Attached is a copy of the original permit. The original N01 did not have physical location information for the outfalls, just the number. We should verify whether the original NOI was submitted with an error about the receiving waterbody (if it's available -- it may not be in our files but in archives now. It would be helpful if you have a copy of this application paperwork on hand). If this was the case, MM needs to submit a correction/modification request because the NOI information initially submitted to DENR/DEQ was not accurate. If we cannot access the original NOI, we will still need to modify the COC after confirming the waterbody on the COC is not accurate. If you can provide us (1) a coordinate or map of the outfall location and (2) a current mine site plan showing the layout with the outfalls (SW and WW identified), we can confirm the change is necessary and proceed with a modification. I will check the file folder for the original NO1 on Monday. I was reviewing several of our discharge points and came across something a bit odd. Our Onslow Quarry (COC 20255) located at 131 Duffy Field Road in Richlands, NC discharges to Rufus Creek according to CDC. When looking at the stream classification map, Rufus Creek appears to be somewhere else. We just wanted to check to see your interpretation of our discharge points. It looks to be an unnamed tributary that discharges into part of the New River classified as C. which would not require the HQW sampling. We are forwarding our approval to add the additional outfall (002) per the requirements of NCG020000. As your letter states, any monitoring and sampling required by NCG020000 will need to be performed at all outfalls. Please be aware that mine dewatering at your site has.the potential to impact adjacent wetlands. The specific requirements for mine dewatering at facilities near wetlands can be found in Section C, Part 1 of your permit (Part III Page 5 of 9). You must have an approved Operation and Monitoring Plan for mine dewatering discharges at your facility. An Operation and Monitoring Plan for your facility must be submitted to the Wilmington Regional Office by December 18 2009. I didn't see any issues in allowing another discharge, but, I told him we hadn't seen anything formal on what they are proposing and we couldn't give a blind "OV to the additional discharge without something demonstrating they weren't going to impact wetlands (including a delineation id'ing their location) and the settling basin will be designed to ensure the discharge will meet our benchmarks. If we have to approve the new discharge by DLR (do we before they will modify their permit?) we will have to wait to see the plans and specs on their proposal. If we don't, we can expect them to submit such before we add a new discharge in that permit. It does not show wetlands from what I can tell (small scale). It shows the new outfall just outside the floodplain. It also shows the stream. It looks like it is around 300' from the stream. The site looked good. Did we get a map of the area they propose to install settling basin showing the outfall and their proximity to receiving surface waters/wetlands? If not, let's get a copy of that prior to their starting any land disturbing activity in that area. so far that area has not been disturbed. I'd like to see what we have there. If it shows no wetland impacts (via wetland delineation) and they are 50' from any wetlands for this work (if delineation shows wetlands), we can give them an ok for addition of an outfall. They do not have an 0 & M plan for this mine site. They do have monitoring wells and told me Land Resources is getting that data, how do we get our hands on that information? It might be quite meaningful for us.
