The discharge is of good quality, they have a decent system there as long as they are not dewatering while digging. They obliterated the wetland, it's gone so I don't know why they bothered to put it on the map. Jo said the wetland was small enough they could have gotten a permit to wipe it out anyway. Hope you are well. We've received an NOI from Sparrow Hawk Sand Pit. for their mine in Carteret County for coverage of their sand mine under NCG02 (mining SW permit). The site discharges stormwater into a UT to the Newport River (C). The NOI is attached. It looks like you have already given t9em an NOV for mine dewatering without a permit and possible wetland impacts. They did submit this by 6J17Jo9. I am sorry this has taken so long to get to you. I received it just before I left on vacation in July, but I don't' know if you know but my husband and I have been really sick. I've been at work for basically two weeks since then. Anyway, it appears that there are be wetlands near the site - the NOV states that they have impacted an isolated wetland. They state that they had this wetland delineated by the US Army Corps and that they stated it was isolated. They state the size is o.16 Acres. They are dewatering. Their plans are not stamped by a PE. I am also sending you the plans and the NO] through the mail. I've sent them a letter stating that they will need to submit an O&M plan to you - & they need to check whether they will need a state stormwater permit for their additional project area they added in 2-oo8. Does the Wilmington Regional Office have any concerns about issuing this facility a COC for this general permit? If we don't receive any objections, we'll issue the COC in 3o days. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the US Environmental Protection Agency dated October 15, 2007 (or as subsequently amended). Please take notice that this certificate of coverage is not transferable except after notice to the Division of Water Quality. The Division of Water Quality may require modification or revocation and reissuance of the certificate of coverage. Please be aware that mine dewatering at your site has the potential to impact adjacent wetlands. The specific requirements for mine dewatering at facilities ncar wetlands can be found in Section C, Part 1 of your permit (Part III Page 5 of 9). You must have an approved , Operation and Monitoring Plan before mine dewatering discharges occur at your facility. Discharging mine dewatering wastewater without Plan approval will be subject to enforcement action. An Operation and Monitoring Plan for your facility must be submitted to the Wilmington Regional Office within 60 days of your receipt of this permit. Please note that mine dewatering wastewater includes wet pit overflows caused solely by direct rainfall and groundwater seepage for this type of mining operation. Any discharge'of this water (and any stormwater commingled with it) is subject to the effluent limitations in this permit. The application included a copy of an associated application for a mining permit submitted to the Division of Land Resources (DLR). Please be aware that the issuance of an NPDES permit is contingent upon the issuance of an associated mining permit from DLR. Our office will process your stormwater permit application once a DLR mining permit has been issued for your project. Please also be aware that if your project is located near wetlands, your NPDES permit will require dewatering operations without wetland impacts. The specific requirements for mine dewatering at facilities near wetlands can be found in the text of the general NPDES mining permit number NCG020000 available on our website, http:Hh2o.enr.state.nc.us/su/Forms_Documents.htm. See Section C, Part 1 of the permit on the page labeled, "Part III Page 5 of 9". An approved Operation and Monitoring Plan is required for NPDES-permitted mining facilities. This area is within the permitted acreage, but was excluded from the Mining Area in the original mine plan. Part of this area (0.16 acres) has been classified as an isolated wetland, and the remainder of the acreage was a buffer. The wetland area was classified by the US Army Corps of Engineers as isolated and not connected to Waters of the US, and therefore not under their jurisdiction. The property owner made application with the NCDENR, Division of Water Quality for permission to excavate this area under Isolated General Wetland Permit (IWGP) #100000.
