Resources (DEMLR) is forwarding herewith the reissued Certificate of Coverage and
Stormwater/Wastewater General Permit. This permit is reissued pursuant to the requirements of North
Carolina General Statute 143-215.1 and the Memorandum of Agreement between the state of North
Carolina and the U.S. Environmental Protection Agency, dated October 15, 2007 (or as subsequently
amended.) The following information is included with your permit package:

Significant changes to the General Permit are outlined in the Technical Bulletin.
Your coverage under the General Permit is transferable only through the specific action of DEMLR. This
permit does not affect the legal requirements to obtain other permits which may be required by the N.C.
Department of Environmental Quality, nor does it relieve the permittee from responsibility for
compliance with any other applicable federal, state, or local law, rule, standard, ordinance, order,
judgment or decree.

This letter is in response to your request for additional information. The information is necessary to complete
the DWQ's review of the O&M Plan, for the 421 Sand Mine. Below you will find the requests outlined in
your email letter, dated 16 March 2012, followed by SEGi's response:
1. You need to let us know date certain as to when the third well will go in and ensure it is constructed
in accordance with the requirements for shallow monitoring wells (talk to Aquifer Protection for the
regulations that apply) ask for Morella King, 910-796-7218. You will need to provide us
information demonstrating that they were constructed accordingly (as soon as you have that
information).
The well was installed on 23 February and per the diagram attached.
2. Be sure the settling basins are not proposed for construction in the undisturbed buffer. It's been a
few years since I've been to this site, so if they are already constructed in the buffer, they need to be
removed from the buffer in order to comply with the buffer requirements. And regarding the sizing
of the settling ponds, forward the calculations to us that demonstrate the settling basins are designed
properly for type 1 settling for the highest pump rate anticipated and to meet the limitations for TSS
and settleable solids. Also, ensure the settling basins are shown to scale on the mine map. We need
to know the pump rates (worst case) identified in the O & M text.
The site plan has been revised to reflect the settling basins have been removed from the plan and the
O&M Plan has been updated to reflect the method by which dewatering will take place (see
Attachments 2 and 3 respectively).
3. Provide us an updated map with both Ashley's requests and ours incorporated.
The revisions are reflected on the attached map (see Attachment 2).

Minine Operations
During the mining of Pit l (Phase 1), the excess water will be pumped via an 8" floating pump (2200 gal/min.)
into Pit 2. Upon completing the excavation of Pit 1, the commencement of mining activities in Pit 2 (Phase II)
will begin. The water from Pit 2 will be pumped back into Pit 1. Upon completion of Pit 2, Pit 3 excavation
will begin (Phase III). Excess water from Pit 3 will be pumped into Pit 2. When mining activities have been
completed, all three pits will be turned into ponds, as per the reclamation plan in the State Mining Permit
Application.
Pumoine Freauenc
The mined pits will be pumped as needed, to keep the pits dry for mining. A pump log will be maintained and
these records will be used to determine the Total Flow per the monitoring requirements in Table 1. If there is a
negative effect found on the hydrology in the area, the pumping frequency will be modified accordingly.
Hydrology Monitoring
There will be 3 monitoring wells installed around the proposed mine area to monitor the effects on the
hydrology in adjacent wetlands. There will be one installed along the southeast side, southwest side, and
northwest side, where the undisturbed buffer abuts the wetlands. The wells will be 1 ''/a" in diameter at a depth
of 6' b.g.s. (below ground surface), using standard well screen. The well riser will be approximately 3' - 4'
a.g.s. (above ground surface), so that the wells will be easy to see when sampling. Wells will be installed per
guidelines set forth by the NC DWQ Aquifer Protection Section (see attached diagram).
At the time this O&M plan was being revised, mining was not taking place. Therefore, dewatering was not
take place. The mine operator has agreed to monitor the three wells, in order to compile baseline. Baseline data
monitoring will cease after a period of 6 months. Once mining and dewatering commences again, monitoring
of these wells will be performed quarterly and will continue for the duration of the mining operation.
Maintenance
The settling pond will be checked regularly and sediment will be removed once the device becomes half full.
The pond will be maintained at a minimum depth of 4' below the spillway outlet and a maximum depth of 10'.
The sediment basin and outlet pipe will be monitored accordingly and sediment will be removed as needed.
The spillway will he checked on a regular basis and maintained as needed.
Discharge Monitorinl~
Discharge monitoring and reporting will be performed as specified in Table 1, during times of dewatering. If
the effluent limitations are greater than specified in Table 2, the monitoring frequency will be modified to
monthly monitoring of the effluents.
Monitoring Reports
Discharge monitoring results, in accordance with the terms of the NCG020000 permit shall be submitted no
later than 30 days from the end of the monitoring period. Duplicate signed copies of all reports required shall
be submitted to the NC DENR Division of Water Quality, Water Quality Section, ATTENTION: Central Files,
1617 Mail Service Center, Raleigh, North Carolina 27699-1617.
`The mine operator will report orally any noncompliance within 24 hours after becoming aware of the
noncompliance.

1. Measurement Frequency: Twice per year during a representative storm event, as defined for this permit. Failure to comply with semi-annual
monitoring in accordance with permit terms for any six-month monitoring period immediately triggers monthly monitoring for the remaining permit
term.
2. Grab samples shall be collected within the first 30 minutes of discharge. For sites where multiple outfalls are separated by distances that preclude
collection within 30 minutes of each discharge event is not feasible, begin collection procedures within 30 minutes and continue until all outfalls with
discharges are sampled. Documentation explaining why it was not possible to take samples within the first 30 minutes must be kept in the SPPP.
3. Sample location: Samples shall be collected at each stormwater discharge outfall (SDO) unless representative outfall status (ROS) has been granted
and documented by the Division of Water Quality. A copy of the letter granting ROS shall be kept on site.
4. Turbidity may be monitored at the Stormwater Discharge Outfall. Alternatively, the permitter may choose to monitor turbidity in the receiving water,
directly upstream and downstream of the stormwater discharge outfall(s).
5. I -or each sampled representative storm event the total precipitation must be recorded. An on -site rain gauge or local rain gauge reading must be
recorded.
6, Total flow shall be: (a) measured continuously, or (b) calculated based on the amount of area draining to the outfall, the amount of impervious area,
and the total amount of rainfall, or (c) estimated by the measurement of flow at 20 minute intervals during the rainfall event. Total rainfall precipitation
and duration of the rainfall event refers to the representative storm event sampled.

Thank you for taking the time to speak with me today. With this letter, Southern Environmental Group, Inc.
(SEGi) is providing a response to your request for additional information. The information is necessary to
complete the permit transfer, from Morton Minerals, Inc. to 421 Sand Mine, LLC. Below you will rind the
requests outlined in your letter dated 12 April 2012, followed by SEGi's response:

The first page of the application has been revised to reflect Mr. Sullivan's position with 421
Sand Mine, LLC, as Manager. In addition, a new signature page, containing the original
signatures, has been included with this letter (see attached).
2. Application package is missing supporting information. Note: Item VI requiring documentation
of the transfer.
421 Sand Mine, LLC is unable to provide documentation of a transfer of land. The land is
currently owned by 421 Sand Mine' LLC's parent company, Cameron Management, Morton
Mineral's, Inc., the current permit holder, has been leasing the land from Cameron Management,
but has since terminated their lease. Cameron Management would like to continue mining the
property, with 421 Sand Mine, LLC being the operating entity.

In response to your renewal application for continued coverage under general permit NCG020000 the Division of Water
Quality (DWQ) is forwarding herewith the reissued slormwater general permit. Please review the new permit to familiarize
yourself with the changes in the reissued permit. The general permit authorizes discharges of slormwater and some types of
wastewater. You must meet the provisions of the permit for the types of discharges present at your facility. This permit is
reissued pursuant to the requirements of North Carolina General Statute 143-215A and the Memorandum of Agreement
between the state of North Carolina and the U.S. Environmental Protection Agency, dated December 6, 1983.
The following information is included with your permit package:
• A new Certificate of Coverage
• A copy of General Stormwater Permit NCG020000
• A copy of a Technical Bulletin for the general permit
Five copies of Discharge Monitoring Report (DMR) Forms - wastewater and stormwater
• Five copies of Qualitative Monitoring Report Form
Your coverage under this general permit is not transferable except after notice to DWQ. The Division may require modification
or revocation and reissuance of the Certificate of Coverage. This permit does not affect the legal requirements to obtain other
permits which may be required by DENR or relieve the permittee from responsibility for compliance with any other applicable
federal, state, or local law, rule, standard, ordinance, order, judgment, or decree.

In accordance with your application for discharge permit received on October 29, 2001, we are forwarding
herewith the subject certificate of coverage to discharge under the subject state - NPDES general permit. This permit is
issued pursuant to the requirements of North Carolina General Statute 143-215 .I and the Memorandum of Agreement
between North Carolina and the US Environmental Protection agency dated December 6, 1983..
Due to Fecal Coliform concerns from Shellfish Sanitation Recreational Water Quality Section, Fecal Coiiform
shall be monitored quarterly, grab at the effluent in addition to the monitoring requirements for mine dewatering in
Section C, table 6.
If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you,
you have the right to request an individual permit by submitting an individual permit application. Unless such demand is
made, this certificate of coverage shall be final and binding.
Please take notice that this certificate of coverage is not transferable except after notice to the Division of Water
Quality. The Division of Water Quality may require modification or revocation and I'CisSUaneC of the certificate of
coverage.
This permit does not affect the legal requirements to obtain other pernuts which may be required by the Division
of Water Quality or permits required by the Division of Land Resources, Coastal Area Management Act or any other
Federal or Local governmental permit that may be required -
