we are forwarding herewith the subject certificate of coverage to discharge under the subject
state — NPDES general permit. This pen -nit is issued pursuant to the requirements of North
Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina
and the US Environmental Protection Agency dated October 15, 2007 (or as subsequently
amended).
Please take notice that this certificate of coverage is not transferable except after notice to
the Division of Water Quality. The Division of Water Quality may require modification or
revocation and reissuance of the certificate of coverage.

I just wanted to make sure about this but I am planning on issuing this permit (Frank Horne Mine) now but adding to the
cover letter that they must get an 0 & M plan to discharge. Is that correct?

Thank you Bradley. I'd have to check our files to see if we need an 0 & M from them. I can't get into our file room just
yet, but I'll follow up with you on this one.
By the way, Brian Lowther had an application from Frank Horne for a mining permit. Frank later told Brian to "forget it,
they weren't going to mine the property", however, he's already dug a pretty good sized pit. So, we sent him an NOV-
2010-OP-0002 for discharging without a permit. He came in with his consultant and son and discussed why they
received the NOV. They are back to "wanting" the permit, so we can move forward issuing (mainly because I want them
monitoring the stormwater discharges from the pit), but until 1 get a satisfactory 0 & M from them.. no dewatering.

On November 18, 2009, and January 7, 2010, Mr. Chad Coburn from the North Carolina
Division of Water Quality conducted a site inspection for your mine site located off of
NC Highway 904 in Columbus County. An active mining operation was observed during
these two visits. A file review confirmed that coverage under the NPDFS General Permit
to discharge stormwater from mining activities has not been secured in accordance with
the provision of North Carolina General Statute 143-215.1. As a result of the site
inspection and a file review, the following violation is noted:
Failure to Obtain General Stormwater Permit NCG020000
The DWQ received a Notice of Intent application on August 27, 2009, for coverage under
this general permit. 'riie DWQ requested additional information regarding any potential
impacts to wetlands but was notified by Chuck Stanley of Frank Horne Construction that
this project would not be undertaken after all. However, site visits show that an access
road, spoil pile, and mine pit have been constructed.

Stormwater discharges from the construction and operation of the mine pit, spoil pile, and
access road require a certificate of coverage under the North Carolina General Permit
NCG020000. The discharge from these structures should be eliminated immediately
until receipt of an NCG020000 permit is secured.
Please be advised that a Violation of NCGS 143-215.1 may result in the
assessment of a civil penalty of up to $25,000.00 in accordance with NCGS 143-215.6A.
It is recommended that you respond in writing to this office within 15 days upon
receiving this notice. Your letter should include corrective actions taken to prevent
future occurrences. In addition, you should indicate the reason for the release of the
alining activity stormwater without obtaining prior coverage under the general permit. If
you have any questions, you may contact either myself, Chad Coburn, or Linda Willis at

The following discharges are covered by NPDES general permit NCG520000 instead of NCG020000:
• Point source discharges of stormwater and wastewater from in -stream sand mining operations (i.e., sand
dredging or dipping operations)
For new mining sites that require an authorization to construct (ATC) wastewater treatment facilities: This
NOI is also an APPLICATION FOR an'ATC for new wastewater treatment facilities. ATC requests must be
submitted at least 90 days prior to construction'.
For existingr mining sites that require an Authorization to Operate (ATO) wastewater treatment facilities:
This N01 is also an APPLICATION FOR an ATO for wastewater treatment facilities in place.
Construction, modification, or installation of any new treatment components at an existing site requires
an ATC. (If the site is already covered by NCG020000, the ATC request may be submitted without an NOI).
Some wastewater treatment facilities used to treat or recycle process wastewater (even if commingled
with stormwater) at mining sites will require an ATC prior to construction per 15A NCAC 214.0138.
Please see the NCG020000 General Permit for details about which treatment facilities require an
ATC (summarized in Table 1 at the end of this form). For example, an ATC is required for treatment
of mine dewatering discharge from clay nits and non -closed -loop wastewater recycle systems. The
authorization to construct or continue to operate will be issued at the same time as the Certificate of
Coverage (COC) for the NCG02 permit. Design of treatment facilities must comply with requirements
of 15A NCAC 2H .0138 & .0139.

supplied in the application with conditions added as necessary to insure compliance with The
Mining Act of 1971. This permit expires on Ju_uly �22014. G.S. 74-65 states that the issuance
of a mining permit does not supersede or otherwlseAWect or prevent the enforcement of any
zoning regulation or ordinance duly adopted by an incorporated city or county or by any
agency or department of the State of North Carolina.
As a reminder, your permitted acreage at this site is 7.73 acres and the amount of land

online the best management practices that will be used at the Haynes Nit in Columbus County.
Stilling Basin 150'X 40' bottom dimension with 1 1/2 to.1 side slopes for a height of 5 feet
Stilling basin will have 1 foot free board
Basin total volume at 4 foot 32,016 cubic feet
"Total surface area at 4 foot 8,424 square feet
Total pit excavation 5.53 acres
Maximum pump rate for pit per day 2" pump rated at 11,000 gph maximum rate per day 100,000 gallons

Establish a good stand of dense vegetation within the structure
If turbidity level are not reached with rock outlet replace with a vertical riser pipe (with no perforations)
That terminates 0.5 feet below the 4 foot water level. The riser must be at 12 inches.
Pump only from the surface waters of the rim ditch.
Bmp for borrow pit construction
Dig rim ditch 10 to 25 feet in width along the perimeter of pit site, ditch to be dug 5 foot below pit
excavation, and graded to the stilling basin location. Do not pump any waste water during the
construction of rim ditch; only begin pumping after turbidity levels are below 50 NTUs.
Borrow Pit Dewatering Sampling Requirements
Measure turbidity at sampling locations
-30 minutes after startup
- at a minimum one additional time per day
Preventive Maintenance
No equipment is to be service or repair at pit site. Equipment utilized during mining activity on a site
must be' operated and maintained in such a manner as to prevent potential or actual pollutio❑ of surface
waters.
Follow all guidelines as stated in the GENERAL PERMIT NO. NCG020000
