As per my original request on December 13, 2002, subsequent requests on March 16, 2004, July 26,
2004 and I'cbruary 16, 2005 (co '� to ant Representative Outfall Status to Unimin Corporation
— Green Mountain Plaint No. (hermit NCG020032 as per Condition No. G of Monitoring & Records
contained in the General Stormwater ermtt, ntr n would like for you to please act upon my requests. The
Asheville Regional Office inspectors, Laurie Moorhead and Starr Silvis, stated in their May 22, 2006
inspection report (copy attached) that they will be Following up with Raleigh to determine the status of the
application. We. have yet to receive any response to date.
In addition, as per the attached inspection report conducted by Laurie Moorhead and Starr Silvis on
May 22, 2006 (Unimin Corporation — Green Mountain Plant 42, Permit NCG020057) Unimin would like to
request rescission of the NCG020057 permit for Green Mountain Plant #2. However, if the SIC Code
requires a general Stormwater permit, the site will qualify for a no exposure exemption as per the Asheville
Regional Office personnel inspection report.
Unimin graciously requests that you approve Representative Outfall Status for Green Mtn. Plant No.
1 and perform a rescission of the general permit for Green Mtn. Plant No. 2. If you have any questions

Dear Permits Unit:
Unimin Corporation would like to request that you grant Representative Outfall
Status as per Condition* No. 6 of Monitoring &' Records contained in the General
Stormv.,ater Permit. Attached please find a copy of a site drawing depicting eight individual
watersheds. Watersheds 1 & 7 drain internally. \Xratershed 4 drains into the mine-dewatering
pond that is analyzed quarterly. Watersheds 2 & 3 are very small in size and the majority of
stormwater shear planes into vegetation buffers. It is very hard to get a sample at these
locations. Watersheds 5, 6 and 8 are all similar in nature, all containing waste areas and all
discharge through either multiple rock check dams or sediment basins. Watersheds 5 and 6
pass through basins that discharge very seldom only in response to a very large storm event.
Please note that the outfalls are all similar watersheds with the same pollutants discharging
from waste areas. All mining areas are internally- draining. Therefore in order to obtain
samples during a representative storm event, Unimin would like to request that stormwater
samples taken at the outfall of Watershed 8 be representative of all other outfalls.
Unimin will continue to analyze samples obtained from the mine-dewatering outfall
quarterly to remain in compliance with the mine dewatering sample requirements. Please
respond to this request for representative outfall status. If you have any questions regarding

The facility has been conducting qualitative and analytical sampling events as required by the permit. The
site map clearly shows the drainage areas for each outfall. The location of the outfall corresponding to the
drainage area should be marked on the map. During the inspection it was difficult for inspectors to
ascertain the outfall location for each drainage area due to abundance of pipes and culverts at Mine Fork
Creek near the entrance. One of the pipes was discharging cloudy water -though it was not raining during
the inspection. The source of this discharge should be determined and documented and if possible treated
to reduce turbidity. Additionally, the runoff from the process building down the road to the southern entrance
did not appear to be captured by the map or the narrative description of the outfalls. All outfalls must be
monitored unless a respresentative status has been applied for and received.
Mr, Snyderman's assistance during the inspection was extremely helpful and appreciated. He indicated that
the facility has applied for representative outfall status over one year ago. We are following up with Raleigh
to determine the status of the application.
Inspectors noticed that there was extensive erosion on the road leading from the southern entrance to the
mine dewatering area. The erosion is currently directed into the creek. We suggest redirecting the flow into
the small sediment basin prior to discharge. Additionally, the sediment basin should be cleaned out.
Permit conditions require Best Management Practices (BMP) inspections to be conducted at least once
every seven calendar days and within 24 hours of any storm event that results in a discharge (NCG020000
Part III Section A.3).

No mining occurs at this site. Olivine is transported to this site from Unimin's Green Mountain Plant #1 in
Yancey County and is bagged and shipped from the Mitchell County site (Green Mountain Plant #2), No
crushing or wet processing occurs at this Mitchell County site. The only stormwater runoff leaving Green
Mountain Plant #2 is parking lot runoff.
Unimin should consider requesting rescission of the NCG020057 permit for Green Mountain Plant #2,
assuming that the Standard Industrial Classification (SIC Code) for this particular site does not automatically
require stormwater permit coverage. Should the SIC Code automatically require a general stormwater
permit, the Green Mountain Plant #2 site'does qualify for a no exposure exemption.

Unimin Corporation would like to request that you grant Representative Outfall
Status as per Condition No. 6 of Monitoring & Records contained in the General
Stormwater Permit. Attached please find a copy of a site drawing depicting two individual
watersheds. Watersheds 1 & 2 are very similar in nature, receiving potential pollutants only
from loading and unloading practices. The Plant No. 2 facility receives material from Green
Mountain Plant No. 1 for further processing. Please note that in both watersheds the
Stormwater travels through extensive vegetative buffers prior to entering the Toe River. Both
outfalls have similar watersheds with the same pollutants discharging from the
loading/unloading areas therefore, Unimin would like to request that stormwater samples
taken at the outfall of Watershed 1 be representative of both outfalls.

Guilford County
to receiving waters designated as Mile Branch Creek in the Cape Fear River Basin
in accordance with the effluent limitations, monitoring requirements, and other conditions set forth in Parts I, 11, 111
and IV of General Permit No. NCG020000 as attached.
This certificate of coverage shall become effective September 25, 1998.
This Certificate of Coverage shall remain in effect for the duration of the General Permit.

In accordance with your request dated March 17, 1995, we are forwarding herewith the
modified Certificate of Coverage page for the subject facility. The only change is in the formal
owner's name. This Certificate of Coverage is issued pursuant to the requirements of North
Carolina General Statute 143-215.1 and the Memorandum of Agreement between North
Carolina and the U. S. Environmental Protection Agency dated December 6, 1983.
If any parts, measurement frequencies or sampling requirements contained in this
permit are unacceptable to you, you have the right to request an individual permit by
submitting an individual permit application. Unless such demand is made, this certificate of
coverage shall be final and binding. Please take notice that this certificate of coverage is not
transferable except after notice to the Division of Environmental Management. The Division of
Environmental Management may require modification or revocation and reissuance of the
certificate of coverage.
This permit does not affect the legal requirements to obtain other permits" which may be
required by the Division of Environmental Management or permits required by the Division of
Land Resources, Coastal Area Management Act or any other Federal or Local governmental
