System (NPDES) permit application for Midway Mine on September 26, 2011. The Following information is needed
to continue the stormwater review:
. Mine dewatering discharges are proposed at this site to a stream classified as a High Quality Water
(HQW). The general permit requires that the total volume of treated wastewater for all discharges
combined shall not exceed 50 percent of the total in -stream flow of the receiving waters under 7Q 10
conditions in HQW waters. Please contact the Mr. J. Curtis Weaver with the USGS to request a
determination of what the 7Q 10 is for the receiving stream. His contact information is:

2. The mining plans submitted show wetlands on the property. Please provide documentation that the
wetlands shown are based on a Jurisdictional Determination from the U.S. Army Corps of Engineers.
Please also be aware that your project is located near wetlands. Your NPDES permit will require
dewatering operations without wetland impacts. The specific requirements for mine dewatering at
facilities near wetlands can be found in the text of the general NPDES mining permit number NCG
020000 available on our website, http://portal.ncdenr.orglweb/wq/ws/su/npdessw. See Part III, Section E
of the permit. An approved Operation and Monitoring Plan is required for NPDES-permitted
mining facilities and may be required prior to permit issuance. Discharging mine dewatering
wastewater without Plan approval will be subject to enforcement action. A Plan for your facility must be
submitted to the Washington Regional Office within 60 days of your receipt of an NPDES permit. Please
contact Linda Willis at the Wilmington Regional Office at (910) 796-7215 to address any wetland
concerns for your facility in order to ensure a successful NPDES application review.

I went out to this site yesterday with Jean Conway. The point of discharge as proposed would be to a ditch that
eventually connects to Mercers Mill Pond which is a Tributary to Mill Creek (C;Sw;HQW). This feature is not tidal
anywhere near the discharge point. We calculated the flow to be approximately 1.25 cfs. Let me know if you need
anything else.

The Division of Water Quality's Stormwater Permitting Unit received a National Pollutant Discharge
Elimination System (NPDES) permit application for Midway Mine on September 26, 2011. The application
noted that an associated application for a mining permit was submitted to the Division of Land Resources
(DLR). Please be aware that the issuance of an NPDES permit is contingent upon the issuance of an
associated mining permit from DLR. Our office will process your stormwater permit application once a
DLR mining permit has been issued for your project.
Please also be aware that if your project is located near wetlands, your NPDES permit will require
dewatering operations without wetland impacts. The specific requirements for mine dewatering at facilities
near wetlands can be found in the text of the general NPDES mining permit number NCG 020000 available
on our website, http://portal.ncdenr.org/web/wq/ws/su/npdessw. See Part I11, Section E of the permit. An
approved Operation and Monitoring Plan is required for NPDES-permitted mining facilities and may be
required prior to permit issuance. Discharging mine dewatering wastewater without Plan approval will be
subject to enforcement action. A Plan for your facility must be submitted to the Washington Regional Office
within 60 days of your receipt of an NPDES permit. We encourage you to contact Linda Willis at the
Wilmington Regional Office at (910) 796-7215 to address any wetland concerns for your facility in order to
ensure a successful NPDES application review.

submitted at least 90 days prforJo construction'.
For existing mining sites that require an Authorization to Operate (ATO) wastewater treatment facilities:

Construction, modification or_ installation of any new treatment components at an existing site requires an
