Thomas Farm Pond and the Thomas Simpson Mine are both located on North River, a relatively small estuary and prime shellfishing area. Fused on the information provided, this office has strong concerns regarding the bacteriological constituents of the dewatering discharges. Fecal coliform contamination, as it relates to stormwater runoff, is the primary cause of shellfish closures. This parameter is currently not being monitored in the general permit requirements for the above mentioned facilities. The Shellfish Sanitation Section requests that the permits for these facilities include monitorin for bacterialo ical contaminants specifically fecal coliform because the discharge associated with these mines could jeopardize the open status of adjacent shellfishing waters. The site is an agricultural field which is surrounded by wooded wetlands. The ditch that completely surrounds the site appears to be tidally influenced and contains salt marsh vegetation. The site is probably a wetland or converted wetland. Staff members have requested a determination of jurisdiction by the Division of Coastal Management. There is a concern that pit dewatering associated with mining activities on the site could result in the draining of the adjacent wooded wetlands. It is understood that if it is determined that the site is a wetland with DCM jurisdiction, staff members may recommend against the issuance of a mining permit. it is recommended that General Permit coverage not be given until it is determined if a mining permit can be issued.
