']'his permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the US Environmental Protection Agency dated October 15, 2007 (or as subsequently amended). Please take notice that this certificate ofcoverage is not transferable except after notice to the Division of Water Quality. The Division of Water Quality may require modification or revocation and reissuance of the certificate of coverage. Please be aware that mine dewatering at your site has the potential to impact adjacent wetlands. The specific requirements for mine dewatering at facilities near wetlands can be found in Part III, Section E of your permit. You must operate under your approved Operation and Monitoring Plan at your facility. Please note that mine dewatering wastewater includes wet pit overflows caused solely by direct rainfall and groundwater seepage for this type of mining operation. Any discharge of this water (and any stormwater commingled with it) is subject to the effluent limitations in this permit. The USACOE was at the site conducting a wetlands survey to determine the extent of any wetland impacts as the result of the mining activity at the site. I spoke with Floyd Williams on August 22, 2011. It is my understanding he is providing consulting services for the NPDES and Mine permit for this site. Floyd indicated that the USACOE determined there to be wetlands on the site that were already impacted due to the land disturbing activities on site. Floyd indicated that the existing pit will be used as a settling basin and any further mine pit water from future excavations will be pumped to this settling pond. The settling basin has an outlet to roadside ditches that will eventually discharge to surface waters of the State (Northwest Prong of the Newport River). I discussed the situation with Floyd and indicated that as long as he maintains a water level in the settling pond that is at or above the elevation of the adjacent wetland, the wetland should be protected. I asked him to provide a plan that will demonstrate adequate protection for the wetland area. Please provide a plan that shows the elevations of the permanent pool that will be maintained in the settling pond, the elevation of the bottom of the outlet structure and the elevation of the wetland located next to the pit. Be sure that the permanent pool elevation in the settling pond will be high enough to recharge the wetland. Please forward the plan to my attention (see address below). Miller, Jr., requesting that information be provided to demonstrate that mine dewatering will not have adverse effects on the wetlands at the Miller No. 2 Mine in Carteret County. The wetlands (.14 acres) at the site are located immediately on a section of the west side of an existing pond (Pond is 350' long, 30' wide) that has been partially cleaned out. The U. S. Army Corps of Engineers delineated this small area of wetlands. Any dewatering discharges from mine pits will result in flow entering the existing .5 acre pond which will recharge the wetlands adjacent to the pond. No more than 98,000 thousand/gallons per day will be discharged from the dewatering activities on any given day. The applicant will pump from one pit into another and will discharge through the pond area only when necessary. Applicant will only dewater a few days at a time and place the excavated material adjacent to pit areas, let it dry out, then utilize. It could be a month or more between dewatering activities. Discharging into the existing pond will result in the .14 acres of wetlands that butts up to the pond being recharged.. For existin mining sites that require an Authorization to Operate (A TO) wastewater treatment facilities: This NOI is also an APPLICATION FOR an ATO for wastewater treatment facilities in place. Construction, modification, or installation of any new treatment components at an existing site requires an ATC.
