Reference is made to your letter of September 27, 1993, regarding your
plans to discharge dredged/fill material into the waters/wetlands of an
unnamed tributary of Elk Creek, associated with the widening of an existing
pipe culvert on SR 1332 (Con Reeves Road), Amelia, Alleghany County, North
Carolina. Reference is also made to Mr. Joe Mickey's letter of October 10,
1993, in which the North Carolina Wildlife Resources Commission expressed no
objections to the planned road improvements provided that:
a. No heavy equipment is operated in the live streams in order to
minimize sedimentation and prevent introduction of other pollutants.
b. Erosion control measures should be implemented where soil is disturbed
and maintained until project completion.
For the purposes of the U.S. Army Corps of Engineers' Regulatory Program,
Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the
Federal Register on November 22, 1991, lists nationwide permits (NWP).
Authorization, pursuant to Section 10 of the Rivers and Harbors Act of 1899
and Section 404 of the Clean Water Act, was provided for the repair,
rehabilitation, or replacement of any previously authorized, currently
serviceable structure or fill; or of any currently serviceable structure or
fill constructed prior to the requirement for authorization, provided that the
structure or fill is not to be put to uses differing from those uses specified
or contemplated for it in the original permit or the most recently authorized
modification.
Special conditions of this permit state that before discharging dredged
or fill material into waters of the United States occurring within the
twenty-five mountain counties of North Carolina that contain trout waters, the
applicant will obtain a letter of approval from the North Carolina Wildlife
Resource Commission. Review of the information you have provided, and the

comments submitted by the North Carolina Wildlife Resources Commission,
reveals that your proposed work of the widening of an existing culvert for the
purpose of upgrading to meet current safety standards, is authorized by
NWP provided it is accomplished in strict accordance with the enclosed
conditions and the recommendations set forth by the Wildlife Resources
Commission. This NWP does not relieve you of the responsibility to obtain any
required State or local approval. You should contact Mr. John Dorney at
telephone [phone] regarding water quality certification.
This verification will be valid for 2 years from the date of this letter
unless the nationwide authorization is modified, reissued or revoked. Also,
this verification wi11 remain-valid for the 2 years if, during that period,
the NWP authorization is reissued without modification or the activity
complies with any subsequent modification of the NWP authorization. If during
the 2 years, the NWP authorization expires or is suspended or revoked, or is
modified, such that the activity would no longer comply with the terms and
conditions of the NWP, activities which have commenced (i.e., are under
construction) or are under contract to commence in reliance upon the NWP will
remain authorized provided the activity is completed within 12 months of the
date of the NWP's expiration, modification or revocation, unless discretionary
authority has been exercised on a case-by-case base to modify, suspend or
revoke the authorization.

Upon review, of your request for 401 Water Quality Certification to place fill material in
0.1 acres of wetlands or waters which are tributary to Elk Creek for road improvements
located at SR 1332 in Alleghany County, as described in your submittal dated 22 February,
1993, we have determined that the proposed fill can be covered by General Water Quality
Certification No. 2745 issued January 21, 1992. A copy of the General Certification is
attached. This Certification may be used in qualifying for coverage under Corps of
Engineers' Nationwide Permit No. 3.

The North Carolina Department of Transportation, District I
Maintenance plans to grade this road primarily along the
existing roadway in the 1993 - 1994 Fiscal Year. Due to the
proximity of a DEHNR Trout Stream (Name Unknown) and
replacement of pipes, we are requesting a 404 Nationwide
Permit (#3 Maintenance) from your agency.
I am sending a straight line sketch with the proposed erosion
control, stream, stream bank, and construction limits. In
addition, I am sending a typical section of the road, plan
and profile of short section around stream at Station 25+38,
general notes on erosion control, and a marked map.
By copy of this letter I am asking Mr. Joseph Mickey, Jr.,
North Carolina Wildlife Resources Commission District
Fisheries Biologist to comment directly to you concerning the
404 Nationwide Permit Request.

Encroachment in the Trout Water Buffer Zone of the DEHNR
Trout Stream (Name Unknown) and I am asking Mr. Mickey to
comment directly to me concerning the Trout Water Buffer Zone
Encroachment.

to proceed under Section 401 of the Clean Water Act from the
Division of Environmental Management.

Pursuant to your request by telephone on February 15, 1993,
for assistance in determining discharge at the above subject
site, the following is offered.
Site Location is +/- 2,500' North of US 221
Drainage area = 370 acres (Rural)
25 year discharge is 260 cfs
Estimated stream slope from USGS quad map is 0.028 ft/ft
Please find attached a copy of the calculation sheet for
subject location.

Dear Mr. Jolly:
The North Carolina Department of Transportation, District I
Maintenance plans to grade this road primarily along the
existing roadway in the 1993 - 1994 Fiscal Year. Due to the
proximity of a DEHNR Trout Stream (Name Unknown) and
replacement of pipes, we are requesting a 404 Nationwide
Permit (#3 Maintenance) from your agency.
I am sending a straight line sketch with the proposed erosion
control, stream, stream bank, and construction limits. In
addition, I am sending a typical section of the road, plan
and profile of short section around stream at Station 25+38,
general notes on erosion control, and a marked map.
By copy of this letter I am asking Mr. Joseph Mickey, Jr.,
North Carolina Wildlife Resources Commission District
Fisheries Biologist to comment directly to you concerning the
404 Nationwide Permit Request.
A request will be made on this project for a Temporary
Encroachment in the Trout Water Buffer Zone of the DEHNR
Trout Stream (Name Unknown) and I am asking Mr. Mickey to
comment directly to me concerning the Trout Water Buffer Zone
Encroachment.
Also, by copy of this letter, I am requesting authorization
to proceed under Section 401 of the Clean Water Act from the
Division of Environmental Management.
