Sullins, Director Division of Water Quality Subject: General Permit No. NCG 020000 Ludlum Sand Mine COG NCG020697 Brunswick County Dear Mr. Ludlum: In accordance with your application for a discharge permit received on December 6, 2006, we are forwarding herewith the subject certificate of coverage to discharge under the subject state —NPDES general permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143- 215.1 and the Memorandum of Agreement between North Carolina and the US Environmental Protection Agency dated May 9, 1994 (or as subsequently amended). Please take notice that this certificate of coverage is not transferable except after notice to the Division of Water Quality. The Division of Water Quality may require modification or revocation and reissuance of the certificate of coverage. Please be aware that mine dewatering at your site has the potential to impact adjacent wetlands. The specific requirements for mine dewatering at facilities near wetlands can be found in Section C, Part 1 of your permit (Part III Page 5 of 9). You must have an approved Operation and Monitoring Plan before mine dewatering discharges occur at your.facility. Discharging mine dewatering wastewater without Plan approval will be subject to enforcement action. An Operation and Monitoring Plan for your facility must be submitted to the Wilmington Regional Office within 60 days of your receipt of this permit certificate of coverage. Please submit this package to the attention of Linda Willis. Your Operation and Maintenance Plan must show that your facility is able to comply with State regulations. It should include the following actions: • Delineate wetland boundaries (including flagging). • Place monitoring wells within the wetland boundary adjacent to the mine site and monitor monthly. Make monitoring records available for review by the Division upon request. • Discontinue mine dewatering immediately if treated wastewater flowing over the level spreader causes channelization. Mine dewatering will not resume until the level spreader design is evaluated and corrective measures are put in place to ensure the discharge will leave the site by sheet flow. Vegetative cover must be re-established before dewatering resumes. Mine Dewatering can only resume when authorized by the Division of Water Quality. • Allow no point source discharge from the mine for any treated wastewater. Stormwater should be directed into the pit and should be unable to leave the site as a point source discharge. • No unauthorized impacts to wetlands will occur. Mine dewatering will cease if immediate and effective measures are unsuccessful at resolving the impacts. Dewatering can only resume when authorized by the Division of Water Quality. This site will discharge to a receiving stream designated as High Quality Waters (HQW) and a Primary Nursery Area (PNA). As a result, a more stringent TSS limit and wastewater discharge volume applies. A supplement sheet is attached outlining the effluent limitations that apply to this discharge and are based on the requirements in the North Carolina Administrative Code Section 15A NCAC 213 .0224. Please note that mine dewatering wastewater includes wet pit overflows caused solely by direct rainfall and groundwater seepage for this type of mining operation. Any discharge of this water (and any stormwater commingled with it) is subject to the effluent limitations in this permit. This general permit allows the discharge of stormwater and certain types of wastewater from your facility. In your application, you specified that only mine dewatering water would be discharged from this facility. If separate point -source discharges of stormwater occur (i.e., stormwater not combined with mine dewatering water), you will be required to adhere to the conditions in this permit for stormwater discharges. This permit does not affect the legal requirements to obtain other permits which may be required by the Division of Water Quality or permits required by the Division of Land Resources, Coastal Area Management Act or any other federal or local governmental permit that may be required. You had said that the best way to determine this is through local knowledge because there is not a GIS layer or other data set available. Over the past few months we have tried to get a handle on this situation. We believe that Ox Pen Branch is likely to be tidally influenced, but not the unnamed tributary of interest (see the attached map titled "2007 04 18 Map for USGS"). The unnamed tributary is not shown on the USGS map, which likely complicates this situation. However, we have been to the site and know that there is a tributary there. I'd say assume the receiving stream is not a tidal stream. That creek their discharge goes to likely feeds to a tidal creek, but I don't think the small tributary this discharges to is tidal. Without a 7Q 10 flow we can't issue our current PNA supplement_ 1 suppose our other options are to 1.) Estimate a flow (which 1 wouldn't know where to begin to do), 2.) To issue the permit with some sort of increased threatening language about PNA waters but without a supplement, or 3.) To issue the permit with the supplement but delete the line about the 7Q10 flow on the supplement page (and also delete reference to it in the cover letter). I can't think of a way to set a volumetric limit on the effluent without a flow rate to work with. Unfortunately, I think that I support option #3 (see drafts attached). I am not sure how much more we can do with this one, He applied in December, so at some point l will need to issue this. I think we are nearing that point. What are your thoughts on this path? I guess the last remaining issue is that this is PNA waters, and the receiving stream, Ox Pen, is tidally influenced so we don't know the 7Q10 flow that we normally use in the PNA supplement. Curtis Weaver (USGS) was really uneasy about giving us a value (even an estimate) for that flow, and said that we would have to rely on local knowledge. Any thoughts on what we can use instead? In a nutshell, the ditch that we saw the ponds discharging to were old and therefore grandfathered (so to speak) so that it is not what we would consider an illegal discharge. Although their mining permit indicated it was a non discharging mine, the fact that the water eventually finds it's way to the ditch is not an issue we can press. That is my understanding from the visit we made. I guess the site, other than being a mess from previous mining activities that were probably never permitted, we cannot hold the current permittee responsible for the fact that what is out -there discharges. I asked Danny if I should have recommended they fill the ditch that goes to the creek to prevent the discharge and lie said no, we shouldn't make that recommendation. Which I already had, so when speaking with Mr. Ludlum, I indicated that he need not stop the ditch from discharging. All we can push is discharge monitoring records and push them to start monitoring according to the permit. We can likely send an NOV for their not monitoring. With respect to current mining efforts, it would be very difficult to demonstrate new wetland impacts and distinguish them from old land disturbances..... In this instance, Danny's thought was that the best approach is to: 1) make sure the site properly secures a mining permit NCG020000., 2) try to require the wetland boundaries to be identified in the mining permit, and 3) follow up with an inspection to ensure that they are compliant with permit conditions. Julie Dorr is the inspector, she said they were on the right track now and making big improvements, I believe they will be issuing a mining permit soon (by the sounds of it). We need to require they send in an 0 & M plan before we issue the NPDES permit. I want to be sure their dewatering activities are looked at closely given the circumstances surrounding this site.
