Reference your March 8, 1993 application for Department of the Army
authorization to grade, base, pave, and drain 0.96 mile of S.R. 1356 along the
John's River near Collettsville, in-, Caldwell County, North Carolina. As part
of the project, three culverts will be replaced and extended. No wetlands
will be impacted by the work. This project has been coordinated with the
N.C. Wildlife Resources Commission (WRC).
On January 1, 1992, we renewed general permit no. 198200031, (copy
enclosed), that authorizes the placement of fill material associated with the
construction, repair, or replacement of bridges across navigable waters and
waters of the United States in North Carolina, including cofferdams,
abutments, foundation seals, piers, temporary construction and access fills,
approach fills, detour fills, and box culvert installation, as part of work
conducted by or in full compliance with the standards and specifications of
the North Carolina Department of Transportation (NCDOT).
Your proposed work is authorized provided it is accomplished in strict
accordance with the enclosed conditions and those conditions outlined in the
enclosed March 26, 1993 WRC letter. Please read the enclosed permit to
prevent an unintentional violation of Federal law. As this Department of the
Army general permit does not relieve you of the responsibility to obtain any
other required approvals, you should contact appropriate State and local
agencies before beginning work.

SUBJECT: A review of an application by NCDOT to grade, drain,
base, and pave 0.96 mile of SR 1356 (Old Johns River
Road) along Johns River, Caldwell County
Dear Mr. Chapin:
The North Carolina Department of Transportation (NCDOT) is
requesting a letter of concurrence from the North Carolina
Wildlife Resources Commission (NCWRC) to obtain a 404 permit from
the U.S. Army Corps of Engineers. The NCWRC has reviewed
information provided by the applicant, and field biologists on
our staff are familiar with habitat values of the project area.
In addition, site visits were conducted on July 28, 1992 and
March 19 & 26, 1993. These comments are provided in accordance
with provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et.
seq.) and the Fish and Wildlife Coordination Act (48 Stat. 401,
as amended; 16 U.S.C. 661-667d).
The stream contains good to excellent habitat for aquatic
organisms, including trout, and carries a light silt load. No
wetlands were observed. However, the presence of the brook
floater (Alasmidonta varicosa), a state threatened mussel, Santee
chub (Cyprinella zanema), a rare fish species, and rainbow trout
in the project vicinity require that special attention be given
to environmental protection in design and implementation of this
project..
The NCWRC does not object to this project, provided the
following stipulations are implemented:
1. Construction in the stream or within the 25-foot buffer
zone is prohibited during the trout spawning period of
January 1 to April 1 in order to protect egg and fry
stages from sedimentation.

2. Heavy equipment should not be operated in the stream
channel in order to minimize sedimentation and reduce
the likelihood of introducing other pollutants into the
stream.
3. Replacement culverts should be placed at the same slope
as the stream bottom and should be buried 1 foot unless
bedrock is encountered.
4. A riprap check dam must be installed downstream within
50 feet of the three culvert replacements crossing live
tributaries at 38+25, 34+75, and 19+00 to trap sediment
from the project. The check dam must be dipped out
when 50% full in order to retain its usefulness.
Within 15 days of project completion, the check dam
must be dipped out again and the riprap completely
removed to an area away from the stream. These actions
will reduce sedimentation to downstream portions of the
stream and eliminate impediments to fish movement.
5. Riprap placed for bank stabilization should not be
placed below normal high water elevation so as to
maintain natural substrate in the stream. Also, riprap
should be kept to a minimum so as to retain riparian
vegetation, which we prefer for bank stabilization
where practical.
6. Erosion controls should be installed where soil is
disturbed and maintained until project completion.
7. Waste earthen material from the project must not be
placed in any stream or wetland or within the 25-foot
buffer zone of any stream classified as "Trout" by the
N.C. Division of Environmental Management.
8. Temporary ground cover (e.g. hardwood mulch, straw,
etc.) should be placed on all bare soil during
construction. Permanent vegetation in these same areas
should be established within 15 days of completion of
ground disturbing activities to provide long term
erosion control.
9. Vegetation (especially trees) within the 25-foot stream
buffer zone damaged during construction must be
replanted within 15 days of project completion with the
same mixture of species existing prior to project
initiation.
10. A 25-foot buffer zone should be established between the
road and the river between stations 21+50 to 27+00,
37+00 to 38+00, and 40+00 to 43+80 where riparian
vegetation and a buffer zone are absent. In these
areas native species of riparian trees should be
planted utilizing river birch, sycamore, and dogwood.
The planting intervals for riparian trees are 8 x 8
feet to provide roots for river bank stability. In the
event of problems with right of way in these areas
other measures should be taken to provide for a buffer
zone such as reducing the cross sectional area.

Dear Mr. Chapin:
The Department of Transportation is scheduled to grade,
drain, base, and pave primarily along the existing roadway of
a 0.96 mile section of SR 1356 Old John's River Road in
Caldwell County during the 1992 - 1993 Fiscal Year. As part
of this project, several pipes with streams will be replaced
in the same location. Therefore, we are requesting a 404
Nationwide Permit for this project.
I am sending a joint application form, a roadway typical
section, a straight line sketch with the proposed erosion
control, notes on pipe installation, general notes on erosion
control, some erosion control standards, and a marked map.
By copy of this letter, I am requesting Mr. Chris
Goudreau, N.C. Wildlife Resources Commission District
Fisheries Biologist to comment directly to you concerning the
404 Nationwide Permit request.
Also, by copy of this letter, I am requesting
authorization to proceed under Section 401 of the Clean Water
Act from the Division of Environmental Management.

PIPE INSTALLATION
1. Install erosion control devices. In streams, where
necessary, rock silt screens will be used.
2. Remove material and existing pipe while limiting, as much
as possible, material and sediment from entering a stream
and/or escaping from project.
3. Prepare pipe foundation while again taking care to limit,
as much as possible, material and sediment from entering
a stream and/or escaping from project. Where possible,
new grade will be below existing stream bed. If needed,
bedding material will be clean stone.
4. Place the new pipe and compact backfill.
5. Install slope protection on outlet and inlet ends of
pipe. Also complete installation of erosion control
measures and perform maintenance as needed on existing
measures.
6. Establish permanent vegetation as soon as possible.
GENERAL NOTES ON EROSION CONTROL
Silt Basin Type B's will be constructed to the dimension of
six feet by three feet by three feet unless otherwise noted
on the plans.
Where slope protection treatment is required, Section 868 and
Section 1042 of the 1990 Standard Specifications for Roads
and Structures will be followed. Any material obtained from
the project must be clean before being placed.
Generally, the order of installation of the erosion control
measures will be as follows:
Temporary Silt Basins shall be installed before
clearing and grubbing begins.
Silt Fences and Temporary Silt Ditches shall be
installed after clearing and before grading.
Temporary Stone Ditch Checks shall be installed as
soon as ditchline is established.
Pipe Outlet and Inlet Protection will be done as
soon as the pipe is installed.
Seeding and other permanent erosion control
measures are to be implemented as soon as
practical.

PIPE OuTix.-r ENERGY DISIPATOR.

A pipe outlet energy disipator shall be used at pipe outlets to slow the water velocities when it
exits the pipe and flows out ditched or natural waterways. It is an apron of stone of a sufficient
thickness to protect the outlet area from scouring out and causing off-site sedimentation darn-
age. Pipe outlet energy disipators should be built according to the guideline chart shown on
page 52 of this manual.
AREAS Or USE:
• Outlets of pipes and culverts to prevent from scouring.
DESIGN CRITERIA:
In accordance with chart on page 52.
• Filter fabric, or six inch layer of gravel, shall be used under stone.
MATERIALS:
• Filter Fabric shall meet requirements of section 1056 of Standard Specifications for
