The reported findings indicate there is potential for the mine pit to affect the adjacent wetlands. As part of the operation and monitoring plan required by the NPDES General Permit NCG0200000, you will need to install wetland monitoring wells in the adjacent wetlands between your mine pit and Northeast Creek. The monitoring wells should be at a depth of no less than 7 feet. Please provide documentation to this office by May 15, 2010 that the wells have been installed. The water levels in the wells should be monitored at least twice per week starting June 1, 2010 and the data reported to this office quarterly. Your Operation and Monitoring Plan should include a revised map of the mine site showing the wetland boundary, the location of the wetland monitoring wells, and the discharge point for the dewatering activities. Willis 123 Tiger Hill Drive Jacksonville, NC 28540 Ref: Sand Mine on Hal [town Road — MILLI J r1T Dear Mr. Willis, A site evaluation was conducted at your sand mine located off Halltown Road in the Jacksonville area of Onslow County. The purpose of this evaluation was to determine the effect of the mine on the adjacent wetlands. The wetland boundary was flagged in the field and has been surveyed by Parker and Associates. A detailed survey has also been provided which shows the pit, wetlands, and pit water elevation at the time of the survey. At this time the dewatering has not drained the wetlands. This was apparent by the standing water, saturation in first 12" of profile, wetland vegetation present, and the presence of hydric soils. Auger borings were dug around the edge of the pit adjacent to the wetlands and the water level in the mine. Soils were found to be group II to group IV soils depending on depth. Hydraulic conductivity of the soils was found to be .01 to I" per hour. Ksat readings in the bottom of the pit were found to be 1 to 3" per hour. This data was placed in The Skaggs Method Lateral Effect model to determine the lateral effect of the mining on the wetlands. Analysis 1# I was calculated using a ksat of 1-3"per hour to a depth of 72", and an assumed restrictive layer of 72" (restrictive layer known to be deeper than 50'). The results of the model showed that a buffer of 86.6' was needed before the mining activities would affect the wetlands. The survey shows that the closest distance to the wetlands from the pit is 117', which is well beyond the 86.6'. At this time the mining operations have not dewatered the wetlands on the site. All permits will he issued by the state and are subject to all rules of the county and state. The findings are based on the conditions of the site at the time of evaluation, and any alterations may adversely impact the results. The site visit was to determine whether an operation and monitoring plan would be required due to dewatering activities frog the pit. While at the site, Ms. Willis learned that no monitoring has been conducted in accordance with the General NPDES Permit NCG020186 requirements. It was determined that active dewatering occurs from the pit to Northeast Creek classified as C-NSW waters of the State. As a result of the site inspection and a file review, the following violation is noted: Item I. Failure to Monitor: Section Ill Part A., B. and C. of your General Permit requires quarterly analytical monitoring of wastewater discharges (mine dewatering wastewater) and scmi annual qualitative monitoring. Neither has been conducted to date. A previous inspection conducted in June of 2005 by Division Representative, Pat Durrett, was documented and indicates you were notified of these requirements. Requested Response This Office requests that you respond to this letter in writing within 20 days of receipt of this Notice. You should indicate in writing when the O & M plan will be submitted to the Wilmington Regional Office for review and approval. No further dewatering can occur from the pit until you receive notification that the O & M plan has been reviewed and approved by DWQ in the Wilmington Regional Office. This Office is considering sending a recommendation for enforcement to the Director of the Division of Water Quality regarding these issues and any future/continued violations that may be encountered. She advised the permittee via the inspection report that both qualitative and quantitative monitoring was required for any stormwater and wastewater (mine dewatering) discharges. She indicated at the time of her inspection, no dewatering was occuring, but when it resumed, the permittee should contact the Regional Office for a follow up inspection. The pit has been dewatered from time to time as needed based on input from heavy rain events and some groundwater infiltration.
