Ron Boone, of the Winston-Salem Regional Office, has reviewed your requests for
Representative Outfall Status (ROS) for Vulcan Materials Company's (VMC) North Quarry and East
Forsyth Quarry, dated March 7, 2011. The results of his review are detailed below.
As we understand it:
East Forsyth Quarry, NCG020115: You are requesting ROS for SDO 003 to be
represented by SDO 005.
North Quarry, NCG020082: You are requesting ROS for.SDOs 004, 005, 006, and 007, to
be represented by SDO 003..
Based on the information and maps provided, as well as information gleaned from the
December, 2010, compliance evaluation inspections, we hereby approve both of these requests. In
accordance with 40 CFR §122.21(g)(7), you are authorized to sample SDO 005 as representative of
SDO 003 at the East Forsyth Quarry, and SDO 003 as representative of SDOs 004, 005, 006, and
007, at the North Quarry. This approval is effective with the next sampling event. Please note that all
other SDOs not expressly mentioned in this letter must still be sampled as required by the permit, i.e.
SDOs 001, 002, and 004 for the East Forsyth Quarry.
You are reminded that VMC is still required to conduct Qualitative Monitoring (QM) at all SDOs
at both quarrys, regardless of ROS. Also, please remember that any actions you initiate in response
to benchmark exceedences, as directed in the tiered response provisions of your permit, must
address all drainage areas represented by the representative outfall, where appropriate.

Please append this letter to your Stormwater Pollution Prevention Plans (SP3) or permits to
document that ROS has been approved. If changes, in drainage areas, structures, processes,
storage practices, or other activities occur that significantly alter the basis of this approval, ROS may
no longer be valid. You should either resume sampling at all SDOs, or reapply to this office for new
ROS based on the updated information.
Finally, although we have approved ROS for -both sites using this single letter, DWQ considers
each site ..completely independent of the other. Therefore, occurrences or activities that occur at one

We are writing in response to your request for an extension to collect the first semi-annual stormwater
sample under this permit. In your letter of June 23, 2010, you requested an extension to August 315t to comply with
sampling requirements at several Vulcan facilities across the state. Your letter cited reasons to support the request
that included:
• Hard copies of the new NCG020000 permit not being received until mid -February, when the permit had
become effective January 1, 2010;
• Spotty weather patterns resulting in storm events during non -operating hours that prevent sample
collection; and
• The need for additional time to train Sampling Personnel on significant changes in the permit.
One of the reasons for your request was the new provision that monthly monitoring will apply for the
remainder of the permit term, should the mine ever fail to collect a sample during a scheduled monitoring period
(footnote 1 of Table 1 in Part lil). While considering your request, the Stormwater Permitting Unit (SPU) realized this
provision may unfairly affect permittees who obtain coverage under NCG020000 in the middle of a monitoring
period. The SPU has written up guidance to address this situation and related conflicts in the permit text (see
attachment).
Recognizing there were possible conflicts with this provision that our guidance now addresses, DWQ will
grant your request for an extension to collect a stormwater sample by August 31, 2010. However, we note that
Vulcan Materials Company should have been prepared to comply with permit monitoring requirements prior to
receiving hard copies of the permit in mid -February. Specifically:

• The SPU met on several occasions with the North Carolina Aggregates Association (NCAA) through the
NCG020000 renewal process, beginning in August 2009. Vulcan Materials is a member of NCAA, and a
representative of the company attended the initial meeting.
• The provision that triggers monthly monitoring for failure to sample came out of discussions with industry
representatives during these meetings and was incorporated into the final permit as a result.
• The definition of representative storm event also changed as a result of these discussions with NCAA to
increase sampling opportunities during operating hours. A representative storm event in NCG020000 now
only requires a period of 48 hours of no rain prior to the event.
• An advance copy of the final permit was forwarded to the Executive Director of the NCAA on December 29,
2009 and subsequently distributed to NCAA members. The final NCG020000 permit was available to all
permittees on the DWQ website when it became effective in January 2010.
• Stormwater sampling requirements are not new with this renewal, even though sampling is now semi-
annual (instead of annual in the previous permit). Vulcan should have already been familiar with the
stormwater sampling requirements.

Dear Mr. Bennett,
I spoke with Ms- Bethany Georgoulias today about Vulcan Construction
Materials, LP respectfully requesting an extension of time beyond June 30th to
collect the first storm water sample for 2010. Ms. Georgoulias advised me to this
request to you for consideration.
Vulcan received its genera! permit packages in mid -February; packages were
post marked February 13t". The permit, as you are aware, was the,fiirst to be
modified requiring increased analytical monitoring, developing and implementing
an SPPP replacing the SBMP Plan and Benchmark with Tiered response
replacing Cut -Off Concentrations, requiring time to review and implement.
Since Vulcan received its permits the weather patterns have been spotty with
little wide spread patterns. Many storm events have occurred during non -
operating hours, obviously preventing sample collection within the first 30
minutes of discharge.
Although Vulcan has begun collecting storm water samples, we have a number
yet to be collected and with the current weather outlook completion by June 30t"
will be a challenge.
With Vulcan receiving its permits 45 days+/- into the permit term and realizing the
need to develop Storm water SPPP plans and train some nineteen Water
Sampling Personnel of the changes with the significantly altered permit, I
respectfully request an extension to August 31St to collect our first semi-annual
storm water sample and maintain semi-annual sampling. Our plan is to sample at
the first possible representative storm, so as to accommodate the 60 day

requirement between samples. This will not relieve us from taking our semi-
annual sample during the second half of the year.

Subject: Guidance for Monthly Monitoring Triggers under General Permit NCG020000
This memo provides guidance on the provisions in the recently renewed NCG020000 General
Permit for Mining Activities that increase monitoring as a result of failure to monitor according to
permit terms. The guidance addresses how. the Division of Water Quality (DWQ) will implement the
provision for mining operations that come under coverage of the permit in the middle of a semi-
annual (for stormwater) or quarterly (for wastewater) monitoring period. This guidance also clarifies
how permittees may be relieved of monthly monitoring.
The new NCG020000 permit became effective on January 1, 2010. Changes from the previous
permit include a provision that triggers monthly monitoring for the remainder of the permit term in
the event the permittee fails to comply with, the monitoring schedule in accordance with permit terms
(Footnote 1 in Tables 1, 4, and 7 of Part III). This trigger applies to circumstances other than
instances of no discharge during the monitoring period or adverse weather conditions that prevent a
sample from being collected during the period.
In the permit, DWQ did not clarify what happens if a permittee obtains coverage mid -cycle
and has less time to take a sample before the end of the scheduled period (for example, a Certificate -of .
Coverage (COC) effective in mid -May and a sampling period ends June 30"). That permittee is
unfairly put at a higher risk of being "kicked into" monthly monitoring for the entire permit term.
The Stormwater Permitting Unit (SPU) will address the shortfall at the time of Cl issuance
in the following way: When staff determines that a COC effective date means the permittee may
not have enough time to reasonably collect a stormwater and/or wastewater sample, the SPU may
advise the permittee that the first compliance sampling period begins on the date of the upcoming
monitoring event period. That extension will be communicated in the cover letter.
What is also unclear in the permit is that the Regional Office (RO) may still relieve a permittee
from monthly sampling after an earlier failure to sample during a scheduled period, EITHER as part
of Tier 3—in the event that a permittee is also sampling monthly because of four benchmark
exceedances (stormwater)—OR independently, should DWQ conclude the change is justified
(stormwater or wastewater). The RO may alleviate the monthly monitoring requirement in either
case, if the RO and SPU determine it appropriate. The permit text inadvertently conflicts with
DWQ's intent on this point.

permits which may be required by DENR or relieve the permittee from responsibility for compliance with any other applicable
federal, state, or local law, rule, standard, ordinance, order, judgment, or decree.

In accordance with your application for discharge permit received on February 1, 1993, we are
forwarding herewith the subject certificate of coverage to discharge under the subject state - NPDES general
permit. Issuance of this certificate of coverage supersedes the individual NPDES permit No. NC0065609.
This permit is issued pursuant to the requirements of North Carolina General Statute 143-215 .1 and the
Memorandum of Agreement between North Carolina and the US Environmental Protection agency dated
December 6, 1983.
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to request an individual permit by submitting an individual permit
application. Unless such demand is made, this certificate of coverage shall be final and binding.
Please take notice that this certificate of coverage is not transferable except after notice to the Division
of Environmental Management. The Division of Environmental Management may require modification or
revocation and reissuance of the certificate of coverage.
This permit does not affect the legal requirements to obtain other permits which may be required by the
Division of Environmental Management or permits required by the Division of Land Resources, Coastal Area
Management Act or any other Federal or Local governmental permit that may be required.
