In accordance with your application for a discharge permit received on April 1, 2011, we
are forwarding herewith the subject certificate of coverage to discharge under the subject state —
NPDES general permit. This permit is issued pursuant to the requirements of North Carolina
General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the
US Environmental Protection Agency dated October 15, 2007 (or as subsequently amended).
Please take notice that this certificate of coverage is not transferable except after notice to
the Division of Water Quality. The Division of Water Quality may require modification or
revocation and reissuance of the certificate of coverage.
Please be aware that mine dewatering at your site has the potential to impact adjacent
wetlands. The specific requirements for mine dewatering at facilities near wetlands can be found
in Part III, Section E of your permit. You must have an approved Operation and Monitoring
Plan before mine dewatering dischary_es occur at your facility. Discharging mine dewatering
wastewater without Plan approval will be subject to enforcement action. An Operation and
Monitoring Plan for your facility must be submitted to the Washington Regional Office within
60 days of your receipt of this permit. Contact Al Hodge at the Washington Regional Office at
(252) 946-6481 for more information about the approval process.
Please note that mine dewatering wastewater includes wet pit overflows caused solely
by direct rainfall and groundwater seepage for this type of mining operation. Any discharge of
this water (and any stormwater commingled with it) is subject to the effluent limitations in this
permit.
This general permit allows the discharge of stormwater and certain types of wastewater
from your facility. In your application, you specified that only mine dewatering water would be
discharged from this facility. If separate point -source discharges of stormwater occur (i.e.,
stormwater not combined with mine dewatering water), you will be required to adhere to the
conditions in this permit for stormwater discharges.

Additionally, new coastal stormwater management rules (SESSION LAW 2008-21 1)
were implemented October 1, 2008. Due to these new rules you may be required to apply for an
additional Coastal State Stormwater Permit. Please contact Samir Dumpor in the Washington
Regional Office at (252) 946-6481 to determine if you will be required to submit an application
for this additional permit.
This permit does not affect the legal requirements to obtain other permits which may be
required by the Division of Water Quality or permits required by the Division of Land
Resources, Coastal Area Management Act or any other federal or local governmental permit that
may be required.

Tier 1 Response:
Asphalt Materials received stormwater results via Prism Laborites on 10/25/10 for outfalls 1-5. Outfall 2
showed a TSS reading of 140mg/L. This TIER 1 Response is to document the failure at Outfall #2 as
required by the NCDENR NCGO8000 Stormwater permit associated with this facility.
Inspection:
Marcus Hackler, Environmental Coordinator for Rea Contracting visited the site after results
were received on 10-25-10. Upon inspection of the outfall it was concluded that possible reason for high
TSS could be due to a rough edge between the asphalt and the grass that leads to the outfall. It is our
belief that the thawag of water running to this outfall collects sediment from this rough edge before
entering the discharge area. This scenario could potentially increase the TSS load of the sample.
Corrective Action:
To correct this problem, we will add a check dam in front of outfall 2 for filtering.

Hello,
I met with Floyd Williams on 4/21/11 to discussed DWO's views regarding impacts from mining operations to wetlands
and other waters of the state. We went through the NOI and discussed each item in order; to achieve project clarification,
to provide a better understanding of the DWO requirements, and to provide guidance toward producing an acceptable
O&M Plan. Mr. Williams presented photos of the operation and stated that he will deliver an acceptable O&M Plan ASAP.
Note: I had previously met with the owners regarding my comments following the new mining permit review of the expired
existing operation. We discussed all of the DWO permitting requirements.
I have no objection to the issuance of the Mining Permit, nor to the issuance of the COC. I expect to receive an
acceptable O&M Plan in the very near future and will update you, the electronic record, as well as document the file of the
approval.

Hi Al,
Hope you are well! We've received an NOI from Thomas D. Norman for his sand mine in Coluiubia
(Tyrrell County) for coverage under NCG02 (Mining SW/WW permit). The site discharges stormwater
and mine dewatering water into Bull Bay (SB) through a settling basin. The NOI is attached.
Their Mining Permit expired — 89-07 and they have applied to get a new one. They say they are not
impacting wetlands but on the aerial photograph it looks pretty wooded there.
So basically I have two questions for you all:
1. Are you alright with them discharging into SB waters?
2. Do you all think they need an O&M plan and are you all concerned about potential impacts to
wetlands?
Does the Washington Regional Office have any concerns about issuing this facility a COC for this general
permit, and are there any potential impacts to wetlands? If we don't receive any objections, we'll issue the
COC in 30 days. I've sent along the NOI copy and map copy to your RO.

Hi Al,
Hope you are well! We've received an NOI from Thomas D. Norman for his sand mine in Columbia
(Tyrrell County) for coverage under NCG02 (Mining SW/WW permit). The site discharges stormwater
and mine dewatering water into Bull Bay (SB) through a settling basin. The NOI is attached.
Their Mining Permit expired — 89-07 and they have applied to get a new one. They say they are not
impacting wetlands but on the aerial photograph it looks pretty wooded there.
So basically I have two questions for you all:
1. Are you alright with them discharging into SB waters?
2. Do you all think they need an O&M plan and are' you all concerned about potential impacts to
wetlands?
Does the Washington Regional Office have any concerns about issuing this facility a COC for this general
permit, and are there any potential impacts to wetlands? If we don't receive any objections, we'll issue the
COC in 30 days. I've sent along the NOI copy and map copy to your RO.

the system and operate at or below two -feet of freeboard. These systems maybe permitted by a Non -discharge Recycle System

operations and/or concrete operations;
• Stormwater discharges associated with oil and gas extraction operations; and
• Stormwater discharges associated with tourist gem mines
• NCDOT borrow pits are covered under NCS000150
The following discharges are covered by NPDES-general Rermit NCG520000 instead of NCG020000:
• Point source discharges of stormwater and wastewater from in -stream sand mining operations (i.e., sand
dredging or dipping operations)
For new mining sites that require an authorization to construct (ATC) wastewater treatment facilities: This
NOI is also an APPLICATION FOR an ATC for new wastewater treatment facilities. ATC requests must be
submitted at least 90 days prior to construction'.
For exi_ •stin_g mining sites that require an Authorization to Operate (ATO) wastewater treatment facilities:
This NOI is also an APPLICATION FOR an ATO for wastewater treatment facilities in place.
Construction, modification, _orinstallation of any new treatment components at an existing site requires an
ATC. (If the site is already covered by NCG020000, the ATC request may be submitted without an NOI).
Some wastewater treatment facilities used to treat or recycle wastewater at mining sites will require an ATC riot
to construction per 15A NCAC 2H .0138. Please see the NCG020000 General Permit for details about which
treatment facilities require an ATC (summarized in Table 1 below). The authorization to construct or continue
to operate will be issued at the same time as the Certificate of Coverage (COC) for the NCG02 permit. Design of
treatment facilities must comply with requirements of 15A NCAC 2H .0138 & .0139.
Construction of wastewater treatment facilities subject to the ATC/ATO requirements in the NCG02 permit
at new or existing mining sites requires submission of three (3) sets of plans and specifications signed
