Hi Brian, 7`ddd Just took a call from Ms. Wilmoth concerning recently received billing for her husband's permit to dischargeom the Wilmoth Pit under COC NCG020536. BIMS shows their permit coverage as active. However, Ms W. reports that they sold the mine to Bogue Sound Septic & Grading in 2011. 1 note that Bogue Sound Septic & Grading holds COC NCG020537. Based on reviewing both original COC issuance letters by Mack Wiggins in 2000 in the SPU files, it looks like these two permittees were immediate neighbors. It appears that now Bogue has acquired the adjacent sand pit from the Wilmoths. Conclusion: we have two active COCs for what is now a single contiguous operation under one owner. NCG020536 and NCG020537. She does not recall that either party sent in a N(0 Change: it appears that neither party requested that we rescind the COC NCG020536. I have advised Ms. W to write on explanation across the face of the billing, including a reference to my phone call with her, and to request that we rescind the permit, and to return the billing unpaid. There was an issue last year with a random renewal for 020536 that Jen and Linda Willis discussed, but from the sion. correspondence in the SPU file it doesn't look like it is relevant to th oon-to s-be-requested rescis3�g.2o/3 name. e� I've copied Bradley based on the my suspicion (from commentary in BIMS) that this site may have had some previous BIMS/administrative adjustments earlier, and I don't want to miss some prior condition that would impact the course of action I'm suggesting. The first pit, NCG020536, was owned by Stuart Wilmoth but was sold to Bogue Sound Septic and Grading in 2011. Bogue Sound owned the adjacent pit which they called the Howard Pit. It's stormwater permit is NCG020537. Bogue Sound sent a request in April of 2012 for a name/ownership change. For an unknown reason, this request was never processed and Mr. Wilmoth kept receiving the bill but didn't pay. He later sent us a note telling us he didn't own it. Since the mining folks at DEMLR kept the two facilities under two different permits (Wilmoth pit 67-32 and the Howard Pit 67-58) and because of the owner's wishes, we decided to keep the stormwater permit separate for -the two pits. Also, since Bogue Sound had requested the ownership for the Wilmoth pit to change but continue to be permitted, we didn't ask Bogue Sound if they wanted to combine stormwater permits. They might do that in the future but we are not doing that on our own. I've updated Bims with this information for both stormwater permits for our future records. It was a random renewal and I renewed it, and I didn't put wastewater in one section — on the top I put sw, mine dewatering and process ww, but not on the bottom. ALL previous permits had that a ww discharges. This was a mistake. It was never really for stormwater only. Unless you have some documentation of this that we don't have, this has always been for wastewater + stormwater. I do agree with you on the 0&M. I will put that in the renewal letter. I will also add information from the rules regarding the 7Q10 flow. We were trying to keep from allowing wastewater discharges to SA waters because of the potential for fecal coliform bacteria. Since Fecal is a pollutant of concern, and one that can close shellfish waters, we have attempted to avoid any discharge from mine pits to SA waters. . not only that, they can't discharge settleable solids to SA waters. They had an alternative to discharge (or so we thought) and that was the discharge to the private pond. The permittee was ok with that and so were we which is why it was for stormwater only. But.. I believe that pond has at, outlet anyway. What we do need i,; an 0 & M that requires the perwittee to put ;n m( nitoring well,; in the 404 wetlands a id require them to discharge snme of the pit water to the wetlands south of the pit area. If I can get d,ig out from under my work load (Cage Fear River renewals), I'll contact :he permittee and try to work with them on an 0 & M. But you should mention the 0 & M requirement in your correspondence. I won't make any excuses - I am sorry about that. I'll fix that. 2) Linda and I looked at it and talked about it. We believe it is discharging to an SA, HQW water (either a UT to Queens creek or most probably to Pasture Branch). WW limit is 50% of 7Q10 there. It may or may not be tidal there. 3) They are planning on discharging 1.44 mgd. That's 120,000 gal/hour for a 12 hour day. That seems like a lot. They are going to need to show they are not over 50% of the 7Q10 for that stream. So I looked throught he printout — I couldn't make heads or tails of the organization of it. I'll need some help with that. Also I looked at the USGS stream map thing - http;i/streamstatsags.cr usgs.gov/gages/viewer14.htm?stabbr=GAGES but there is no gauge near it.
