Dear Mr. Miller: WETLANDS GROUP I; WATER UALITY SECTION SAM HUNT SECRETARY Please review the attached plans for grade, drain, base, and pave of SR 1150 (Oresent Dr.) in Ashe county. This work may impact the waters of unnamed tributaries to Beaver Creek, a DEHNR Class C trout water. These plans have been reviewed and approved by our Division Roadside Environmental Engineer, with copies to the area Roadside Environmental Engineer. Plans have been sent to the North Carolina Wildlife Resources Commission and the U. S. Army Corps. of Engineers for their review and approval. (Copies of letters attached). Said road now exists inside the 25 ft. buffer zone of unnamed stream. The new center line has been surveyed, and moved away from the creek an much as reasonably possible to avoid and minimize impact to the stream. To protect the existing slope and minimize future erosion, we propose to utilize class II Rip Rap at a thickness of 18 in. with fabric liner along the creek banks for slope protection. We ask that you review these plane, offer which might aid us in accomplishing this to the streams, and grant us the written proceed with this project. The North Carolina Department of Transportation (NCDVT) is requesting a letter of concurrence from the North Carolina Wildlife Resources Commission (NCWRC) to obtain a 404 permit from the U.S. Army Corps of Engineers. I have reviewed the subject permit application an I am familiar with habitat values of the project area. These comments are provided in accordance with provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et. seq.) and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-6674). The NCDOT is proposing to replace 1 cross line drainage structure along SR 1150, Ashe County. This project will impact a small unnamed tributary to Beaver Creek which is Designated Public Mountain Trout Water. Based on the information provided by the applicant and our information on the range of trout in the project area, we do not believe this project will cause signi.f.i.cant effects to trout craters. District Engineer Post Office Box 250 W S GROUP North Wilkesboro, North Carolina 28659 W WATERQ AL ITY SECTION l1AL Dear Mr. Bennett: Reference is made to your letter of March 24, 1993, regarding your plans to discharge dredged/fill material into the waters/wetlands of an unnamed tributary of Beaver Creek, associated with the replacement an existing pipe culvert with the paving upgrade of S.R. 1150 (Cresent Drive Road), West Jefferson, Ashe County, North Carolina. Reference is also made to Mr. Joe Mickey's letter of March 30, 1993, in which the North Carolina Wildlife Resources Commission expressed no objections to the planned road improvements provided that: a. No heavy equipment is operated in the live streams in order to minimize sedimentation and prevent introduction of other pollutants. b. Erosion control measures should be implemented where soil is disturbed and maintained until project completion. For the purposes of the U.S. Army Corps of Engineers' Regulatory Program, Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the Federal Register on November 22, 1991, lists nationwide permits. Authorization, pursuant to Section 10 of the Rivers and Harbors Act of 1899 and Section 404 of the Clean Water Act, was provided for the repair, rehabilitation, or replacement of any previously authorized, currently serviceable structure or fill; or of any currently serviceable structure or fill constructed prior to the requirement for authorization, provided that the structure or fill is not to be put to uses differing from those uses specified or contemplated for it in the original permit or the most recently authorized modification. Special conditions of this permit state that before discharging dredged or fill material into waters of the United States occurring within the 25 mountain counties of North Carolina that contain trout waters, the applicant will obtain a letter of approval from the North Carolina Wildlife Resource Commission. Review of the information you have provided, and the comments submitted by the North Carolina Wildlife Resources Commission, reveals that -2- your proposed work of the replacement of an existing culvert for the purpose of upgrading to meet current safety standards, is authorized by nationwide permit provided it is accomplished in strict accordance with the enclosed conditions and the recommendations set forth by the Wildlife Resources Commission. This nationwide permit does not relieve you of the responsibility to obtain any required State or local approval. This verification will be valid for 2 years from the date of this letter unless the nationwide authorization is modified, reissued, or revoked. Also, this verification will remain valid for the 2 years if, during that period, the nationwide permit authorization is reissued without modification or the activity complies with any subsequent modification of the nationwide permit authorization. If during the 2 years, the nationwide permit authorization expires or is suspended or revoked, or is modified, such that the activity would no longer comply with the terms and conditions of the nationwide permit, activities which have commenced (i.e., are under construction) or are under contract to commence in reliance upon the nationwide permit will remain authorized provided the activity is completed within 12 months of the date of the nationwide permit's expiration, modification or revocation, unless discretionary authority has been exercised on a case-by-case basis to modify, suspend, or revoke the authorization.
