After reviewing the letter and talking with the Asheville Regional Office, we don't have a definitive understanding of what discharge points the request is referencing. For example, Pine Mountain names discharge points "pm-pst-3, pmt-st 10, port-12, west pit, intersect, shop, or warehouse." The Asheville Office is not certain which outfalls these are, or that this nomenclature matches the outfall nomenclature used previously or for reporting sampling results. Could you please provide clarification about which outfalls this letter means? Or arrange to meet with the ARO staff to go over site plans and clear up the confusion? If you prefer, you may contact Shawna Riddle at ARO directly to arrange this. We are confident we can make an accommodation for continuous flow monitoring for outfalls where appropriate at these operations. We just want to be sure to that we can reference the affected outfalls correctly in our final documentation and response. The request asserted that wastewater discharge points chalk-002, chalk-003, and chalk- 004 at this operation do not have continuous flow. Consequently, The Quartz Corp is asking NC DEMLR to remove the continuous flow monitoring requirements at these discharge points. The DEMLR Stormwater Program hereby approves the modification request to allow an instantaneous grab sample of flow or alternative estimate of a daily flow rate (for example, using rainfall amount, percent impervious area, and/or runoff coefficient to calculate a daily flow rate in cfs from a precipitation event) in lieu of a continuous flow measurement reading to fulfill the flow monitoring requirement for the specified outfalls. Please maintain this letter for your records for the duration of coverage under this General Permit. If circumstances of the outfalls at this site change in the future, you must notify the Division. In addition, Mr. Hutson's letter -,asked for clarification about why mining wastes are classified as wastewater discharges. Any wastes (e.g., mine tailings) from the mining process that contacts stormwater is considered wastewater. This determination is not U.S. EPA policy but rather is based on the definition of "process wastewater" in federal regulations in 40 CFR 122.2: "any water which, during manufacturing or processing, comes into direct contact with or results from the production or use of any raw material, intermediate product, finished product, byproduct, or waste product." Mr. Hutson's letter expresses concern about EPA's interpretation being based on data from western U.S. mines "where mine face is more likely to be reactive and leach metals." Perhaps the company's concern centers around mine face or mine excavation stormwater drainage instead of "mining wastes." In particular, the question about whether mine excavation area rainfall drainage should always be considered "mine dewatering" (and therefore wastewater) has come up. In response, DEMLR's Stormwater Program developed a guidance document to assist regional staff and NCG02 permittees in determining which discharges at a mine operation are stormwater and which are wastewater (enclosed). This guidance is also available on our website. Note the Division recognizes there is some ambiguity and debate about what qualifies as "mine dewatering" in the federal regulations, and that there may be situations where mine excavation run-off does not clearly fit the definition of mine dewatering in 40 CFR 436, which is specific to the type of mine. The task is not always straightforward because there are different implementation possibilities when considering the definition of "process wastewater" in 40 CFR 122.2, the definition of "stormwater discharge associated with industrial activity" in 40 CFR 122.26 (b)(14), and "mine dewatering" definitions in various sub -parts of 40 CFR 436. DEMLR must apply a determination that is consistent with federal requirements and expects the permittee to sample discharges accordingly. We hope this guidance helps clear up the questions'you have and better understand NC's Stormwater Program's rationale. If you have questions about specific discharge outfalls at your site, please contact the Asheville Regional Office Stormwater Program staff to arrange a site visit. This permit modification does not affect the legal requirements to obtain other permits which may be required by the Division of Energy, Mineral, and Land Resources, or permits required by the Division of Water Resources (DWR), Coastal Area Management Act, or any other federal or local governmental permit that may be required. As to the discharge points in these permits where there is no continuous flow, we ask that these permits be modified to remove continuous flow monitoring requirements at these discharge points. With regard to permit NCG020818 for the Altapass operation, changes to the discharge points have been made to eliminate the discharges for almost all measurable storm events. (Photographs of the changes are enclosed.) Indeed, no discharge has been observed this year. Quartz will continue to maintain the sediment basins under this permit and, if a discharge is observed during a measurable storm event, sampling and reporting will be done as required. However, since there is no continuous flow at any discharge point identified in this permit, we would request that continuous flow monitoring be removed from this permit entirely. In addition to these matters, I also discussed with Ken the issue of why mining wastes are being classified as wastewater discharges. He indicated that there is a U.S. EPA policy on this issue and that the State has followed that approach for some time. However, it is our understanding that the EPA interpretation was developed based on data from mines in the western U.S. where the mine face is more likely to be reactive and leach metals. In contrast, the mine faces at Quartz's operations have been shown by testing to be neutral and thus not disposed to leach metals. What are key stormwater requirements? NCG020000 requires periodic discharge monitoring and a Stormwater Pollution Prevention Plan (SPPP): • Develop and implement an SPPP, and update it at least annually. • Inspect Stormwater Best Management Practices (BMPs) once every seven (7) calendar days. • Semi-annual analytical monitoring and qualitative (visual) monitoring. • Report stormwater monitoring data once a.year by March 1 st to DEQ Central Office. • Report benchmark exceedances or Tier 2 monitoring to the DEMLR Regional Office within 30 days. • Respond to benchmark exceedances according to Tier response requirements. What are key wastewater requirements? NCG020000 stipulates wastewater treatment facility operational requirements and periodic discharge monitoring: • Notify DEG if facility fails to perform satisfactorily or creates nuisance conditions. • Only DEQ-evaluated flocculants may be used, if administered according to maximum application doses. • Quarterly analytical monitoring for first year, or until four consecutive samples comply with all limits (then semi-annual monitoring allowed). Quarterly monitoring schedule resumes upon any limit violation. • Settleable solids (SS) monitoring applies to discharges to HQW, ORW, SA, SB, PNA, or Tr designated waters. • Total Suspended Solids (TSS) limits specific to industrial sand mines, and to any mine discharging to HQW. • Report wastewater effluent monitoring data once -a year (by March 1 st) to DEG Central Office. • Report effluent limitation violations to the DEMLR Regional Office within 30 days. • Effluent turbidity levels above the water quality standard prompt upstream and downstream monitoring. The permit makes allowances for inactive mines that have sus- pended all industrial activities and that certify to DEMLR that the site has been stabilized. If approved for "dormant status," these operations qualify for re- duced BMP inspections and may be exempted from outfall moni- toring by the Regional Engineer. Do I have to monitor all outfal Is? Yes. However, you may request Representative Outfall Status (ROS). If approved, ROS allows monitoring at fewer outfalls. To request ROS, submit an ROS Re- quest Form to the DEMLR Region- al Office. The form is available on our website (below). Also, the Regional Office may exempt mines with "dormant sta- tus" from analytical and/or quali- tative monitoring. What if I sell my business, or the name changes? You are required to notify DEMLR of those changes in writing, and continuation of permit coverage is subject to the Director's ap- proval. Please submit the Name/ Ownership Change form located on our Program website. What do I do when my permit expires? Permitees are not required to sub- mit an application for renewal un- less directed by the Division. The permittee should continue to abide by this general permit if it expires and renewed coverage has not yet been issued. What is wastewater, and what is stormwater at a mine site? Any water contacting an actively mined area, water used to pro- cess mined materials, and mine dewatering water are all consid- ered "wastewater." For some mines, "mine dewatering also means wet pit overflows, and not just pumped -out water. Any stormwater that commingles with these waters is "wastewater." "Stormwater" includes runoff from areas related to miring, pro- cessing, or raw material storage areas, such as haul roads or pro- cessing plant areas at the mine. Sometimes the answer is not clear because of how broad the defini- tions are. For example, N.C. con- siders runoff'from areas that con- tain overburden only (no mined or processed material), and that does not commihole with wastewater (including runoff from the mine), to be stormwater. If you are unsure about discharges, please contact the DEMLR Re- gional Office for assistance. Does a certified lab need to analyze my,samples? . Monitoring under NPDES permits must be conducted in accord- ance with test procedures ap- proved in federal regulations in 40 CFR § 136. All labs certified by LAST REV. 1018/ 1 S North Carolina perform analysis in accordance with those proce- dures. While N.C. certification re- quirements do not apply to testing stormwater-only discharges, data gathered under an NPDES permit _must stilLconform to federal re- quirements. Using a North Caroli- na certified lab is one way to en- sure compliance. You may, but it is not necessary under NCG02. Some other gen- eral permits require it, however. What if there is no flow for a period between two samples that exceed a benchmark? The sediment basin beside LOI stockpile # 3 appears to have not been maintained and overflowed during a storm event. Please provide an explanation of what happened, what measures were taken at the time of the overflow to stop the release, and what measures will be taken to prevent future releases. Please provide this information to our office within thirty (30) days of receipt of this letter. In addition, you must immediately clean out and maintain your stormwater/wastewater settling basins to make them fully functional. 2. The sediment basin beside LOI stockpile # 3 appears to have overflowed during a storm event. However, the outlet of the sediment basin has previously not been identified as a stormwater outfall and has not been sampled as a stormwater outfall. Pursuant to Part III, Section B, "Stormwater Discharges: Analytical Monitoring Requirements," analytical monitoring is not required for any basin or pond designed to contain the 25-year, 24-hour storm (as defined in Part VII Definitions) without discharging and that can regain capacity to hold such an event within five (5) days' time through means other than discharge to surface waters. Please provide capacity calculations and supporting documentation to demonstrate that this sediment basin meets this provision and is considered a non -discharging stormwater control. This documentation shall include sediment basin dimensions, drainage area, hydrologic and hydraulic calculations to support this definition, and methodology used to empty the pond without discharge. Two copies of this demonstration must be submitted to our office within thirty (30) days of receipt of this letter. 3. A discharge occurred from sediment basin beside LOI stockpile # 3 which caused the turbidity of the receiving water (an unnamed tributary to Brushy Creek) to exceed Water Quality Standards as cited in the Water Quality Regional Operations' April 27, 2015 Notice of Violation and Recommendation for Enforcement issued to the facility. This notice stated that analyses of water samples of the receiving stream showed results of 850 NTUs in the stream immediately below the sediment basin. Pursuant to Permit No. NCG020000 (COC 020257), Part III, Section B, "Stormwater Discharges: Analytical Monitoring Requirements," the permittee must immediately institute Tier 2 response actions, including monthly monitoring for all parameters of all stormwater discharge outfalls to the receiving waters. The permit allows the permittee to monitor turbidity in the effluent or up- and downstream of the discharge points. You -shall report in writing the analytical results from each sample to our office within the monitoring period. A follow-up compliance inspection will be conducted in approximately 30 days to assure the settling basin has been cleaned out and is being maintained; that Tier 2 response has been initiated including monthly sampling of all outfalls; and that the demonstration that ' the outfall of this sediment basin beside LOI stockpile # 3 does not require sampling has been submitted to our office. y Messrs.
