are forwarding herewith the subject certificate -of coverage to discharge under the subject state —
NPDES general permit. This permit is issued pursuant to the requirements of North Carolina
General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the
US Environmental Protection Agency dated May 9, 1994 (or as subsequently amended):
Please take notice that this certificate of coverage -is not transferable except.after notice to
the Division of Water Quality. The Division of Water Quality may require modification or
revocation and reissuance of the certificate of coverage.
This permit does not affect the legal requirements to obtain other permits which may be
required by the Division of Water Quality or permits required by the Division of Land
Resources, Coastal Area Management Act or any other federal or local governmental permit that
may be required.. -

without your concurrence, so please return this form at your earliest convenience.

This agency has reviewed the draft permit and determined that the proposed discharge will not
be sufficiently close to any existing or known proposed public water supply intake so as to
create an adverse effect on water quality.. We concur with the issuance of this permit,
provided the facility is operated and maintained properly, the stated effluent limits are met
prior to discharge, and the discharge does not contravene the designated water quality
standards.

facility is located in Alexander County, handled by the Mooresville Regional Office.

I can't find any reason why we shouldn't move forward with issuance of the SW permit
so feel free to issue the permit at your convenience.

Hiddenite (Alexander County) for coverage of their gemstone mine under NCG02
(Mining SW/WW permit). The site discharges stormwater and mine dewatering water
into Wallace Creek and the South Yadkin River (both WS-II, HOW) through three
settling basins. The NOI is attached.
Their Mining Permit (02-06) from DLR was revised 10/26/05, and it looks like you
guys already notified them that this site needed an NPDES stormwater permit as well
(a copy of the MRC letter was attached).
Does the Mooresville Regional Office have any concerns about issuing this facility
a COC for this general permit, and are there any potential impacts to wetlands? If
we don't receive any objections, we'll issue the COC in 30 days, pending DEH
approval.
